Variance is requested as Section 4.21(1), Sawyer County Zoning Ordinance,
would require a setback of 130' from the centerline of both highways. Town
Board has approved. Village Council, Village of Exeland, has approved.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship. There would
be no change in the use in the zone district. It would not be damaging to the rights of others or
property values. It would be due to special conditions unique to the property in that she's limited
in the area that she can put them and unable to expand the pumps further away from the store.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within

Read the attached "Court llecisions Regarding the Granting of Variances" prior to
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sawver Countv
Zoning Ordinance would result in unnecessary hardship. Presen� Wisconsin case law
describes hard.ship as being present on/y when an applicant has demonstrated that he
or she will have no reasonable use of the property, in the absence of a variance. If a
parcel as a whole (but not necessarily each portion of the parcel) provides some
reasonable use for its owner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hazdship (i.e., purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be granted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
property and are not eligible for variances.
2) The hardshin must be due to unique phvsical limitations oFthe propert�ich are not
Qenerallv shared bv other properties. Growing families, additional living area for
guests, the desire For a larger garage etc., are not factors in deciding variances.
3) A variance mav not be ¢ranted which results in harm to nublic interests. The Sawyer
County Zoning Ordinance was adopted "for the promotion and protection of the
public health, morals, safety, and the general welfare." Additionally, the shoreland
zoning provisions of the Ordinance, provides for water quality, wildlife habitat,
fisheries and natural scenic beauty protection of the County's lakes, rivers and
streams
4) Other considerations:
a. Self-created hardships. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot when the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when
` , , , . .
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bv nei h�rs. In State v. Kenosha Counry Board ofAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the property. Variances are granted for hardship that pertains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.

II. This property has long been established as a"gas station,service garage,bait
shop&convenience store". A"reasonable use"would be to allow it to re�r�ain as such.
Routine maintenance,modernization,and improvements aze essential to keep any property
sustained and economically viable,which in this particular case necessitated the installation
of"new"code complying,environmentally safe fuel tanks and petroleum pumps. The
location determined for the"new"(replacement)pump island(as such)is the most
"reasonable"location possible as determined by the Dept.of Transportation,Dept.of
Natural Resources,Wisconsin State Patrol,the petroleum contractor,installer,owner,and
others with experience and knowledge as to the distances and setbacks necessary to
maintain safe and appropriate traffic flow into and around said islands;and entrance and
exit from highway without infringing on right-of-ways,property lines and other mandatory
(statutorily)required setbacks.
III. Hardships aze created by:
A.) Limited Parcel Size: The size of the parcel in question is 140'(north to south)by 157'
(east to west)or.51 acres as determined from the deed.(Vol.454 Pg 485). A major
portion of that area is consumed by 2 highway right-of-ways(see attached drawing).
B.) Size&Location of Existing Buildin¢s: The main building which is in the same
location as it was originally built,occupies another substantial portion of the remaining lot
azea. The main service entrance to the building is to the east.This factor was serious
consideration in detemuning an appropriate location for the installation of the
"replacement"pump island since the former island location(also shown on drawing)
created a significant safety concern. Someone e�ting the building too quickly could fmd
themselves in harms way from vehicles approaching or departing the former fuel island.
C.) Location of Eacistin�Well&Septic System: The attached drawing sbows the
locations of the present well&septic system. They create a"hardship"because the
location of the"new"fuel island requires certam statutory setbacks(distances)from these
appurtenances.
D.) Location of"Replacement"Septic System&Well: Presently there is a well and
septic system serving this budding which were established when the facility was
constructed. The installer has established the placement of a"new"well with
consideration as to the statutory distances from e�cisting septic and location of the"new"
replacement fuel tanks and pump island. It is the nature of these things that at some point
during the life of this establishment that the septic system will require replacement. It is
prudent that consideration be given to setting aside and preserving adequate area to
provide for the future installation of its replacement.
N. Yes. Ownership of this property and buildings by Mr. & Mrs. Blomberg was
established in October 1987 to the present. The type of use for which the property was
originally designed and built has been maintained.
V. This variance will ensure that the owner of this property will be able to
continue operating this facility and it's appurtenances in a safe and orderly manner. It will
also ensure the economic viability, that the convenience, safety, and visibility of vehiculaz
ingress and egress to and from the fueling station will not be impeded, enhanced pazking
opportunity for store & gas station customers, space for the planned new well, adequate
space for fizture septic system and that the integrity and stability of the present buIlding
and it's superstructure can remain undisturbed.
VI. Enforcement of the 130' setback as requued by section 4.21 (1) of the Sawyer
County Zoning Ordin. would not even be possible on a pazcel that only measures 157' x
140', much less being able to meet or maintain numerous other reasonable and statutorily
required setbacks from building, right-of-ways, well, septic, etc... The existing buflding
and "old" fuel station t�as had a long history with the public being well awaze of the site
and iYs accommodations as they presently exist. A vaziance to allow the "new" fuel island
to remain will only ensure that said public will be able to enjoy and safely and conveniently
continue to use these facilities.
It should also be noted that tbe "structure" in question is along an azea of highway
that is established as a "reduced" speed zone due to the intersection of highways and a
numerous amount of driveways and other non-conforming structures within a close
proximity. Therefore, "normal" setbacks in this situation are not as necessary to maintain
a degree of safety.
In addition, it has never been deternvned that the existing building, former fuel
island and other aspects of this property to be an "unreasonable use" for such a property in
this or any other similar location.

