On December 15, 1998, the Sawyer County Board of Appeals approved as amended your vari-
ance on the following described real estate to wit:

Records Page 457. .51 acres. Property is zoned Residential/Recreational One (RR-1). Applicarion
is for the razing of an existing dwelling and the replacement of a 30'x60' dwelling with a deck at
a lake setback of 53' from the ordinary high-water mark of Round Lake and a road setback of 37'
from the centerline of Peninsula Road, and the consmzction of a 24'x36' garage at a lake setback
of 46' from the ordinary high-water mark of the lake and road setback of 33' from the centerline
of Peninsula Road. Variance is requested as Secrion 4.49(1), Sawyer County Zoning Ordinance,
would require a minimum lake setback of 75' from the ordinary high-water mark of the lake, Sec-
tion 4.21(3) would require a minimum road setback of 63' fi-om the centerline of a town road. The
Town Board has denied the applicarion.
The Board of Appeals approved the amended application as follows: approve 22'x24' garage no
closer than 48' from the lake, dwelling to be moved 2 feet closer to the road.
Findings of Fact of the Board of Appeals: It would not be the basis of economic gain ar loss. It
would not be a self-created hardship. There would be no change in the use in the zone district. It
would not be damaging to the rights of others or property values. It would be due to special con-
ditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiarari to review the legality of this decision within
30 days after the date of this notice.

On September 26, 1991, the Sawyer County Zoning Board of Appeals approved with

Dear Sirs:
I have reviewed the proposal by Beverly and Stephen Pisut for a variance from Section 4.49(1), Sawyer County
Zoning Ordinance which requires a 75 foot setback from the Ordinary High Water Mark of Round Lake. The
application is for the razing of an existing building with the replacement of a 30' by 60' dwelling with a deck at
a lake setback of 53 feet from the OHWM, and the construction of a 24' by 36' garage at a lake setback of 46
feet from the OHWM.
The basic purpose of the shoreland zoning ordinance is to protect navigable waters from degradation and
deterioration which results from uncontrolled use and development of shorelands. According to Wisconsin c:�se
law, re-affirmed in the recent Wisconsin State Supreme Court decision State of Wisconsin v. Kenosha Countv
Board of Adjustment, when an applicant submits a request for a variance, he or she must show that unless a
variance is granted, he or she has no reasonable use of the property.
In other words, the party seeking the variance must prove that an unnecessary hardship will result if the variance
is not granted. The hardship must be the result of a unique condition of the property or land, and not a
condition personal to the landowner. The granting of a variance cannot be to alleviate (or accomodate) a self-
created hardship, or merely for self-convenience. See also, Section 59.694(7), Wisconsin Statutes.
I understand that Variance 91-022 was approved on September 26, 1991 for a 28' by 38' replacment building
and a garage at a road setback of 45 feet from the centerline of Peninsula Road for this site. The garage was
limited to 24'x 24' in size. A variance should include only the minimum relief necessary to allow reasonable use
of the property. To grant a variance now for a larger home and larger garage would clearly negate the definition
of minimum relief.
The Board of Adjustment may wish to explore with the applicant the possibility of additional land being available
to Mr. and Mrs. Pisut adjacent to this property for purchase. Another option open to Mr. and Mrs. Pisut is
making use of the existing cabin as it exists or within the limitations of the 50% rule.
After reviewing the request by the applicant, the Department believes that none of the above criteria are met and
recommends that the board deny the request. Thank you for the opportunity to comment on this proposal.

owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
