Town of Lenroot. Part of the SW '/ of the SE '/, Lot 1 CSM 30/92 #7534; 515, T42N, R08W;
Tax ID #39913 ; 5.67 total acres; Zoned Residential/Recreational One (RR- 1 ).
Request: Permit requested as per Section 17.2(B) (7) for a professional office/studio for the
assembly of dairy wash controls. No manufacturing is to be done onsite.
Project History & Summary of Request: In conversation with the owner they are seeking a
conditional use permit to assemble dairy wash controls on the requested property. This property is
a vacant parcel immediately adjacent to the parcel that contains their primary dwelling. Currently
this use is being performed elsewhere in the City of Hayward but are wanting to relocate this
"Professional Office/Studio" to their home residence parcel(s). As part of this request there would
be no manufacturing done onsite. Outside vendors would manufacture specific parts of the product
and ship them to this location. The property owners would then take several different pieces and
assemble them into the final product and reship to other destinations. This would be done by light
tools such as general power tools and hand tools. UPS would then ship out the final product.
As part of this request the property owners would be constructing a new building as part of this
use on the property. With any type of new "non-habitable building' it will require that a deed
restriction or restrictive covenants is also submitted between the lot containing the new
"professional office/studio" and the existing dwelling. This would then require that both properties
are sold together. The reason this is needed is because this CUP would be limited to the property
owner. If the property owner sells, then the CUP is voided and whatever structures inay be placed
out there would not be allowed as an accessory structure on vacant land. Thus, combining the lots
with the deed restriction would just be viewed as an accessory structure that is still combined back
with a lot containing a dwelling. The proposed accessory structure size has not been identified yet
but would need to meet all requirements. The "use" of the building is what requires the CUP.
Additional information for Conditional Use Permits:
Substantial evidence means facts and infonnation, other than merely personal preferences
or speculation, directly pertaining to the requirements and conditions an appiicant must meet to
obtain a conditional use permit and that reasonable persons would accept in support of a
conclusion. If an applicant agrees to meets all of the requirernents and conditions specified in the
county ordinance or those imposed by tlle county zoning board, the county shall gant the
conditional use permit. Any condition imposed must be related to the purpose of the ordinance
and be based on substantial evidence. The conditions must be reasonable and, to the extent
practicable, measurable. The applicant must demonstrate that the application and all
requirements and conditions established by the county relating to the conditional use are or shall
be satisfied, both of which must be supported by substantial evidence. The county's decision to
approve or deny the permit must be supported by substantial evidence.

My husband Jeff and I are seeking a conditional use permit to move our business from the
above address to our property on Old 00 Road in Seeley. I have outlined our business structure
below.
Bender Machine Works, Inc., is owned and operated by Jeff& Cindy Schmid. We do not have
any employees and do not sell our products via a storefront.
We are a small manufacturer of dairy pipeline and wash controls. Our controls are assembled
by Jeff and shipped via UPS by myself. Additionally, we sell parts for our products, also shipped
by UPS. I do all of the administrative work and help with other tasks in the areas of shipping and
parts/inventory.
The components used for our controls are fabricated and procured from outside vendors. We
do not manufacture any plastic or electrical components. Assembly of our product is done
solely by Jeff with hand tools. We do not sell or store chemical solutions used in the wash
u n its.

NOTICE OF TOWN MEETINGS AND ZONING COMMITTEE PUBLIC HEARING DATE

Your application for a Conditional Use will be considered at several different meetings. You
should first contact the Town Board for their review. Some Towns also have a Planning
Commission. Please contact the Town Clerk,Carol Stone at 715-634-4509 or email at
carol@townoflenrootwi.gov for the day and time of the Planning Commission and Town Board
meetings for your attendance or the attendance of your agent.
The Sawyer County Zoning Committee will hold its Public Hearing on April 28, 2023. This
Hearing will begin at 8:30 A.M. in the Sawyer County Courthouse, 10610 Main Street,
Hayward,Wisconsin.
It is recommended that either you or a representative be present at the Town meetings and
Zoning Committee Public Hearing. Enclosed is virtual attendance information. A lack of
information about the application may result in an unnecessary delay of a decision. Failure to
appear may also result in the denial or tabling of the application and may result in additional
fees.
If it is impossible for you or a representative to be present, please submit a written statement
directed to Jesse Boettcher, Chairman of the Zoning Committee addressed to this office. The
statement should include your proposed intentions or purpose of the request and a description
of the general terrain and surrounding development. Indicate how the proposal would not be
contrary to the public interest. Photographs of the property and surrounding area are
encouraged.
PLEASE NOTE: If approval is granted,a permit may be required. Land Use Applications may be
obtained from the Zoning Office or our website.
