On June 15, 1999, the Sawyer County Board of Appeals approved as amended your variance
on the following described real estate to wit:
Lot 5, being part of Govt Lot 2, S 25, T 40N, R 9W, Parcel :2. 14. WD Vol 411
Records Page 464; CSM Vol 10 Page 8. Approximately .47 acres. Property is
zoned Residential/Recreational One (RR-1 ). Application is for the construction of
a 5-7' high, 24'x35 ' irregularly shaped basement beneath an existing dwelling at a
setback of 37' from the ordinary high-water mark of Grindstone Lake and 3 ' from
an adjacent lot line; the construction of a 11 'x16' addition onto the same dwelling
and on an existing deck, at a setback of 38 ' from the lake; and the enclosure of an
existing 10'x1T screen porch at 56' from the lake. Variance is requested as Sec-
tion 4.49(2), Sawyer County Zoning Ordinance, would require a setback of 66'
from the lake as the average lake setback was determined at that distance and
Section 18.4 would require a setback of 10' from the adjacent lot line. The Town
Board has approved the application.
The Board of Appeals approved the amended application as follows: Dwelling to be moved 10'
west and 10' south to be further from the lake and the east lot line; approval for basement, deck
and screen porch.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would
not be a self-created hardship. There would be no change in the use in the zone district. It would
not be damaging to the rights of others or property values. It would be due to special conditions
unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 99-015.

Notice is hereby given that on June 15, 1999, the Sawyer County Zoning Board of
Appeals approved as amended the following application:

Approximately .47 acres. Property is zoned Residential/Recreational One

Variance Application
Dear Mr. and Mrs. Rigotti:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance(s), you should review
the variance application for correctness, sign it, and return it to this office with a check in
the amount of$250.00 made out to the "Sawyer County Zoning Administration" by
Friday, May 7, 1999 for hearings in June 1999.
The "Application for Variance -Additional Information must also be completely filled

out and returned with the Variance Application. Both documents together make up the
entire application that will be reviewed by the Sawyer County Board of Appeals. Failure
to return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Bass Lake at 6:30 P.M., Monday, June 14, 1999. You should contact Shirley
Miller, Clerk, Town of Bass Lake at (715) 634-2172 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, June 15, 1999 in the Circuit Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s) that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
The "50%rule" applies in this situation as the dwelling is a nonconforming structure - it
is closer than 75' to Grindstone Lake and 10' to the adjacent lot line. The "50% rule"
limits the cost of improvements to a nonconforming structure to less than 50% of the
structure's current estimated fair market value (CEFMV).
The Sawyer County Board of Appeals must approve a variance if the cost of these
improvements will exceed 50% of the CEFMV. The CEMFV for the house is $45,160.
Therefore, an additional variance would be required if the cost of the improvements
would exceed $22,580.
I am assuming that the cost of the materials and labor for your proposed improvements
will not exceed $22,580; therefore, I did not include the "50% rule" on the enclosed
application. If you believe that costs will exceed $22,580, then the application can be
amended to reflect the "50% rule.° You should probably contact a contractor for the cost
estimates.

Discussion:
To qualify for a variance,you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sawver County
Zonine Ordinance would result in unnecessary hardship.Present bi�isconsin case lain
describes hardship as berng present only when an applicant has demonstrated that he
or she will have no reasonable use of the properry, in the absence of n var•iance.If a
parcel as a whole(but not necessarily each poRion of the parcel)provides some
reasonable use for its owner,then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship(i.e.,purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations).A varia�ce also cannot be granted,when in the absence of the
variance approval,the owner will suffer loss of profit or financial hards6ip.Decks
and similar minor accessory stcuctures are not essential to the reasonable use of
property and are not eligible for variances.
21 The hardship must be due to unique phvsical limitations of the propertv which are not
generallv shared bv other prooeRies.Growing families,additional living area for
guests,the desire for a larger garage etc.,are not factors in deciding variances.
3) A variance mav not be granted which results in harm to public interests.The Sawyer
Couary Zoning Ordinance was adopted"for the promotion and protection of the
public health,morals,safety,and the eeneral welfare."Additionally,the shoreland
zoning provisions of the Ordinance,provides for waYer quality,wildlife habitat,
fisheries and natural scenic beauty protection of the County's lakes,rivers and
streams
4) Other considerations:
a. Self-created hardships.A property owner may not obtain a variance for a hardship
that is self-imposed.Examples include:creating a substandard lot when the owner
has sold off portions that would have prevented the hardship,creating a land-
locked parcel by selling properiy,building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bv neighbors. In State v. Kenosha Counry Board ofAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the propertv. Variances are granted for hardship that pertains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances ruo with the property and are not terminated when the
property changes hands.
