RESOLUTION TO AMEND SAWYER COUNTY OFFICIAL ZONING MAP
WHEREAS, Wisconsin law permits Sawyer County (the "County") to adopt certain
zoning ordinances and amend its existing zoning ordinances, inciuding amendments to
the County's official zoning map;
WHEREAS, the owner of real property located at Part of the SE Yd of the NW Y<;
S01 T41N R08W' Parcel #024-841-01-2402� Tax ID#40156• 36.43 total acres• Zoned
Forestry One (F-1), and as more fully described as set forth in Exhibit A, which is
attached hereto and incorporated herein, requested a rezoning of the Property's zoning
designation from Forestry One (F-1)to Aqricultural Two (A-2) (the"Zoning Designation
Amendment");
WHEREAS, the Sawyer County Zoning Committee (the "Zoning Committee"), at
its meeting on November 15, 2023, reviewed the proposed Zoning Designation
Amendment for the Property;
WHEREAS, the Zoning Committee voted to recommend approval/denial of the
proposed Zoning Designation Amendment to the Sawyer County Board of Supervisors
("County Board°); and
WHEREAS, the County Board determined, at its meeting on December 21, 2023,
that adopting/denying the proposed Zoning Designation Amendment for the Property is
warranted to protect the health, welfare and safety of its citizens.
NOW, THEREFORE BE IT RESOLVED, by the Sawyer County Board of
Supervisors approves/denies the following:
Amendment to Official Zoninq Map. The PropeRy's zoning designation shall be
amended to Aqricultual Two (A-2).
Additional Actions. The Sawyer County Department of Zoning and Conservation
Administrator(or his/her designee) shall take all necessary steps to ensure that
the amendment adopted herein is completed.
This Resolution is recommended for adoption/disapproval by the Sawyer County Board
of Supervisors at its meeting on December 21, 2023 by this Sawyer County Zoning
Committee on this November 15, 2023.

Notice is hereby given that on December 21, 2023 the Sawyer County Board of
Supervisors adopted the proposed Zoning Designation Amendment for the Property.
The Property's zoning designation shall be amended to of the following described real
estate:
Part of the SE % of the NW '/<; S01, T41N, R08W, Parcel #024-841-01-2402; Tax ID
#40156; 36.43 total acres; Zoned Forestry One (F-1). Purpose of request is to rezone
100' x 352' or 0.80 acres of the (F-1) zone district to (A-2) as part of property sale to
adjacent property owner. The sale is contingent on the rezone approval and a new
survey map would need to 6e filed with approval of the rezone.
Any person or persons jointly aggrieved by the decision of the County Board may
commence an action in the Circuit Court for Writ of CeRiorari to review the legality of the
decision within 30 days after the date the decision was ratified by the County Board.

On November 15, 2023, the Sawyer County Zoning Committee approved your
application for a change of zone district on the following described real estate to wit:
Part of the SE '/. of the NW '/<; SOI, T41N, R08W, Parcel #024-841-01-2402; Tax ID
#40156; 36.43 total acres; Zoned Forestry One (F-1). Purpose of request is to rezone
100' x 352' or 0.80 acres of the (F-1) zone district to (A-2) as part of property sale to
adjacent property owner. The sale is contingent on the rezone approval and a new
survey map would need to be filed with approval of the rezone.
Jayne Schroeder, owner speaks in favor of the application and that there will be a
certified survey done.
Motion to approve the application by Shuman with Findings of Fact: 1) It would not be
damaging to the rights of others or property values. 2) It would not be detrimental to
ecology, wild life, wetlands or shorelands. 3) It would not create an air quality, water
supply, or pollution problem. 4.) It would not create topographical problems such as run
off, drainage, erosion, flooding, or vegetative cover removal. 5) It would not create traffic
or highway access problems. 6). It would not destroy prime agricultural lands. 7) It
would be compatible with the surrounding uses and the area. 8) It would be consistent
with the Town and/or County Comprehensive Plan. 9) It would not create an
objectionable view. Second by Righeimer. Discussion held. Roll call finds: Hessel—yes,
Wilson—yes, Shuman —yes, Maestri—yes, Righeimer—yes. All in favor.
The Sawyer County Board of Supervisors must ratify the approval of the change in
zone district before it becomes final. This will be scheduled for the County Board
meeting on December 21, 2023 at 6:30 P.M., in the Circuit Courtroom of the Sawyer
County Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person(s)
jointly aggrieved by the decision of the County Board may commence an action in the
Circuit Court for Writ of Certiorari to review the legality of the decision within 30 days
after the date the decision is ratified by the County Board.

Request: Purpose of request is to rezone a 100' x 352' area or 0.80 acres of the (F-1) zone
district to Agricultural-Two (A-2) as part of property sale to adjacent property owner. The sale is
contingent on the rezone approval and a new survey map would need to be filed with approval of
the rezone.
Summary of Request & Project History:
The applicant is requesting to rezone the above described 0.80 acres from F-1 to A-2. For
ease of explanation this piece of land will be referred as "the strip". In conversations with the
applicant the rezone is needed to sell "the strip" to the neighbor to the South. Since JBT's property
is zoned F-1 and the neighbor to the South (Arnett's property) is zoned A-2 the only way "the
strip" of land could be deeded to the neighbor would be to rezone the strip to Arnett's current zone
district and include "the strip" within a new certified survey map (CSM). Without "the strip" being
rezoned it would create a non-conforming zone district split. No additional lots are to be created
just moving property line boundaries around with the proposed rezone. Conditions cannot be added
onto a rezone. However, there are other ordinance standards that apply the with approval of a zone
district change on "the strip" it would need to be absolved into Arnett's property as 1 contiguous
lot.
The Town of Round Lake comprehensive plan does show this area as "private forest" with
the property immediately to the South identified as Agricultural. Both of these future land use
areas are similar in what they require specifically a minimum of 5-acre lot minimums. With the
proposed rezone no additional lots are to be created and resulting parcels sizes would be in excess
of 5 acres.
The majority of this surrounding land area is light residential and forestry with agricultural
and coinmercial on the east side of Hwy 77 which is "Hayward Power Sports".

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC
HEARING DATE

Your application for a Rezone will be considered at several different meetings.
You should first contact the Town Board for their review. Some Towns also
have a Planning Commission. Please contact the Town Clerk, Kathy McCoy
at 715-462-9271 or email at town@townofroundlakewi.org for the day and
time of the Planning Commission and Town Board meetings for your attendance
or the attendance of your agent.
The Sawyer County Zoning Committee will hold its Public Hearing on November
15, 2023. This Hearing will begin at 8:30 A.M. in the Sawyer County
Courthouse, 10610 Main Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Town
meetings and Zoning Committee Public Hearing. Enclosed is virtual attendance
information. A lack of information about the application may result in an
unnecessary delay of a decision. Failure to appear may also result in the denial
or tabling of the application and may result in additional fees.
If it is impossible for you or a representative to be present, please submit a
written statement directed to Ronald Buckholtz, Chairman of the Zoning
Committee addressed to this office. The statement should include your proposed
intentions or purpose of the request and a description of the general terrain and
surrounding development. Indicate how the proposal would not be contrary to the
public interest. Photographs of the property and surrounding area are
encouraged.
PLEASE NOTE: If approval is granted, a permit may be required. Land Use
Applications may be obtained from the Zoning Office or our website.
