Notice is hereby given that on June 16,2023 the Sawyer County Zoning Committee approved the
conditional application CUP#23-015.
Property Description:Part of Govemment Lot 2, Lot 1 CSM 12/4#2540; S34, T41N, R07W,
Parcel#024-741-34-5205; Tax ID#26338;2.50 total acres;Zoned Residential/Recreational One.
Permit desired for an accessory building 40'x 80'subject to Section 4.26(1)to allow on a vacant
parcel with conditions and Section 4.26(2J to build the accessory building on the adjacent parcel
divided by a public roadway with conditions. Primary dwelling to be built on the lake side.
Motion by Wilson to approve the application with conditions of 1)Land Use Permit is required&
applies for the accessory structure(s within 1 year from the date of the Zoning Committee decision
&built within permit timeframes. 2)Land Use Permit is required&applied for principal structure
within 3 years from the date of Zoning Committee decision&built within permit timeframe. Failure
to apply&build will result in citation with potential order for removal of accessory building. 3)
Proposed accessory structure must meet all other Sawyer County Zoning & Conservation
requirements&complaint with all other State&Federal Laws. 4)Size of proposed structure not
to exceed 40'x 80'. Must have a natural buffer surrounding property. Second by Shuman.

Any person or persons jointly aggrieved by the decision of the Zoning Committee may appeal the
decision to the Sawyer County Board of Appeals to review the legality of the decision within 30
days following the date of this notice.

Request: Permit desired for a 40' x 80' accessory structure on vacant property per section 4.26
( 1 ) of the Sawyer County Zoning Ordinance. This accessory structure is to meet all setbacks. As
per section 4.26 ( 1 ) of the Sawyer County Zoning Ordinance.
4.26( 1 ) . . . .The construction of accessory buildings on vacant property may only be allowed by
Conditional Use with Town and Zoning Coinmittee Approval. Granting of a Conditional Use
will require within 3 years for a principal dwelling Land Use Permit to be applied for and the
principal dwelling to be built within tlle permit tiine frame on the same parceL Failure to build
principal dwelling will result in citation and order for removal of accessory structure.
This pennit request is also subject to Section 4.26 (3) of the Sawyer County Zoning Ordinance in
that the placement of the accessory structure will be on opposite side of the Town Road from
where the future primary dwelling is to be located. Initially the request was for 4.26 (2) but after
additional research was conducted the request should be for section 4.26(3) as the parcel of land
is defined as one contiguous tract of land that is divided by a public road way. Section 4.26(2)
would only apply if this was a separate parcel of land.
Project History & Summary of Request
As per conversations with the applicants the Conditional Use Permit is being requested to first
build an outbuilding prior to constructing a cabin. Proposed accessory structure is to meet all other
County Zoning setback and use requireinents. The size of the garage is not to exceed 40' x 80' and
1 story in height. If the CUP is granted for Section 4.26( 1 ) which is placement of an accessory
structure prior to building a primary dwelling and be given a 3-year timeframe to build the primary
the Committee should also address the additional request for Section 4.26(3) which is the -
placement of that primary dwelling on the opposite side of the public roadway from where the
accessory structure is to be placed. This is a hybrid CUP request. The accessory structure is
proposed on the non-lakeside portion from where the primary is to be located due to topography
concerns as well as limiting impervious surfaces near the lake.
Additional.information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition imposed inust be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC HEARING DATE

Your application for a Conditional Use will be considered at several different meetings. You
should first contact the Town Board for their review. Some Towns also have a Planning
Commission. Please contact the Town Clerk, Kathy McCoy at 715-462-9271 or email at
town@townofroundlakewi.org for the day and time of the Planning Commission and Town
Board meetings for your attendance or the attendance of your agent.
The Sawyer County Zoning Committee will hold its Public Hearing on June 16, 2023. This
Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main Street,
Hayward,Wisconsin.
It is recommended that either you or a representative be present at the Town meetings and
Zoning Committee Public Hearing. Enclosed is virtual attendance information. A lack of
information about the application may result in an unnecessary delay of a decision. Failure to
appear may also result in the denial or tabling of the application and may result in additional
fees.
If it is impossible for you or a representative to be present, please submit a written statement
directed to Jesse Boettcher, Chairman of the Zoning Committee addressed to this office. The
statement should include your proposed intentions or purpose of the request and a description
of the general terrain and surrounding development. Indicate how the proposal would not be
contrary to the public interest. Photographs of the property and surrounding area are
encouraged.
PLEASE NOTE: If approval is granted,a permit may be required. Land Use Applications may be
obtained from the Zoning Office or our website.
