WHEREAS, Wisconsi�l law perinits Sawyer Coutlry {the "County") to adopt certain
zoning ordinances and amend its existing zoning ordinances, including amendments to the
County's official zoning map;

WHEREAS, the Sawyer County Zoning Committee (the "Loning Committee"), at its
meeting on �pril 28, 2O23, reviewed the proposed Z�ning Designation Amendment for the
Property;
WHEREAS, the 7oning Committee voted to recommend approval/denial of the proposed
Zoning Designation Amendment to the Sawyer County Board of Supervisors ("County Board");
as determined by findings of Fact included as Exhibit B.
WHEREAS,the County Board detennined, at its meeting on Mav 18, 2O23,that adopting
the proposed Zoning Designation Amendment for the Property is warranted to protect the health,
welfare and safety of its citizens.
NOW,THEREFORE BE IT RESOLVED,by the Sawyer County Board of
Supervisors approves the following:
1. Amendment to Official Zonin�Map. The Property's zoning designation shall be amended
to RR-1 Residential/Recreational One.
2. Additional Actions. The Sawyer County Department of Loning and Coi�servation
Administrator (or his/l�er designee) shall take all necessary steps to ensure that the
amendment adopted herein is completed.

Notice is hereby given that on May 19, 2023 the Sawyer County Board of Supervisors
adopted the proposed Zoning Designation Amendment for the Property. The Property's
zoning designation shall be amended to Residential/Recreational One (RR-1) to the

becomes final. This will be scheduled for the County Board mee[ing on May S8,2023 at 6:30 P.M.,in the
Circuit Courtroom of the Sawyer County Cour[house.
This decision is a recommendation to the Caunty Board of Supervisors. Any person(sJ jointly oggrieved by
the decision of the County Board may commence an action in the Circuit Court for Writ of Certiorari to

Request: Purpose of request is to rezone from Forestry One (F-1 ) to Residential/Recreational
One (RR-1) to allow portions of lot to be merged into the adjacent lots, cleaning up lot lines and
roads. No new additional lots are being created. The Shoreland/Wetland (SW) District overlay is
not part of the rezone request.
Summary of Request & Project History:
The applicant is requesting to rezone the above described 5.06 acres from F-1 to RR-1 . In
conversations with the applicant the rezone is needed to move around adjacent property lines and
easement roads. The only way that this above described property can change property lines is by
rezoning the property to the adjacent zone district of RR-1 because there would otherwise be a 5-
acre minimum lot size if kept within the F-1 District. No additional lots are to be created just
inoving property line boundaries.
The Town of Lenroot comprehensive plan does show this area as rural residential. Rural
residential as defined by the Town of Lenroot comprehensive plan are, "areas where higher density
development has occurred or is projected to occur. To accommodate this level of development, 1 .5
acre lots with a minimum of 150' on frontage or public roads is recommended." This proposed
rezone and future survey map for lot reconfiguration would meet these
requirements/recommendations.
The majority of this surrounding land area is RR-1 and F-1 with single family dwelling
development.

The following covenants and restrictions are intended for the benefit of the property, and for each owner
thereof,to protect and preserve the values,amenities,and qualities of the development.
These covenants and restrictions permanently run with the land, and appiy to and bind the owners of the
lots subject thereto and Yheir successors in interest. The covenants shall be enforceable by Fred Scheer,thc
architectural committee created herein,any owner or their respective heirs, successors and assigns.
NOW,THFREFORE,the undersibned declares that the real estate described in and referred to in
paragraph B is and shall be held,transferred, soid, and conveyed, subject to the following covenants and
restrictions on use.
1. Land Use: The use of each individual parcel is restricted to the construction and maintenance of a
single family residences. The only structures to be located on the property shall be the residential
dwelling,a gara�e, if any,and any approved outbuildings.
Following the conveyance to the original purchaser, there shall be no righY to further
divide the parcel to create an additional building site or separate parcel, unless that right is
specifically reserved in the deed. No duplex,condominium,apartment or other multi-family
hovsing configuration shall be permitted on any parcel.
2. Subcnission of Plans Prior to Commencement of Construction:
A. No construction or excavation shall be commenced until the owner has provided the
Architectural Committee co�isisting of Fred Scheer or his successor,and two current
property owners appointed by Fred Scheer with a complete set of construction plans and
specifications, including the site plan sliowing the proposed location,grade, and elevations
of the strucwres to be constructed on the site. Site plans shall conform to local ordinances
regulating the location of the resicience including,but not limited to, side tot, set backs,
rear lot,and proximity to Mosquito Brook and other defined wetlands or waterways.
B. The initial committee shall consist of Fred Scheer,Joseph A. Hoida,and Eric Maki_ ln the
event that any member of the co�nmittee is unavailable, the vacancy shall be filled by the
remaining committee members from the roster of current owners of property in"The
Brook."
C. The architectural committee is formed for the purpose of�rotecting and preserving the
quality,value,and amenities in the parcels subject to these covenants, and for the benefit
of al I of the lot owners and humeowners.
Neither the committee, nor any individual member thereof, shall be responsible or
liable to any lot ow�ner for any loss or damage ckaimed to be occasioned by or through acts

