Request: Purpose of request is to rezone entire 9.6 acres of Commercial One (G 1) to Agricultural Two (A-2) to establishing a small-scale homestead farm for personal and family use. The Shoreland/Wetland District overlay is not subject to change as part of this request. Additional Information/details: See attached additional maps included in this packet. The owner's/applicant is requesting to rezone this property to A-2 to keep livestock on the property. The nearest Agricultural zoned property is approximately 3000' away. There are inultiple other residential structures immediately in this area and other commercial zoned areas with cominercial uses. The Town of Ojibwa as part of their comprehensive plan shows this future land use designation as commercial. The designation of commercial in this area is mostly due to the proximity of this property in relation to the "down- town" area of Ojibwa around the Hwy 27/70 & Hwy 27 corridor. This property also is shown to have a large amount of wetland soils on the property but no delineated wetlands as shown on the WI DNR "Surface Water Data Viewer '. This may be viewed as spot zoning, but spot zoning is not necessarily illegal because such zoning is not necessarily inconsistent with the purposes for which zoning ordinances can be passed. However, rezoning should be consistent with long-range planning and based upon considerations which affect the whole community. Therefore, spot zoning should only be indulged where it is in the public interest and not solely for the benefit of the property owner requesting the rezoning.
