Dear Mr. Wachowicz:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request for additional information. While the court decisions relate primarily to
shoreline properties, the Sawyer County Board of Appeals may decide to discuss
"reasonable use" of property issues with you before making a decision on your
application.
If you believe that you meet the criteria for the requested variance(s), you should review
the variance application for correctness, sign it, and return it to this office with a check in
the amount of$250.00 made out to the "Sawyer County Zoning Administration" by
Friday, August 6, 1999 for hearings in September 1999.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Draper at 7:00 P.M., Wednesday, September 15, 1999. You
should contact Brenda Adler, Town of Draper Clerk, at (715) 266-5779 to confirm this
date.
The Sawyer County Board of Appealc will hold the second hearing at 7:00 P.M..,
Tuesday, September 21, 1999, in the Circuit Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the recommendation of the Town of Draper is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
Mr. Wachowicz, as I see the situation, you must convince the Sawyer County Board of
Appeals that the existing driveway access is no longer suitable for your needs.

Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sawver Countv
Zoning Ordinance would result in unnecessary hardship. Present Wisconsin case law
describes hardship as being present only when an applicant has demonstrated that he
or she will have no reasonable use of the properry, in the absence of a variance. If a
parcel as a whole (but not necessarily each portion of the parcel) provides some
reasonable use for its owner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship (i.e., purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be granted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
property and are not eligible for variances.
2) The hardshi�mus�t be due to ungue U�sical limitations of the property which are not
e� nerally sh�re�i bv other properties. Growin� families, additional living area for
guests, the desire for a larger garage etc., are not factors in deciding variances.
3) A variance mav not be granted which results in harm to public interests. The Sawyer
County Zoning Ordinance was adopted "for the promotion and protection of the
public health, morals, safety, and the general welfare." Additionally, the shoreland
zoning provisions of the Ordinance, provides for water quality, wildlife habitat,
� fisheries and natural scenic beauty protection of the County's lakes, rivers and
streams
4) Other considerations:
a. Self-created hardships. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot when the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when

Court Decisions Regarding the Granting of Variances
Two recent appellate court decisions, State v. Kenosha County Board ofAdjustment and
State ex rel. Spinner v Kenosha Counry Board ofAdjustment, have clarified the criteria
for the granting of zoning variances.
Back�round:
State statutes [�62.23(7)(e) 7.] allow for the granting of a variance when it:
will not be contrary to the public interest,where owing to special conditions, a literal enforcement
of the provisions of the ordinance will result in practical difficulty or unnecessary hardship, so that
the spirit of the ordinance shall be observed, public safety and welfare secured and substantial
justice done.
�-Iow�ver, tne statutes dc not define the meaning of "unneces>ary hardship."
Prior to these recent court decisions, an unnecessary hardship was:
"where compliance with the strict letter of the restrictions governing areas, set backs, frontage....
would unreasonably prevent the owner from using the property for a permitted purpose or would
render conformity with such restrictions unnecessarily burdensome."�
Appellate court decisions:
State v. Kenosha Coa�nry BoaYd of Adjustment—A property o�vner (Janet
Huntoon) applied for a variance to construct a 14' x 23' deck onto her home at a setback
of 64' from the ordinary high water mark of a lake. The required lake setback is 75 feet.
The Kenosha County Board of Adjustment granted the variance as a steep slope exits on
the lakeside of the house, and the Board considered this slope to be a unique property
limitation, an unnecessary hardship and a safety hazard.
The Wisconsin Supreme Court held that the board did not properly apply the standard for
unnecessary hardship. The court concluded that an unnecessary hardship exists only
when an applicant "has demonstrated that he or she w�ill have no reasonable use of the

The court stated that "when the record before the board demonstrates that the property
owner would have a reasonable use of his or her property without the variance, the
purpose of the statute takes precedence and the variance request should be denied."3
The court concluded that "[o]nly when the applicant has demonstrated that he or she will
have no reasonable use of the property, in the absence of a variance, is an unnecessary
hardship present."�
This case was decided in May 1998.
State ex rel. Spinner v Kenosha Counry Board of Adjustment 5—A property owner
(George Wronowski) applied for a variance to allo�v him to construct a 2,58� square foot
home closer than 7�' to the ordinary high water mark of navigable waters. A creek
bisects Mr. Wrono�vski's lakeshore property and a 75' setback would be required from
both the lake and the creek. 1,879 square feet of buildable area existed if all setbacks
were met.
The board granted the variance.Among other factors,the board decided that enforcing
the setback requirement would have caused an unnecessary hardship on Mr.Wronowski.
The circuit court upheld the board's decision upon appeal by a group of neighbors.
However,the court of appeals reversed.
The court of appeals pointed out that Mr.Wronowski failed to present any evidence that a
different sized house could not be bailt and meet the required setbacks.
The court concluded that to meet the unnecessary hardship test:
Wrenowski must present evidenoc demonshztine that no other home desi�n could incorporate the
setback requirement or his property.He failed to do so;therefore,a reasonable use for his
property without a variance remains a possibility.Accordingly,we find[hat the board failed to
properly apply Ihe no reasonable use standard to the evidence before it.
The above appellate court decisions are very clear in defining the role of boards of
appeal/adjustment in granti�g variances.Variances are onlv to be eranted when,in the
absence of the variance,the applicant will have no reasonable use of the propertv.

the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations by neighbors. In State v. Kenosha Counry Board ofAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the property. Variances are granted for hardship that pertains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.
