Shoreland vegetative buffer:
The shoreline area is to.be fully vegetated to a depth of 35 feet from the shore of any waterbody. The
exception is an access corridor of 30 feet within any 100 feet of shoreline. Indicate on the above
drawing the location of the access corridor. Owner's signature is required on the appropriate attached
Shoreland Protection Agreement. This permit cannot be issued without a signed Shoreland Protection
Agreement. if the 35 foot buffer is fully vegetative, sign the Shoreline Protection Agreement #1.
If any part of the 35 foot buffer is not in compliance with vegetative requirements, sign the Shoreline
Protection Agreement #2 - Non -Intact.
Please submit a shoreline photo to verify buffer status.
Notice: Land Use Permits expire one year from issue date.

On the Land Use permit application that was initially submitted, the 911 number for the adjacent parcel
was used. Each parcel/dwelling requires its own number. Generally speaking, local contractors deal
with these permits or regulations on a daily basis.

This letter concerns the unauthorized discharge of fill material into wetlands adjacent to
Grindstone Lake for the construction of an access road. The project site is located in Section 25,
T. 40N., R. 9W., Sawyer County, Wisconsin.
Based on your meeting with Bill Sande on July 12, 2010, it is our understanding you have
agreed to resolve your Clean Water AM violation by removing the fill material and restoring the
wetlands to pre -project conditions in accordance with the enclosed wetland restoration plan.
Once the unauthorized material is removed and the area is satisfactorily restored, we will close
our case file.

Wetland Restoration Plan
I . Appropriate erosion controls shall be implemented and maintained in accordance
with state -approved published practices until the site is stabilized. This includes,
but is not limited to, the placement of silt fence along the edge of the
upland/wetland boundary(s) and seeding the site with a temporary seed mix.
2. All sand and gravel fill material discharged into wetlands, identified as "Fill
Area" on the attached map, shall be removed and relocated to an upland area.
3. The "Fill Area" shall be backfilled with a minimum of 12 inches of original
wetland soils to match preconstruction contours and elevations. The elevations
should match the adjacent undisturbed wetlands located north and south of the
site.
4. Contact Bill Sande in our Hayward office for a compliance inspection upon
completion of items 1 thru 3 above. All restoration work shall be completed by
September 1, 2010.
5. The site shall be monitored for invasive plant species, such as purple loosestri£e
and reed canary grass. Should they appear, control shall be removal by hand or
use of an approved herbicide.
6. Representative photographs showing the restored wetlands shall be taken in June,
July, and August 2011, and be submitted to Bill Sande in our Hayward office by
September 1, 2011.
7. Corrective work, such as regrading and/or replanting the site may be necessary
should the Corps determine the wetland restoration not satisfactory.

Dear David,
The end of last week I was contacted by Eric Wellauer in Zoning and told I had to get a flood
plane report for the area I have hoped to build on. Bill, of the Corps of Engineers was in contact
with Eric and said there were still some issues that the DNR had with my proposed project. He
was willing to allow us to set the house, then restore the wetlands, and construct a foot bridge
across them. The garage would be away from that area.
Before I spend more time and money on the project I believe I need to know where you stand on
the whole thing. I have contacted Ann Michalski who did the wetland deliniation and her firm
can and would do the flood plane study, which hasn't been done on any of the lake shores
according to the map I was given. I also understand there are some permits I need which weren't
obtained when they should have been. I want to cooperate with you and have tried to work with
local people to do what is right. This land has been in my family for over a hundred years and
I've been coming up here for more than 60 of those years. I have a deep affection for the place
and want to continue to be a good custodian of the land. I hope we can work together to do
what's right, and would appreciate it if you would tell me how and when that can happen.

