Dear Mr. Cress and Mr. and Mrs. Hohenstein:
On, Thursday, June 22, 1989, the Sawyer County Zoning Board of Appeals approved
a part of your application for a variance on the following described real estate
to wit:
Unit 7, Holiday Lodge Condominium being a part of Lots 42-47, Edgewater
Beach in Govt Lot 2 S 26, T 41N, R 8W. Parcel -16.7. LC Vol 420 Re-
cords Pg 195 and Condo Plat Vol 2 Pg 51. Property is zoned RR-1. Ap-
plication is for the construction of a 18' x 20' deck addition onto an
existing dwelling at a waterline setback of 16 feet to the normal high-
water mark of Round Lake; and at a lot line setback of six (6) feet.
Variance is requested as Section 4.49 (2) , Sawyer County Zoning Ordin-
ance, requires a minimum waterline setback of 40 feet to the normal
highwater mark of a lake; and Dimensional Requirements, requires a
minimum lot line setback of ten (10) feet. Town Board has denied.
The Board of Appeals approved squaring off of the building and a deck extending
ten (10) feet out from the present building; the deck can never be enclosed in
the future.
Findings of Fact of the Board of Appeals: It would not be the basis of economic
gain or loss; it would not be a self created hardship; there would be no change
in the use in the zone district; and it would not be damaging to the rights of
others or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may co�ence an action in the Circuit Court for Writ of Certiorari to review the
legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to
Variance 89-014.
