Dear Mr. Clare:
This letter is based on our visit to the Yarusso property on July 8, 2003. The issues of
concern were the 50% current estimated fair market value (CEFMV)as it pertains to the
cabin and the actual size of the dwelling that was approved by the Sawyer County Board
of Appeals.
The CEFMV of the cabin is $27,700 resulting in a 50% CEFMV of$13,850. Structural
changes to the cabin that would exceed $13,850 (materials and labor) would require the
prior approval of a variance by the Sawyer County Board of Appeals.
The Sawyer County Board of Appeals granted a variance for the construction of a 39' x
48' dwelling to be located no closer than 20' to the centerline of the easement road and no
closer than 55' to the lake.

On September 21, 1999, the Sawyer County Board of Appeals approved as amended your vari-
ance on the following described real estate to wit:
Lot 2, being part of Govt Lot 3, S 17, T 40N, R 8W, Parcel :3.12. WD Vol 401
Records Page 461; CSM Vol 4 Page 39. Property contains .92 acres. Property is
zoned ResidentiaURecreational One (RR-1). Application is far the construction of
a 34'x48' replacement dwelling (including eaves) at a setback of 55' from the or-
dinary high-water mark of Grindstone Lake and 25' from the centerline of a pri-
vate access easement. Variance is requested as Section 4.49(1), Sawyer County
Zoning Ordinance, would require a waterline setback of 75' and Section 4.21(6)
would require a setback of 30' from the centerline of the road. Town Board has
approved.
The Board of Appeals approved the application as follows: Approve replacement dwelling
39'x48' at 20' from centerline of easement road and 55' setback from lake.
Findings of Fact of the Board of Appeals: Findings of Fact of the Board of Appeals: There would
be no change in the use in the zone district. It would not be damaging to the rights of others or
property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 99-037.

Dear Mrs.Yarusso:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granring of Variances,"
• "Application for Variance-Additional Information,"and a completed
• "Variance Application."
Please review the inspection report,read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance(s),you should review
the variance application for correctness,sign it,and retum it to this office with a check in
the amount of$250.00 made out to the"Sawyer County Zoning Administration"by
Friday,August 6,1999 for hearings in September 1999.
The"Application for Variance-Additional I�formation"must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
retum both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your"Variance Application"will be reviewed at two public hearings.The first hearing
will held by the Town of Bass Lake at 6:30 P.M.,Monday,September 13,1999. You
should contact Shirley A.Miller,Town of Bass Lake Clerk,at(715)634-2172(home)to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M,
Tuesday,September 21,1999,in the Circuit Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing,especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the recommendation of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board oFAppeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

Read the attached "Court Decisions Regarding the Granting oF Variances" prior to
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sawver Countv
Zonin� Ordinance would result in unnecessary hardship. Present 6Y"isconsin cnse lmv

or she will have no reasonable a�se of the properry, in the absence of a variance. If a
parcel as a whole (but not necessarily each portion of the parcel) provides some
reasonable use for its owner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship (i.e., purchasing
propeRy with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be granted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
propertv and are not eligible for variances.
2) The hardship must be due to unique phvsical limitations of the propertv ��hich are not
eenerallv shared bv other nroo�eRies. Growing families, additinna] Gving area for
guests, the desire for a larger garage etc., are not factors in deciding variances.
3) A variance mav not be �ranted �chich results in harm to public interests. The Sawyer
Couniy Zoning Ordinance was adopted "for the promotion and protection of the
public health, morals, safety, and the general welfare." Additionally, the shoreland
zoning provisions of the Ordinance, provides for water quality, wildlife habitat,
fisheries and natural scenic beauty protection of the County's lakes, rivers and
streams
4) Other considerations:
a. Self-created hardships. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot when the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bv neighbors. In State v. Kenosha Counry Board ofAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the propertv. Variances are granted for hardship that pertains
to the conditions of the propeRy, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.