The Department has reviewed the Revision No. 003 submittal for the Regional Flood Elevation Determination.
The final Hec-Ras unsteady flow model for Revision No. 003 was received March 9, 2009.
The lake RFE determinations in Revision No. 003 are being approved as meeting NR 116 technical -requirements
for application of Sawyer County's Floodplain Zoning ordinance.
These Lake Regional Flood Elevations ( RFE's) were done in conjunction with the hydrology for the Billy Boy
Dam Failure analysis, which is also approved as reasonable for use as an inflow hydrograph into the Billy Boy
Dam Failure analysis.
The approval does not include stream or river flood profiles between the lakes.
Revision 003 is for the Report entitled "Regional Flood Elevation Determination Round Lake, Little
Round Lake, Osprey Lake, Lac-Cowle-Oreilles, Little Lae-Courte-Oreilles, Grindstone Lake, Little
Grindstone Lake, Sand Lake, Upper Holly Lake, Whitefish Lake" The report is dated February 2009.
Some of these Lake RFE's are repeats from a previous submittal, and some lake RFE's have been; revised slightly.
These revised RFE's supersede any previously approved RFE's. For ease of reference and to avoid future
confusion, all the RFE's are listed in this approval and are the specific results from the last Hec-Ras unsteady

Sturtevant in Madison. Mr. Sturtevant should also be supplied with a copy of the HEC-Ras floodplain RFE
analysis, as it includes the hydrology for Billy Boy Dam failure.
The Department recognizes and appreciates the considerable expense and effort Sawyer County has voluntarily

It has come to our attention that you, or someone acting for you, may have discharged
fill material into approximately 3445 square feet of wetlands adjacent to Grindstone Lake for the
construction of an access road to a building site. The project site is in Section 25, T. 40N.,
R. 9W., Sawyer County, Wisconsin.
On June 28, 2010, Bill Sande from our Hayward office determined areas north and south
of the recently constructed access road met the criteria required for jurisdictional wetlands as
outlined in the Corps of Engineers Wetland Delineation Manual and regional supplements.
These criteria include a dominance of wetland vegetation, hydric soils and wetland hydrology.
We have further determined that this wetland is a water of the United States and is
regulated by the Corps under Section 404 of the Clean Water Act. A review of our records
indicated that a Department of the Army permit has not been issued for this activity. Section 301
of the Clean Water Act (33 U.S.C. § 1311) prohibits discharges of dredged or fill material into
waters of the United States, which includes most wetlands, unless the work has been authorized
by a Department of the Army permit. Persons violating Section 301 are subject to
administrative, civil, and criminal penalties under Section 309 of the Clean Water Act (33 U.S.C.
§ 1319).
Based on our understanding of the facts and circumstances of this violation, we have
decided not to pursue legal action at this time and appreciate your cooperation in resolving this
matter as promptly as possible.
As part of our investigation, we must determine whether there are practical alternatives
available to you to accomplish your project that would not result in the need to fill wetlands. In
this case, it appears that there may be an alternative building site that would not require filling
wetlands for an access road. Permits are issued only when applicants can demonstrate that there
are no other practicable alternatives available to accomplish the project purpose. Unfortunately
time and money spent on a proposal prior to commencing the project cannot be factored into the
Corps' decision as to whether there are practicable alternatives.

We request you obtain the services of a wetland consultant to delineate the wetlands on
your property to determine whether there is a suitable alternative building site available that
would not require the construction of an access road in wetlands. The wetland delineation
should be completed in accordance with the procedures outlined in the Corps of Engineers
Wetland Delineation Manual and applicable regional supplements. Once we receive a copy of
the delineation report, we will review and schedule a meeting with you to discuss resolution
options.
A copy of the wetland delineation report should also be provided to the Wisconsin
Department of Natural Resources and the Sawyer County Zoning office for review for any state
or county permit requirements.

Doris, we'll be getting an enforcement letter out this week. Hopefully the letter will be clearer on what
DNR expects for restoration of the wetland and also what grading permit application is needed.
I have no problem with an elevated boardwalk if you are going to put your house where you originally
intended with the following conditions;
1). The wetland is restored per Corps of Engineers and DNR requirements (will be in DNR letter).
2). That you get your building permit and all approvals from the county and meet all required setbacks
and locational criteria - which may also include addressing the need for septic tank pumping and
emergency response to your proposed house - which may drive the size and structural limits on your
boardwalk.
3). You'll need an after -the -fact grading permit from DNR. Here's a weblink to our information on grading
permits. I'll also attach and provide additional information in our enforcement letter.

