Creation of Habitable Living Area(LUP 00-469)
Dear Mr. Weinert:
On August 29, 2000 this office issued LUP 00-469 for the"changing of roof pitch &
foundation." The roof pitch was to be changed to "l2x 12." When the permit was issued
a I added a note to the signature page of the application - "NOTE: Increase in the amount
of habitable area is not allowed with this permit." The reason that this comment was
added is that the cabin is nonconforming (closer than 75' to the lake) and only ordinary
repair and maintenance was to be permitted on the cabin. The replacement of the
foundation and the change in roof pith are allowable as long as the cost of materials and
labor would not exceed 50% of the current estimated fair market value (CEFMV) of the
cabin. The 50% CEFMV was determined to be $18,250 with a cost of construction of
$9,200. It is for this reason that the permit was issued.
However, last week this office received an inquiry about the loft that had been created
within the cabin. The construction of a loft would amount to an increase in habitable
area. Today I visited the property and I observed a stairway leading to a loft area. Mr.
Weinert the creation of the loft area is not in accordance with the intent of the permit.
There are a couple of options available to you.
1. Reconfigure the interior of the cabin so that the lofr area ceases to exist (i.e.,
remove the stairs).
2. Apply for an after-the-fact variance to retain the loft area. The requirements
for the approval of a variance are:
A. In the absence of a variance, the property owner can make no feasible use
of the property.
B. The hardship must be unique to your parcel.
C. Loss of profit or financial inconvenience is not in of itself grounds for a
variance.
D. A self-imposed problem or inconvenience is not grounds for a variance.
