Court Decisions Regarding the Granting of Variances Two recent appellate court decisions, State v. Kenosha Counry Board of Adjustment and State ex rel. Spinner v Kenosha Counry Board ofAdjustment, have clarified the criteria for the granting of zoning variances. Back round: State statutes [�62.23(7)(e) 7.] allow for the granting of a variance when it: will not be contrary to the public interest, where owing to special conditions, a literal enforcement of the provisions of the ordinance �vill result in practical difficulty or unnecessary hardship, so that the spirit of the ordinance shall be observed, public safety and welfare secured and substantial justice done. However, the statutes do not define the meaning of "unnecessary hardship." Prior to these recent court decisions, an unnecessary hardship was: "where compliance with the strict fetter of the restrictions �overnin� areas, set backs, fronta�e. . .. «�ou(d unreasonably prevent the o�vner from usin� the property for a permitted purpose or �vould render conformity with such restrictions unnecessarily burdensome."' Appellate court decisions: State v. Kenosha Coarnty Board of Adjustrnent — A property o�vner (Janet Huntoon) applied for a variance to construct a 14� x 23 ' deck onto her home at a setback of 64' from the ordinary high water mark of a lake. The required la�:e setback is 7� feet. The Kenosha County Board of Adjustment granted the variance as a steep slope e�its on the lakeside of the house, and the Board considered this slope to be a unique property limitation, an unnecessary hardship and a safety hazard. The Wisconsin Supreme Court held that the board did not properly apply the standard for unnecessary hardship. The court concluded that an unnecessary hardship exists only v��hen an applicant "has demonstrated that he or she ��ill have no reasonable use of the property, in the absence of a variance."z The court stated that "�vhen the record before the board demonstrates that the property o�vner �vould have a reasonable use of his or her property ���ithout the variance, the purpose of the statute takes precedence and the variance request should be denied."' The court concluded that "[o]nly w�hen the applicant has demonstrated that he or she �vill have no reasonable use of the property, in the absence of a variance, is an unnecessary hardship present."� This case was decided in N1ay 1998. State e,r rel. Spinner v Kenosha Counry Board of Adjustnzent ' — A property owner (George Wronowski) applied for a variance to allow him to construct a 2,58� square foot home closer than 7�' to the ordinary high water mark of navigable ��aters. A creek bisects Mr. Wrono���ski's lakeshore property and a 7�' setback ���ould be required from both the lake and the creek. 1,879 square feet of buildable area existed if all setbacks were met. The board granted the variance.Among other factors,the board decided that enforcing the setback requirement would have caused an unnecessary hardship on Mr.Wronowski. The circuit court upheld the board's decision upon appeal by a group of neighbors. However,the court of appeals reversed. The court of appeals pointed out that Mr.Wronowski failed to present any evidence that a different sized house could not be built and mee[the required setbacks. The court concluded that to meet the unnecessary hardship test: Wronowski must presen[evidence demonstra[ing that no other home design could incorpora[e the setback requirement on his property.He failed to do so;therefore,a reasonable use for his property without a variance remains a possibility.Accordingly,we find[hat[he board failed to properly apply the no reasonable use standard to the evidence before i[. Discussion: To qualify for a variance, you must meet all three requirements of a three-step test. 1) Strict application of the dimensional requirements contained in the Sa�wer Countv Zoning Ordinance would result in unnecessary hardshio. Present Wisconsin case law describes hardship as being present only when an applicant has demonstrated that he or she tivill have no reasonable t�se of the properry, in the absence of a variance. If a parcel as a whole (but not necessarily each portion of the parcel) provides some reasonable use for its owner, then the test is not met and a variance cannot be granted. A variance cannot be granted because of a self-imposed hardship (i.e., purchasing propeRy with limitations and expecting that a variance would be granted to relieve these limitations). A variance also cannot be granted, when in the absence of the variance approval, the owner will suffer loss of profit or financial hardship. Decks and similar minor accessory struchires are not essential to the reasonable use of property and are not eligible for variances. 2) The hardship must be due to unique phvsical limitations of the propertv which are not eeneraih� shared 'nv other proqerties. Growing famiiies, additional living area ror guests, the desire for a larger garage ete., are not factors in deciding variances. 3) A variance mav not be granted which results in harm to public interests. The Sawyer County Zoning Ordinance was adopted"for the promotion and protection of the public health, morals, safety, and the general welfare." Additionally, the shoreland zoning provisions of the Ordinance, provides for water quality, wildlife habitat, fisheries and natural scenic beauty protection of the County's lakes, rivers and streams 4) Other considerations: a. Setf-created hardships. A property owner may not obtain a variance for a hardship that is self-imposed. Examples include: creating a substandard lot when the owner has sold off portions that would have prevented the hardship, creating a land- locked parcel by selling property, building during the pendency of an appeal when the owner does not prevail, and making improvements in violation of the ordinance. b. Violations bv nei h�. In State v. Kenosha Counry Board ofAdjustment, the Board of Adjustment in part based its variance on the fact that many other neighbors have decks within the setback. The court rejected that as a legitimate factor to use in determining whether the owner had a reasonable use of her property without a deck. c. Variances run with the property. Variances are granted for hardship that pertains to the conditions of the property, rather than to the person making the application. Accordingly, variances run with the property and are not terminated when the property changes hands.