The end of last week I was contacted by Eric Wellauer in Zoning and told I had to get a
flood plane report for the area I have hoped to build on. Bill, of the Corps of Engineers
was in contact with Eric and said there were still some issues that the DNR had with my
proposed project. He was willing to allow us to set the house, then restore the wetlands,
and construct a foot bridge across them. The garage would be away from that area.
Before I spend more time and money on the project I believe I need to know where you
stand on the whole thing. I have contacted Ann Michalski who did the wetland
deliniation and her firm can and would do the flood plane study, which hasn't been done
on any of the lake shores according to the map I was given. I also understand there are
some permits I need which weren't obtained when they should have been. I want to
cooperate with you and have tried to work with local people to do what is right. This land
has been in my family for over a hundred years and I've been coming up here for more
than 60 of those years. I have a deep affection for the place and want to continue to be a
good custodian of the land. I hope we can work together to do what's right, and would
appreciate it if you would tell me how and when that can happen.

This letter is to confirm that you and I met at your property off of Indian Drive, Northwoods Beach, Town of
Bass Lake. Below I will describe the findings.
1. Said driveway is approximately 400 feet in length and 16 feet wide.
2. There is adequate turn around space now for an ambulance and with the improvements of a driveway
just east of your parking area, fire trucks should have no problem turning around and accessing you
residence.
3. As we discussed, some type of walk way between the parking area and the steps will be required.
4. Some type of elevated walkway over the wetland area will also be required.
5. As this is not a stream or river, the Fire Department should have no problem fighting fire as it will only
take 2 lengths of hose to reach from parking area to the residence.
6. Total distance from walkway to residence is about 80 feet.
In Conclusion, I believe there will be no hardship for Emergency Services providing service to this new
residence.

The Department of Natural Resources has evaluated your request for water quality certification
pursuant to Section 401 of the federal Clean Water Act and Chapter NR 299, Wisconsin
Administrative Code or s. 281.36(2), Wis. Stats., to temporarily place timber mats in a regulated
wetland to access the upland building site for placement of the pre-fab structure, etc. This
project affects 0.03 acres of wetlands.
Our records indicate your project is located in Section 25, Township 40 North, Range 9 West,
Town of Bass Lake, Sawyer County.
Your application is complete, and the Department has determined that this activity complies with
the conditions of the State's water quality certification. One of the conditions of these permits is
that you shall allow Department personnel reasonable entry and access to the site to inspect the
discharge for compliance with certification and applicable laws. The conditions of the Corps of
Engineers permit are the same for the state confirmation/approval. Understand that this permit is
for temporary impact during this frozen season only. Arrangements to access the building
structure permanently will have to be addressed by means of an elevated crossing that will not
impact the wetland.
This letter also is confirmation that the wetland mitigation/corrective measures taken for the
unauthorized wetland fill has been addressed to the State of Wisconsin satisfaction.
The issue of grading more than 10,000 square feet of ground disturbance within the definition of
bank for Grindstone Lake is still unresolved. A grading permit application is still needed, with
erosion controls and revegetation plan as part of the application to resolve the grading issue.

You are responsible for obtaining any permit or approval that may be required for your project by
local zoning ordinances and by the U.S. Army Corps of Engineers before starting your project.
You should also obtain any required wetland, grading or similar permits from your local Zoning
office prior to commencing this project.

septic/well, etc.. The list should include a reference to the location in the code
where each permit is listed as required.

