Since this parcel is currently zoned Agricultural one (A-1), a dwelling is a permitted use under 17.4(A)(1) "Year round dwellings, but only when occupied by owners and/or persons engaged in farming activities on the premises". Under 17.4(B)(1) one family and two family year round dwellings are permitted as a conditional use. I understand that the target ten acres is contiguous to larger acreage under your ownership, and can substantiate this as a permitted use with the $250 fee you provided as opposed to an additional $200 filing fee for a conditional use if you can provide proof of agricultural production in one of the forms below. I have included the verbage regarding this and can send you the complete text, but be aware this does not include cropland rental. (iv) In order to be considered an agricultural producer there must be an annual minimum oJ$1,000 gfagricultural products beingproduced sold, or bothfrom the operation or from the land in which an owner has an interest according to 7 CFR Part 1400. If there were reasons beyond the producer's control (e.g., climatic conditions such as drought) to meet this $1, 000 annual minimum, then documentation must verify that the $1, 000 minimum has been met 2 of the last 5 years. The $1, 000 threshold may be documented by using crop type acres and livestock numbers collected as part of the conservation planning inventory and estimating associated dollar values from agricultural statistics data reports or other acceptable forms ofproof including Internal Revenue Service profit or loss fom,farming Form 1040, Schedule For other accounting records certified by a tax preparer that show profit or foss from farm operations. There is not any money that changes hands per say. We allow two (2) farmers to take crops off that they fertilize and seed in exchange for leaving us with some standing crops for wild game food plots or winter feed. On the average Basil Hanson takes approximately7J�large round bales for his cattle and he leaves us 1 or 2 per year. The value of this would be $ fcgr the past to yrs. Basil Hanson Dave Kinsley takes haylage off and corn on his portion of the land. A fair guess at what this is worth is $ ;3/ d. for the past three (3) years. I agree that the land itself is agricultural, and should be in the agricultural zone district. The ordinance is clear that "Year round dwellings (are acceptable), but only when occupied by owners and/or persons engaged in farming activities on the premises" ..."one family and two family year round dwellings are permitted as a conditional use". Here are three options 1) Apply for a conditional use permit by including an additional $200 for a public hearing and we can get you on the July public hearing docket 2) You can request clarification of the rule from the Zoning and Conservation committee at their June 71h (tentative schedule) meeting. I will present that historically conditional use permits were required in the AO district. 3) From the aerial photo it appears there may have been a home site on this parcel historically. If you can provide evidence of this and the reason for its being removed was that of potential health or safety concerns, I may be able to waive the conditional use permit and issue a land use permit within the week. After we bought the above said property in 2003, we used the home for 1-'/Z years before tearing it down. There was no interior toilet so we used outdoor privies. The water inside was a sand point for wash water and not safe to drink. The electric was not safe whatsoever. Mice had chewed some of the old coverings that left bare holes in the walls and attic. We started leveling floors but found a lot of joist rotten and the floors were spongy due to moisture. When we went to the roof, the low -sloped roof was very bad, and we actually stepped through it. When we found these problems, I talked to Zoning and asked if we could demo and rebuild in the future. They didn't see a problem, but wanted us to do a soil testing for the sewer system. The outbuildings were falling down when we bought the property and had planned on removing them. All of these issues were potentially a health and safety hazard to my family. I hereby request a clarification of the rule from the Zoning and Conservation committee at the upcoming June 7, 2010 meeting. Please verify the scheduled date for this meeting.
