RESOLUTION TO AMEND SAWYER COUNTY OFFICIAL ZONING MAP
WHEREAS,Wisconsin law permits Sawyer County(the"County")to adopt certain
zoning ordinances and amend its existing zoning ordinances, inciuding amendments to
the County's official zoning map;
WHEREAS,the owner of real property located at:Part of the SW'/<of the NW'/<:
S29, T37N, R09W; Parcel#008-937-29-2301;Tax ID#8996; 32.53 total acres; Zoned
Agricultural One(A-1)(the"Property"),and as more fuliy described as set forth in Exhibit
A, which is attached hereto and incorporated herein, requested a rezoning of the
Property's zoning designation from Agricultural One (A-1) to Zone District
Residential/Recreational One(RR-1) (the"Zoning Designation AmendmenY');
WHEREAS,the Sawyer County Zoning Committee(the"Zoning Committee"), at
its meeting on September 15, 2023, reviewed the proposed Zoning Designation
Amendment for the Property;
WHEREAS, the Zoning Committee voted to recommend approval/denial of the
proposed Zoning Designation Amendment to the Sawyer County Board of Supervisors
("County Board");and
WHEREAS, the County Board determined, at its meeting on October 19, 2023,
that adopting/denying the proposed Zoning Designation Amendment for the Property is
warranted to protect the health,welfare and safety of its citizens.
NOW,THEREFORE BE IT RESOLVED,by the Sawyer County Board of
Supervisors approves/denies the followi�g:
Amendment to Official Zoninq Map. The Property's zoning designation shall be
amended to RR-1.
Aciditional Actions. The Sawyer County Department of Zoning and Conservation
Administrator(or his/her designee)shall take all necessary steps to ensure that
the amendment adopted herein is completed.
This Resolution is recommended for adoption/disapproval by the Sawyer County Board
of Supervisors at its meeti�g on October 19, 2023by this Sawyer County Zoning
Committee on this September 15, 2023.

Notice is hereby given that on October 19, 2023 the Sawyer County Board of
Supervisors adopted the proposed Zoning Designation Amendment for the Property.
The Property's zoning designation shall be amended to of the following described real
estate

937-29-2301; Tax ID #8996; 32.53 total acres; Zoned Agricultural One (A-1). Total lot
size subject to rezone is 9.09 total acres. Purpose of request is to change the zone

processing of CSM that would not meet dimensional requirements with an Agricultural

Any person or persons jointly aggrieved by the decision of the County Board may
commence an action in the Circuit Court for Writ of Certiorari to review the legality of the
decision within 30 days after the date the decision was ratified by the County Board.

On September 15, 2023, the Sawyer County Zoning Committee approved your
application for a change of zone district on the following described real estate to wit
Part of the SW '/< of the NW%: S29, T37N, R09W, Parcel#008-937-29-2301; Tax ID
#8996; 32.53 total acres; Zoned Agricultural One (A-1). Total lot size subject to rezone is
9.09 total acres. Purpose of request is to change the zone district of Agricultural One (A-
1) to Residential/Recreational One (RR-1) to allow processing of CSM that would not
meet dimensional requirements with an Agricultural One (A-1) zone district and to build
additional dwelling on new lot.
The Sawyer County Board of Supervisors must ratify the approval of the change in
zone district before it becomes final. This will be scheduled for the County Board
meeting on October 19, 2023 at 6:30pm., in the Circuit Courtroom of the Sawyer
County Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person(s)
jointly aggrieved 6y the decision of the County Board may commence an action in the
Circuit Court for Writ of Certiorari to review the legality of the decision within 30 days
after the date the decision is ratified by the County Board.

Town of Edgewater. Part of the SW '/4 of the NW '/4: 529, T37N, R09W; Parcel #008-937-29-
2301 ; Tax ID #8996; 32.53 total acres. Zoned Agricultural One (A-1).
Request: Purpose of request is to rezone 9.09 acres as determined by preliminary survey map to
change the zone district of Agricultural One (A-1) to Residential/Recreational One (RR-1). This
would then allow processing of certified survey map (CSM) that would not meet dimensional
requirements within an Agricultural One (A-1) zone district and to build a new dwelling on the
new lot. The ShorelandlWetland Overlay District is not subject to change as part of this request.
Additional Information/details:
See attached additional maps included in this packet. The owner's/applicant is requesting
to rezone 9.09 acres of this property from A-1 to RR-1 to further subdivide this lot. With the
placement of the existing dwelling unit on this lot and lot configuration the only way to further
subdivide this lot where they are requesting would be to rezone to a residential zone district. The
A-1 zone district would require 300' of width along the road thus the request for the zone district
change. The RR-1 zone district was requested in that there is other RR-1 zoned land immediately
south from this request as to not be viewed as spot zoning. As per conversations with the applicant
they are looking at selling the existing house on the A-1 zoned property which would be
approximately 22.98 acres and then build a new permanent residence on what would be a newly
created RR-1 zoned lot.
The Town of Edgewater comprehensive plan future land use shows this area as "shoreland".
Shoreland as defined by the Town of Edgewater comprehensive plan still references the old Lake
Classification system which is no long in effect. These Lake Classifications were initially intended
to protect environmental sensitive bodies of water. This property is located within 1000' from a
pond on the west side of County Hwy F yet the property itself does not have any frontage on said
pond. As par of the NRCS web soil survey the front portion of this property is listed as prime farm
land area with the majority of acreage beyond that would only be prime farmland if drained. The
surrounding zone districts and uses are mixed between light residential, forestry, and agricultural.

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC
HEARING DATE

Your application for a Conditional Use will be considered at several different
meetings. You should first contact the Town Board for their review. Some
Towns also have a Planning Commission. Please contact the Town Clerk,
Natalie Clemens at 715-354-7747 or email at info@toenofedgewater.com for
the day and time of the Planning Commission and Town Board meetings for your
attendance or the attendance of your agent.
The Sawyer County Zoning Committee will hold its Public Hearing on
September 15, 2023. This Hearing will begin at 8:30 A.M. in the Sawyer
County Courthouse, 10610 Main Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Town
meetings and Zoning Committee Public Hearing. Enclosed is virtual attendance
information. A lack of information about the application may result in an
unnecessary delay of a decision. Failure to appear may also result in the denial
or tabling of the application and may result in additional fees.
If it is impossible for you or a representative to be present, please submit a
written statement directed to Ronald Buckholtz, Chairman of the Zoning
Committee addressed to this office. The statement should include your proposed
intentions or purpose of the request and a description of the general terrain and
surrounding development. Indicate how the proposal would not be contrary to the
public interest. Photographs of the property and surrounding area are
encouraged.
PLEASE NOTE: If approval is granted, a permit may be required. Land Use
Applications may be obtained from the Zoning Office or our website.