SECTION 1.0 STATUTORY AUTHORIZATION AND PURPOSE
1.1 AUTHORITY
The Board of Supervisors of Sawyer County in regular session this first day of March,
1971 so amend all portions of the Sawyer County Zoning Ordinance except title and
repeal those conflicting portions. This ordinance is adopted pursuant to the
authorization of Sections 59.69, 59.692, 59.694, 87.30, 281.31 and 703.27 of the
Wisconsin Statutes.
1.2 PURPOSE
An ordinance regulating and restricting the location, construction, use of buildings,
structures, and the use of land in the unincorporated portions of Sawyer County and for
said purposes dividing the County into districts. Adopted for the promotion and
protection of the public health, morals, safety, and the general welfare.
1.3 INTERPRETATION
The provisions of this ordinance shall be held to the minimum requirements. Adopted
for the promotion and protection of the public health, morals, safety, and the general
welfare. Whenever the requirements of this ordinance are at variance with the
requirements of any other lawfully adopted regulations, ordinances, or private
covenants, the most restrictive, or that imposing the higher standards shall govern.
1.4 COMPLIANCE
Unless specifically exempted by law, all cities, villages, towns, and counties are
required to comply with this ordinance and obtain all necessary permits. State agencies
are required to comply when Section 13.48 (13), Wisconsin Statutes, applies. The
construction, reconstruction, maintenance and repair of state highways and bridges by
the Wisconsin Department of Transportation are exempt when Section 30.12 (4) (a),
Wisconsin Statutes, applies.

SAWYER COUNTY PROPERTY ADDRESS SYSTEM ORDINANCE
The County Board of Supervisors of the County of Sawyer does ordain as follows:
SECTION 1.0 STATUTORY AUTHORIZATION AND PURPOSE
(1) PURPOSE AND AUTHORITY
Pursuant to Section 59.02 of the Wisconsin Statutes, the Sawyer County Board of
Supervisors in regular session this 20th day of September 2001 hereby repeals the
Sawyer County Numbering and Signage Ordinance 3-98 and adopts the Sawyer County
Property Address System Ordinance.
(2) To protect the public safety and welfare, to provide for emergency services, Sawyer
County establishes a comprehensive road naming and numbering system for structures,
parcels and facilities; to create and establish regulations for such system and to provide
for its administration, control and enforcement. This ordinance is created, adopted and
amended pursuant to the authority granted in Chapters 59.01, 59.02 and 59.54(4) of the
Wisconsin Statutes.
SECTION 2.0 DEFINITIONS
For the purpose of administering and enforcing this ordinance, the terms or words used
herein shall be interpreted as follows:
(1) COMMITTEE: Sawyer County Property Address System Committee.
(2) PRIVATE ACCESS ROAD: A lane, street or other improved surface on privately
owned lands which is designated and ordinarily used for vehicular travel within a
commercial, business industrial, residential development.
(3) PROPERTY ADDRESS NUMBERING SYSTEM: Numbering system refers to the
system created by this ordinance for the numbering and signage of parcels,
buildings, and facilities in Sawyer County,
(4) PROPERTY NUMBERING SYSTEM COMPONENTS: The numbers, letters, frames
and posts used in the PROPERTY ADDRESS NUMBERING SYSTEM.
(5) ROAD NAMING SYSTEM: The system of assigning unique names to municipal and
private access roads, and the maintenance of a master road index and property
address maps.
SECTION 3.0 ROAD NAME ADMINISTRATION
Oversight of the road naming system shall be provided by the Committee and shall be
administered by the Land Records Department. Costs to the County for the road
naming system shall be limited to necessary administrative costs, including the costs of
developing and maintaining a master index and preparation of official property address
maps. The cost of securing, erecting and maintaining municipal road name signs shall
be the responsibility of the municipality.
SECTION 4.0 ROAD NAME SELECTION
The purpose of this section is to establish a uniform system for the naming of roads
location in Sawyer County.
7) Once created, a lake access parcel can never be built upon, unless its use as a lake
access parcel is removed by a conditional use permit.
_.. 8) MAJOR RECREATIONAL EQUIPMENTNEHICLES (i.e., camping equipment)
shall not be placed on the parcel.
9) Shoreline LOTS not having access per this Section or Section 4.413 shall have a dry
land access!
4.413 ISLAND DEVELOPMENT
Islands and mainland accesses that were in the same ownership as of June 15, 1995,
even though substandard in size, and remain in the same ownership after that date, do
not have to comply with this section. Same ownership means that both an island and
its mainland access must have the same owner. An island with its access may be
transferred to a different owner. However, should the island and its access be
separated (i.e., different owners) the provisions of this section shall apply.
Islands that are subdivided or developed shall meet the following requirements:
1) The owner or developer of Island lots shall provide a private lake access parcel on
the mainland for ingress and egress to the island and for the storage of vehicles and
boat trailers. The size of the mainland lake access easement or outlot shall meet the
minimum lot and parcel size requirements of the Lake Class Development Standards.
The minimum required lot area shall exclude any wetlands. A contiguous buffer area of
25 feet wide along each side lot line running the full depth of the lot shall remain in its
natural state. The cutting of vegetation or trees or the construction/placement of
buildings within the buffer area is prohibited.
2) The number of single family lots, building sites, single family units, or single family
condominium units utilizing said access shall be limited to two (2).
3) The construction or placement of any structures on the mainland access is
prohibited.
4) The creation or use of mainland land for a lake access for island development shall
be by conditional use only in the RR-1 and RR-2 zone districts in accordance with
Section 8.0. The Zoning Committee shall consider the size, shape, depth, present and
potential use of and the effect of the mainland lake access on public rights in navigable
waters.
4.414 RESORTS
1) New Resorts. The development and construction of new resorts shall comply with all
requirements of this ordinance as they pertain to the issue of land use permits for
residential dwelling construction. Each dwelling unit within such new resort must meet

