Request: Pennit requested to operate a general Gunsmith Service as per Sawyer County Zoning Ordinance Section 17.2(7) for a "professional office and studios and Sec 17.2(3) for a"sports shop or other recreational service-oriented use'". Project History & Summary of Request: Per the applicant's stateinent, activities will include disassembly, diagnosing, reassembly, cleaning,repairs, scope&sighting alignments utilizing bore lasers,reinoval of stuck cartridges or live rounds,restorations, and Federal Firearms License(FFL) to transfers firearms on a limited basis. There will not be direct sales of firearms from this location. However, this request does include the applicant obtaining an FFL which is handled through The Bureau of Alcohol,Tobacco, Fireanns and Explosives(ATF). The ATF requires a property to have an established business use on the property before authorizing a FFL. Tlle main intent for the applicant to obtain the FFL would be to serve as a distributor for online purchases. When individuals purchase fireanns online it must be sent to a FFL holder who then releases the firearm after proper authorization. This process is strictly regulated by the ATF. Business hours are specified as Monday thru Friday, 9am to 2pin by appointment only. The request is just to run the actual business out of the existing house on the property. Future plans may include an additional storage building if setbacks allow but no additional buildings are proposed at this time. The CUP is being requested to operate a professional office and business with a similar use to a sports shop which provides gunsmithing services. Additional information for Conditional Use Permits: Substantial evidence means facts and infonnation, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall gant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions inust be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the pennit must be supported by substantial evidence.
