Request: Permit desired for a 32' x 40' accessory structure on vacant property per section 4.26
(1) of the Sawyer County Zoning Ordinance. This accessory structure is to meet all setbacks. As
per section 4.26 (1) of the Sawyer County Zoning Ordinance.
4.26(1). . ..The construction of accessory buildings on vacant property may only be allowed by
Conditional Use with Town and Zoning Committee Approval. Granting of a Conditional Use
will require within 3 years for a principal dwelling Land Use Permit to be applied for and the
principal dwelling to be built within the permit time frame on the same parcel. Failure to build
principal dwelling will result in citation and order for removal of accessory structure.
Project History & Summary of Request
As per conversations with the applicants the Conditional Use Permit is being requested to first
build an outbuilding prior to constructing a cabin. Proposed accessory structure is to meet all other
County Zoning setback and use requirements. The size of the garage is to be 32' x 40' and
approximately 20' in height.
Additional information for Conditional Use Permits:
Substantial evidence means facts and information, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an applicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion.
If an applicant agrees to meets all of the requirements and conditions specified in the
county ordinance or those imposed by the county zoning board, the county shall grant the
conditional use permit. Any condition iinposed inust be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must deinonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

1 Land Use Permit is required and applied for the accessory structure(s)within 1 year from
the date of Zoning Committee decision and built within permit timeframes.
2 Land Use Permit is required and applied for principal structure within 3 years from date

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC HEARING DATE
CUP #23-008, Reginald & Kimberly Pontillo
Your application for a Conditional Use will be considered at several different meetings.
You should first contact the Town Board for their review. Some Towns also have a
Planning Commission. Please contact the Town Clerk, Bryn Hand at 715-634-4123 or
email at townofhayward@cheqnet.net for the day and time of the Planning
Commission and Town Board meetings for your attendance or the attendance of your
agent.
The Sawyer County Zoning Committee will hold its Public Hearing on April 28, 2023.
This Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Town meetings
and Zoning Committee Public Hearing. Enclosed is virtual attendance information. A
lack of information about the application may result in an unnecessary delay of a
decision. Failure to appear may also result in the denial or tabling of the application
and may result in additionai fees.
If it is impossible for you or a representative to be present, please submit a written
statement directed to Jesse Boettcher, Chairman of the Zoning Committee addressed to
this office. The statement should include your proposed intentions or purpose of the
request and a description of the general terrain and surrounding development. Indicate
how the proposal would not be contrary to the public interest. Photographs of the
property and surrounding area are encouraged.
PLEASE NOTE: If approval is grented, a permit may be required. Land Use Applications
may be obtained from the Zoning Office or our website.
