We havc your land use application for a garage on a lot adjoining the lot where your house
is. Sawyer County Zoning does not allow for accessory buildings to be buIlt on lots that
do not have a primary dwelling on them.
However, since you have adjoining lots you might still be able to build your garage on the
lot. We would need youc assurance that the lots are not divided by a state, eounty or
town road. Also, the lot could not be sold with an accessory building and no primary
dwelling.

AFFIDAVIT REGARDING BRINK LAND USE APPLICATION

DAVID R. BRINK, being first duly sworn, deposes and says the following
relating to his land use application for a garage structure referred to in a letter
addressed to him, dated July 16, 1997 and signed by Debra Hammerel of the Sawyer
County Zoning Office, a copy of which is attached, marked "Exhibit A":
1. Affiant ("Brink") is the owner of a tract of land consisting of in excess
of 10 acres and having total shoreline on Lake Windigo in excess of one-half mile
(the "tract") on the north shore of Lake Windigo, Bass Lake Township, Sawyer
County, Wisconsin.
2. The tract, except for one very small parcel, was originally acquired by
Brink's grandfather, Clark Mills Brink, in 1908. It then consisted of approximately
55 acres and included approximately one and one-half miles of shoreline. It was
then improved by a cottage and several outbuildings used by the family. After the
death of Brink's grandfather in 1917, the tract and its contiguous property passed to
Brink's grandmother, Helen Bacon Brink, who sold portions of the land during the
1920's, retaining that portion of the land and all existing structures forming the
major part of the tract. The tract then passed to Brink's father, Raymond W. Brink,
who purchased the small contiguous parcel referred to earlier in, to the best of
Brink's recollection, about 1931, primarily for the purpose of assuring access to the
tract which is otherwise unitary and at the end of a dead-end private road. In about
1932 Brink's father tore down some of the old outbuildings and built a
summerhouse and a second cottage near the lakeshore. Since about 1932, (65 years
ago), the land comprising the tract has been merged into a single piece without
changes of boundaries. As improved from time to time, the property has always
been used and occupied as a unit, with its grounds, house and structures serving as
an occasional vacation home for all members of the Brink family and their guests.
3. The only changes in the nature or title to the tract occurred more than
20 years ago. Brinks' father had the property surveyed in 1970 and then gratuitously
deeded to Brink a north portion of the tract in order to make it possible for Brink to
build his own house or cottage. Brink never built on or altered the portion so
deeded to him, and the tract continued to be used and occupied as a unit by his
father and all members of the Brink family and their guests, just as before. In late
December, 1973, Brink's father died and the remaining portion, not previously
deeded to Brink, passed to Brink's mother, Carol Ryrie Brink. In turn, Brink's
mother gratuitously deeded that remaining portion to Brink in 1974. Thus title to
the total tract was legally merged and unified in Brink once again in 1974, having
been nominally divided only since about 1970.
4. In 1976, Brink removed the old main cottage and replaced it with a
modern, year-round three bedroom house in approximately the same location. In
1977, Brink remodeled the second house, converting it into a modern, year-round
two bedroom structure. He also repaired and repainted the old summer house. All
of these changes, of course, were accomplished while observing appropriate

procedures and obtaining all necessary permits. As in the past, all structures and the
whole tract were legally merged into one unit that was used interchangeably by
members of the Brink family, friends and"guests. Thus, for more than 20 years, the
entire tract has been used and occupied without change as one tract (despite the fact
that, for tax purposes, it is viewed as four parcels).
5. In the severe winter of 1997, water pipes burst in the three bedroom
house, flooding and ruining much of the structure and its contents. This drastic
damage triggered the application by Brink for a land use permit with regard to the
reconstruction and improvements to the three bedroom house and also led to the
present application to build a garage. The primary purpose of the projected garage is
to increase sheltered storage for cars, boats, lawn and garden equipment, serving
both houses, and thereby to add to the beauty and utility of the entire tract.
6. The locations of the present two houses, summerhouse and projected
garage are shown on the attached "Exhibit B" and "Exhibit C." Even if the
temporary and unused division of the tract in the early 1970's is somehow regarded
as creating two permanent lots which were not merged by their reacquisition by one
owner (Brink) more than 20 years ago, it is still evident from Exhibits B and C that
the projected garage lies on the same lot as the two houses and even if the lot line is
viewed as affected b}� the section line ar by some other factor, it is evident that the
projected garage lies in the same lot as the two-bedroom house which then would be
the principal dwelling to which the garage is an accessory building, thus providing
auto, boat and equipment storage and workshop space to that dwelling.

7. By whatever reasoning the tract may be viewed as divided into lots
(notwithstanding its merged and unitary character), it is a fact that such lots are not
divided by a state, county or town road. In fact there is no such road on the tract,
which is served solely by a single private driveway.
8. It is Brink's understanding and intention that no sale of the parcel
containing the projected garage or any other accessory building will take place
without inclusion of a primary dwelling. Brink's present intention is to improve
the beauty, efficiency, ecology and utility of the property as a whole for the benefit of
himself, his wife, his children, grandchildren, and their families, friends and
occasional guests, and he has no present intention of disposing of any part of the
property.
This affidavit is made in support of the application for permission to build
and use the described garage building.
