The proposed structure to be located on the other side of a Town road (Fletcher Road) from where the primary dwelling is located and subject to Sawyer County Ordinance Section 4.26 (3): The construction of a single accessory structure on an adjacent parcel of land that are divided by a Public Roadway and defined as one contiguous tract of land by deed or survey map will also require Conditional Use Approval. Project History & Summary of Request The applicant is requesting to build a 40' x 60' accessory structure on the back side of Fletcher Road across a Town road froin where the primary dwelling is located. Recently this property owner was able to acquire additional land on the back side of the road through a missing gap in title. With this additional land the property owner is now requesting a CUP for a larger pole shed on the back- side Fletcher Road. There may be area available on the lake side of this property to fit this size structure however, the lake side area would have topography challenges associated with it. It would also limit the cumulative impacts of impervious surfaces if the new pole shed was located further away from the lake. The proposed pole shed would be located approximately 425' from the lake and would meet all other setback requirements including impervious surface requirements per the land area. See attached maps included in this packet. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant a�nees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition iinposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are ar shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence.
