Reinemann, personally and by their attorney, Thomas G. Kissack. The Court having considered the evidence and rendered its oral decision makes the following Findings of Fact and Conclusions of Law: 1. The plaintiffs claim of title to real estate located within Sawyer County, Wisconsin„and described below by warranty deed recorded in Volume 321 of Records, Page 438 (Trial Exhibit 4). The parcel is described as follows: The East 700 feet of the Northwest Quarter of ToWnshiphwest Quarter (NW1/4-NW1/4)"of Section Thirty-o�e (31), � �oo � 2�s ' �kh����- Forty-one ( 41 ) North, Range Seven ( 7 ) West and that part of the East 700 feet of Government Lot Five ( 5 ) ; Section Thirty ( 30 ) , Township Forty-one ( 41 ) North, Range Seven ( 7 ) West , lying West of the thoroughfare described in Volume 83 of Deeds , Page 582 . This deed is given in fulfillment of that certain land contract , dated 31 March 1978 and recorded 3 April 1978 in Volume 292 of Records , Paqe 255-256 , Document No. 164033 and Amendment to Land Contract , dated 17 March 1980 , recorded 25 March 1980 in Volume 316 of Records at Page 991-492 , Document No. 173567 . 2 . The defendants claim of title to real estate located within Sawyer County, Wisconsin, and described below by land contract recorded in Volume 362 , Page 57-58 ( Trial Exhibit 6 ) . The parcel is described as follows : The Northwest Quarter of the Northwest Quarter ( NW1/4-NW1/4 ) , Section Thirty-one ( 31 ) , Township rorty-one ( 41 ) North of Range Seven ( 7 ) West and part of Government Lot Five ( 5 ) , Section Thirty ( 30 ) , Township Forty-one ( 41 ) North of Range Seven ( 7 ) West , except the East 700 feet thereof as the same were surveyed and staked on August 24 , 1946 , and that part of Government Lot 5 referred to hereinabove is described as follows : That part lying to the South of the shoreline and high ground line that bay known as Oliphant ' s Bay on Big Round Lake as measured from the intersection of the east line of the above described parcel with the South shore of Oliphant ' s Bay on Big Round Lake; thence westerly along tt�e shoreline and high ground line to the intersection with the township line or west line of the above described parcel . Excepting the following described parcel : Lot One ( 1 ) as recorded in certified survey volume 10 , pages 83-84 . Including an easement for purchasers over existing driveway , and for their heirs , representatives , successors and assigns . 3 , Both parties trace title from Emil Filter and Gertrude Filter by Warranty Deed recorded in Volume 71, Page 89 . 4 . The deeds in defendants chain of title make reference to the exception of the East 700 feet of Government Lot 5 and the NW-NW, Section 31 , Township 41 North of Range 7 West " . . . . as the same were surveyed and staked on August 24 , 1946 . . . . " . The Court finds that this exception refers to the same exception of Warranty Deed recorded in Volume 79 of Records , Page 596 , which is as VOL t5 �o � � � 7 i follows : "Except the East 700 feet of the above mentioned lands as surveyed and staked by Gobler Brothers Surveyors , August 24 , 1946" . 5 . The document purporting to be the Gobler Brothers survey of August 24 , 1946 is admissable because: A. The monuments identified upon the map have been found in the field. g, The dimensions of the parcel, the angles , distances and other geographic data are consistent with the location of the parcels and remnants of the old fence . C. The map was obtained by surveyor Peterson from an heir of the Gobler Brothers Surveyors that has possession of those documents . D. The map itself has the distinctive "North Arrow" indicator which is identical to that previously used by the Gobler Brothers Survey that they did sign and record. E. The handwritten description appears to resemble the hand of one of the Gobler Brothers , as Surveyor Peterson testified . F. The handwritten descriptions are consistent with deeds subsequently used for conveyance purposes . ( , Surveyor Ron Peterson ' s Certified Survey Map recorded in Volume 12 CSM' s , Page 88-69 as Document Number 207487 accurately re-establishes the location of the property originally intended to be conveyed by the various parties throughout the chain of title to the parcels conveyed. Further, the Peterson Certified Survey Map ( 12 CSM , Pg• 88-89 ) accurdtely establishes the location of plaintiff ' s west boundary � VOL 5 €�Q P� 2 �� v common to defendant ' s east boundary . '7 . The plaintiff ' s have proven by clear and convincing evidence, that they are entitled to judgment declaring their interest in and to Lot 1 of CSM ' s , Volume 12 CSM ' s , Page 86-89 . JUDGMENT 1 , Pursuant to Wisconsin Statutes , �841 . 10 , title to Lot One ( 1 ) of CSM ' s recorded in Volume 12 of CSM ' s , Page 88-89 as Document Number 207487 is herewith declared to be vested in Richard Hayes and Jean M. Hayes , husband and wife , in accordance with Warranty Deed recorded in Volume 321 , Page 938 . Such title is herewith confirmed and declared.
