Velasquez 13078 Town Line Road Waukegan, Illinois 60087 RE: Parcel —34.1, Unit 1, Lakeland Shores Condo, S O5, T 39N, R 08W, Town of Bass Lake: Property Inspection Dear Mr. Velasquez: Enclosed is a copy of the inspection report for your property based on my visit on Friday, July 9, 1999. The purpose of my visit was to determine the feasibiliYy of constructing a second story addition onto the cabin. The average lake setback was determined at 67' from the ordinary high water mark of Lac Courte Oreilles. Flags were set at this distance from the lake. The flags are located 5` from the front of the cabin. Construction activities closer than 6T to the lake would require the prior approval of a variance by the Sawyer County Board of Appeals. The applicant must demonstrate to the Board that only through the granting of a variance can "reasonable use" be made of the property. The "50% rule" applies in this situation as the cabin is a nonconforming structure - it is closer than 75' to Lac Courte Oreilles. The "50% rule" limits the cost of improvements to a nonconforming sCructure to less than 50% of the structure's current estimated fair market value (CEFMV). The Sawyer County Board of Appeals must approve a variance if the cost of these improvements will exceed 50% of the CE,FMV. The CEMFV for the cabin is $37,700. Therefore, a variance would be required if the cost of the improvements would exceed $18,850. Again, the applicant must prove to the Board that onl5� through the granting of a variance can "reasonable use" be made of the property. We also discussed the possibility of constructing a replacement dwelling. If a replacement dwelling were to be constructed, the new dwelling must meet the setback requirements of the Sawyer County Zoning Ordinance (i.e., 7S from the lake, 20' from adjacent condominium units, 30' from the centerline of the access road, 30' from the adjacent lot line etc.). A replacement cabin could be constructed that would meet all of these setbacks. Additionally, a letter of approval from the condominium association would be required whether you construct an addition onto the existing cabin or whether you build a new cabin.
