Re: Parcel :3.13, S 17, T 40N, R 08W, Town of Bass Lake, Owner—David Weber:
Floodplain Issues
Back�round:
David Weber presently owns the property. A large portion of the property (including the
building site)was filled in 1996 or 1997 with the permission of the DNR.
Mr. Weber was issued a Land Use Permit(#97-223) for the construction of a new
dwelling. The dwelling was never built.
The property is located in the Special Flood Hazard Area(SFHA) with the landward edge
of the flood fringe being County Highway E.
Dr. Tom Statz, a possible purchaser, contacted this office about floodplain issues and the
possibility of constructing a dwelling on this property.
Present:
Today Cindy Kuczenski and I visited the property to determine the fill elevation. My
reasoning was that if County Highway E represents the most landward edge of the SFHA,
then if the fill on the property is at the same elevation or higher than County Highway E,
then the building site should be at the Regional Flood Elevation (RFE). Therefore, if the
first floor living area were build at least 2' above the RFE (i.e., above a crawl space, drive
under garage etc.), I would issue a Land Use Permit for a dwelling on this property.
The fill is approximately 20"below the elevation of the centerline of County Highway E.
I called Dr. Statz, (715) 835-8311, and informed him of my findings/decision.
• I would issue a LUP if the fill was raised to the level of County Highway E
and the first floor living area was at least 2' above this fill level. This would
also require a dry land access to the building site no lower than the RFE. The
fill must be in place prior to the issue of the permit.
• Even though I would issue a Land Use Permit,the mortgage holder/lender
may still require flood insurance as the Flood Insurance Rate Map (FIRM) -
would still indicate that the building site was located in the SFHA. • .
• I also explained to Dr. Statz the procedure for determining the RFE if he
decided not to place any additional fill on the property (i.e., submit an
Application for Land Use Permit, denial of the application, DNR involvement
etc).
• I also explained the process of obtaining a Letter of Map Amendment
(LOMA) from FEMA to remove the parcel/structure from the SFHA.
