Request: Permit desired for a 40' x 80' accessory structure on vacant property per section 4.26 ( 1 ) of the Sawyer County Zoning Ordinance. This accessory structure is to meet all setbacks. As per section 4.26 ( 1 ) of the Sawyer County Zoning Ordinance. 4.26( 1 ) . . . .The construction of accessory buildings on vacant property may only be allowed by Conditional Use with Town and Zoning Coinmittee Approval. Granting of a Conditional Use will require within 3 years for a principal dwelling Land Use Permit to be applied for and the principal dwelling to be built within tlle permit tiine frame on the same parceL Failure to build principal dwelling will result in citation and order for removal of accessory structure. This pennit request is also subject to Section 4.26 (3) of the Sawyer County Zoning Ordinance in that the placement of the accessory structure will be on opposite side of the Town Road from where the future primary dwelling is to be located. Initially the request was for 4.26 (2) but after additional research was conducted the request should be for section 4.26(3) as the parcel of land is defined as one contiguous tract of land that is divided by a public road way. Section 4.26(2) would only apply if this was a separate parcel of land. Project History & Summary of Request As per conversations with the applicants the Conditional Use Permit is being requested to first build an outbuilding prior to constructing a cabin. Proposed accessory structure is to meet all other County Zoning setback and use requireinents. The size of the garage is not to exceed 40' x 80' and 1 story in height. If the CUP is granted for Section 4.26( 1 ) which is placement of an accessory structure prior to building a primary dwelling and be given a 3-year timeframe to build the primary the Committee should also address the additional request for Section 4.26(3) which is the - placement of that primary dwelling on the opposite side of the public roadway from where the accessory structure is to be placed. This is a hybrid CUP request. The accessory structure is proposed on the non-lakeside portion from where the primary is to be located due to topography concerns as well as limiting impervious surfaces near the lake. Additional.information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed inust be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence.