If you believe that you nzeet the criteria for the requested variance(s), you should review
the variance application for correctness, sign it, and return it to this office with a check in
the amount of$2�0.00 made out to the "Sawyer County Zoning Administration" by
Friday, August 6, 1999 for hearings in September 1999.
The "Application for Variance - Additional Information" must also be completely filled
out and returned with the Variance Application. Both documents together make up the
entire application that will be reviewed by the Sawyer County Board of Appeals. Failure
to return both of the dociiments or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public he�rings. The first hearing will held by
the Town of Weirgor at 7:30 P.M., Tuesday, September 14, 1999.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 21, 1999 in the Circuit Courtroom located in the Sawyer County
Couf-thouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sa�vyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Weirgor is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s)'that you
have requested. Therefore, you shouid coi�sider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to
4:00 P.M., Monday through Friday.
Mrs. Blomberg, as we discussed during my visit, you will be allowed to use the gas
pumps as they are now located. However, you should realize that there is the possibility
that the Sawyer County Board of Appeals may deny the variance or they may decide that
the pumps must be relocated. If the Board's decision should not be in your favor, you
would still be required to cotnply with the Board's decision.

I WOULD LIKE TO EXPRESS MY CONCERNS REGARDING THE POSSIBLE
, , REMOVAL OF THE GASOLINE TANKS AT THE WINDFALL LAKE STORE. I
FEEL THAT IT WOULD BE A POOR DECISION ON YOUR PART,BECAUSE OF
THE FACT THAT WE NEED TO REFUEL OFTEN, OUR FIRE TRUCKS, FIRE EQUIPMENT
AS WELL AS PERSONAL VEHICLES OF OUR FIRST RESPONDERS .
MRS . BLOMBERG HAS ALWAYS BEEN WILLING TO OPEN UP THE STORE FOR
US AT ANY GIVEN MOME[VT TO REFUEL. MANY TI*fES WE ARE UP AND OUT
ON THE FIRE SCENE, IN THE EARLY MORNING HOURS, AND NEED REFUELING
AS SOON AS POSSIBLE. WE ARE READY FOR OUR NEXT EMERGENCY.
BY HAVING GASOLINE ACCESSABILITY,THERE WILL NOT BE ANY REASON
WHY WE CANNOT MAKE IT TO A FIRE OR EMERBENCY. RUNNING OUT OF
GAS, ON THE WAY TO A FIRE, WOULD NOT SIT WELL; ESPECIALLY IF

As per your request, i have enclosed a series of Figures that present the delineation of soil and
groundwater contamination at the above mentioned site. Figure 2 presents the delineated extent of soil
contamination and my recommendations for placement of the new UST system and the New Potable
Well.
The new UST system must be located outside the delineated extent of soil contamination,because the
remedial adion being planned for the site will involve some degree of contaminated soil excavation
Based on former conversations with Ms. Blomberg, I have located the new UST system on Figure @
outside the clean soil borings that border the extent of contaminated soils. The new system(induding
piping)should not be installed between these borings and the extent of soil contamination,because the
new system could end up being excavated later when the remedial action is performed. Figure 2 has
three possible pump island locations that are provided. The pump island can be placed anywhere outside
of the clean soil borings that border the extent of contaminated soils.
Figures 4 through 8 present the groundwater flow directlons and isocon maps for both benzene and
Gasoline Range Organics as groundwater contaminants. Based on the location of the present/former
UST Systems,location of contaminated soil and groundwater,and location of the septic drainfield; the
best location on the property for the new potable well to be installed is to the west and possibly
northwest of the Windfall Store Building. Arrows have been drawn on Figure 2 indicating the direction
from the building for installation. This location is upgradient of the extent of groundwater
contamination, and should represent the safest location based on the non-detect analytical results for
petroleum compounds for the existing potable well which lies between the proposed new well location
and the extent of groundwater contamination. Because the presence of potential contaminant sources
(groundwater contamination, soil contamination, septic drainfield, and adjoining farmers field to the
west)it would be best if the new well was completed within a lower aquifer unit to reduce the potential
for the new well to draw potential contaminants into its cone of depression/capture zone.