or omissions of the committee,or any individual member thereof, while directly or
indirectly exercising their rights,duties,and obligations,as required and set forth herein.
� D. Approval of plans and design shall be conditioned upon conformity with these covenants,
harmony of external design and color with existing structures,and compatibility ofthe
proposed structure's location with respect to topography, finished grade,elevation, and
neighboring structures.
3. T'Yne of Buildines, Size, and Construction Materials:
A. No exterior storage, temporary building,out or accessory building shall be placed or
constructed on any lot without the written permission of the architecturai committee,
which shall not be unreasonably withheld. Such structures shall bc compatible in sty(e
with the residence located on the property, and shall be constructed of the same materiats,
and shall conform to the zoning requirements of the local municipality.
B. Residential dwellings shall contain at least 1,000 square feeY of living floor space. "I'he
calculation of living floor space does not include porches, sun decks, basements, including
walkoitts, attached garages, breeze-ways, crawl spaces, and the Gke.
C. The improvements shall be sided with natural siding materials, i.e. wood siding, stone,
brick or stucco. Other premium siding materials may be considered for use on a case by
case basis, provided the architectural committee,at its sole discretion, approves the use, in
writing.
D. All roofs shall be a 6/12 pitch or greater.
E. All excavation and earth moving shall comply with and be subject to the requirements of
the Department ofNatural Resources,and tliose authorities having jurisdiction thereof.
Excavation shall be conducted in such a manner as to prevent run-off into or disturbance
of Mosquito Srook. 'Che�se of silt screening or other appropriate measures shall be
implemented,as required.
4. Parkingand Storaee of Vehicles:
A. The term,"vehicle", includes, but is not limited to, motor vehicles,automobiles,vucks,
motorcycles, A7�Vs, trailers,campers,boats,water craft, snowmobiles,etc.
R. Storage and parking of vehicles, whether putdoors or in a�arage constructed for thai
purpose, shall not create a nuisance and/or eyesore.
1. Outdoor parking and storage of vchicles shali be permitted on a temporary basis.
2. If a garage is constructed as part of the improvements to the property,the vehicles
located on the premises,to the extent reasonably possible, shall be stored within
the gara�e.
3. No more than four(4) usable vehicles may be stored ovtdoors on a continuous or
long term basis.
4. No junked,abandoned or unsightly vehicles shall be stored or pa�ked on the
premises.
5. Buildine Site Limitations: Each lot represents one building site. "['he original parccl purchased
from Seller shall not be divided to create an additional building site, unless specifically pennitted
and provided for in the original conveyance.
No further division of the lot or application for re-zoning shall be permitted,other than as
necessary to permit the construction of one singlc family residence on the parcel.
6. Trees: The cutting of trees and/or timber is restricted as follows:
A. The creation of a building site no greater than one(1)acre in size;
B. The removal of storm damaged or dead trees;
C. The removal of trees constituting a safety hazard.

D. No logging,clear cutting or removal of timber for purposes of sale shall take place at any
time,other than in conjunction with a thinning of the pine plantation consistent with
� nonnai timber stand improvement practices,or in conjunction with the establishment of
the building site,per item 6(A).
7. Excavation: No excavation, mining,or removal of natural resources shall be permitted on the
subject property,except as required to construct permitted improvernents and the enstallation of
landscaping.
8_ Wood Boilers: Exterior wood boilers or furnaces for the purpose of generating and providing heat
to the improvements on the property are prohibitcd.
9_ Burnine of Garbaee: The outdoor burning of garbage is prohibited.
10. Severabilitv: Invalidation of any of these covenants or restrictions by final order or final judgment
of a court of competent jurisdiction shall not affect the enforceability of the remaining restrictions
and covenants,all of which shall remain in full forcc and effect.
1 l. Amendment of Covenants: "['he Declaration of Covenants may be amended, subject to the
following:
A. Such amendment shall be in writing;
B. T'he amendment must bc approved, in writing, by 80 %of the owners of the total number
of lots in the development.

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC HEARING DATE
RZN #23-001, Fred Scheer III
Your application for a Conditional Use will be considered at several different meetings.
You should first contact the Town Board for their review. Some Towns also have a
Planning Commission. Please contact the Town Clerk, Carol Stone at 715-634-4509 or
email at carol@townoflenrootwi.gov for the day and time of the Planning Commission
and Town Board meetings for your attendance or the attendance of your agent.
The Sawyer County Zoning Committee will hold its Public Hearing on April 28, 2023.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Town meetings
and Zoning Committee Public Hearing. Enclosed is virtual attendance information. A
lack of information about the application may result in an unnecessary delay of a
decision. Failure to appear may also result in the denial or tabling of the application
and may result in additional fees.
If it is impossible for you or a representative to be present, please submit a written
statement directed to Jesse Boettcher, Chairman of the Zoning Committee addressed to
this office. The statement should include your proposed intentions or purpose of the
request and a description of the general terrain and surrounding development. Indicate
how the proposal would not be contrary to the public interest. Photographs of the
property and surrounding area are encouraged.
PLEASE NOTE: If approval is granted, a permit may be required. Land Use Applications
may be obtained from the Zoning Office or our website.
