Thomas P.Callahan,LUP97-662:DNR Onsite Inspection for Lake Bed Determination
Backs�round:
In the summer of 1994 Todd Naas,DNR Water Management Specialist,together with
Dave Heath,then Sawyer County Zoning Administrator and myself visited the above
property. During this visit Todd Naas determined the wetland area on and adjacent to this
property to be"old lake bed"and could not be filled for any reason.
On December 2,1997 this office issued a Land Use Permit(97-662)to the Callahan's for
the construction of a new seasonal dwelling. As a part of the construction of the
dwelling,approximately 1000 yards of fill was to be placed on the property.
Construction/fill activities were stopped until DNR personnel made a final determination
as to whether this property was in deed old lakebed.

The following personnel met on the property for lakebed determination:
Dan Houston,DNR,Water Management Specialist
Jack Sandy,DNR
Chuck Froseth,Sawyer County Zoning Administrator
Bill Christman,Sawyer County Zoning Code Enforcement Officer
Dan Thompson,Bob Thompson and Sons Excavating
Dan Aouston made elevation measurements on:
• High and low points at the top of the ice ridge
• Top of lalce ice
• Lake high water level point on the lake side of the ice ridge
• Lowest point of the"old lake bed"
• Bench mark(nail in Aspen tree on top of the ice ridge)
Based on these measurements, and the fact that there is now no direct connection to the .
lake through the ice ridge, Dan Houston determined that the area in question is not lake .
bed.
Construction/fill activities were allowed to proceed with the stipulation that a 40 feet
setback is maintained from the dwelling to the wetland and that no fill is placed in the
wetland.