(f) Filling shall comply with any local floodplain zoning ordinance and shall not
restrict a floodway or destroy the flood storage capacity of a floodplain.
(g) Channels or artificial watercourses shall be constructed with side slopes of
two (2) units horizontal distances to one (1) unit vertical or flatter which shall
be promptly vegetated, unless bulkheads or rip -rap are provided.
4.412 LAKE ACCESS
1) All private lake accesses; lake access easements; or outlots; deeded or contractual
accesses for the purpose of lake access shall meet the following requirements. Lake
access parcels that were in the same ownership as of June 15, 1995 and remain in the
same ownership, even though substandard in size, do not have to comply with this
section. Such -lake access parcels shall be restricted to lake access for only a single
family lot, a single building site, a single family unit, a single family condominium unit or
any other single area of a condominium designated as a unit. Campsites/RV sites
located on a backlot are prohibited from utilizing said access. Same ownership means
that both a lake access parcel and its backlot must have the same owner. A lake
access parcel and its backlot may be transferred to a different owner. However, should
the lake access parcel and its backlot be separated (i.e., different owners) the
provisions of this section shall apply.
2) The access to a navigable waterway for backlot or off shore development shall meet
the minimum lot and parcel size requirements of the Lake Class Development
Standards. The lot width shall be measured at right angles at all points along its side lot
lines and the minimum required lot area shall exclude any wetlands. A cleared strip,
ten (10) feet wide to contain the path that allows access to the lake through the lake
access corridor (see Lake Class Development Standards), is the only clearing that is
allowed.
3) The number of single family lots, building sites, mobile home park sites, single
family units and single family condominium units or other areas of a condominium
designated as units utilizing said access shall be limited to not more than three (3).
CAMPGROUND/RV sites located on a backlot are prohibited from utilizing said access.
4) A "Gard Gazebo" shall be the only building (structure) allowed on the lake access
parcel. An area on the landward side of the SHORELINE VEGETATION
PROTECTION AREA, not to exceed 500 square feet, may be cleared for the location of
this structure.
5) No utilities shall be allowed on the lake access parcel (gas, electricity, water or
phone).
6) The creation or use of land for a lake access shall be by conditional use only in the
RR-1 and RR-2 zone districts in accordance with Section 8.0. The Zoning Committee
shall consider the size, shape, depth, present and potential use of the lake and the
effect of the private access on public rights in navigable waters.
