On December 17, 1996, the Sawyer County Board of Appeals approved and denied
a portion of your application for a variance on the following described real
estate to wit:
Lot 2 in part NE} of the SE} S 1, T 39N, R 8W. Parcel
. 13.7. WD Vol 587 Records Pg 471 and CS Vol 7 Pg 92.
Parcel size is 100'/163' x 116' /245' containing .46
acres. Property is zoned Residential/Recreational One.
Application is for the construction of a 16' /2H' x 74'
open deck addition onto an existing dwelling at lot line
setbacks of 23'7" and 6' ; the razing of an existing 24'
x 28' attached garage and its replacement with a two
story 24' x 29' addition with an attached 12' x 40'
lean-to at a lot line setback of 6' all at a
construction cost exceeding 50� of the current estimated
fair market value. Variance is requested as Section �
18.4, Sawyer County Zoning Ordinance, would require lot
line setbacks of 10' and 30' for the deck addition; and
10' for the garage/lean-to addition; and Section 10.2
restricts the cost of construction to less than 507 of
the current estimated fair market value. Town Board
decision was returned with additional comments.
The Board of Appeals approved the deck addition with the stipulation that the
deck not be enclosed in the future. The Board of Appeals denied the dwelling
addition as submitted.
Findings of Fact of the Board of Appeals: There would be no change in the
use in the zone district. It would not be damaging to the rights of others
or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
96-043.

Tuesday, December 17, 1996
This hearing wi11 begin at 7:00 PM in the SaWyer County
Courthouse, 406 Main, Hayward, Wisconsin.

the Hearing. A lack of information about the situation may result
in unnecessary delay of a decision. Failure to appear may also re-
sult in the denial of the application.
If it is impossible for a representative to be present, please
submit a written statement to this office directed to Arvid H.
Va11em, Chairman of the Board of Appeals. This statement should
include a description of the general terrain; surrounding
development; your proposed intentions; and the purpose of the

requested. Explain the undue zoning hardship inflicted upon the

Dear Mr. and Mrs. Ziebell:
Attached is a copy of the inspection report based on my visit to the above property on
Monday, 21 October 1996. As you know, the required lot line setbacks for the
proposed deck are 10' and 30', while the required lot line setback for the ;arage/lean-to
is 10 feec Because both the deck and the garage/lean-to will be constructed closer co
their respective lot lines than required, the prior approval of a variance application by
[he Sawyer County Board of Appeals is needed before construction can begin.
I have enelosed a completed "Variance Application." Please review the application,
and if correct, sign it and return it to this office with a check in the amount of $250.00
made out to the "Sawyer County Zoning Administration. " The application and check
must be in this office by 4:00 P.M., Friday, O1 November 1996 for public hearings in
December 1996.
Your "Variance Application" will be reviewed at two public hearings. The first
hearing will be held by the Town of Hayward at 7:30 P.M. , Tuesday, 03 December
1996. You should reconfirm this date with Mrs. Arlene Mizerka, Town Clerk, Tel:
(715) 634-8325. The second hearing will be held by the Sawyer County Board of
Appeals at 7:00 P.M. , Tuesday, 17 December 1996 in the Circuit Courtroom located in
the Sawyer County Courthouse. You, or your representa[ive, should attend each
hearing, especially the hearing conducted by the Sawyer County Board of Appeals.
Only the Board oY Appeals can grant the variance, the opinion of the Town of Hayward
is advisory only.
You must provide this office with an estimate of the anticipated costs of materials and
labor for both projects. The estimated costs should be divided into: (1) the estimated
cost of materials and labor to construct the deck and to enclose the garage/lean-to
addition, (2) the estimated cost of materials and labor to finish the interior of the
garage/lean-to addition, (3) the estimated cost of materials and labor to
improve/renovate the existing structure as a result of constructing the deck and/or the
garage/lean-to and (4) the total cost of all materials and labor involved in both the deck
and garage/lean-to projects. This information shall be in this office five working days
prior to scheduled meeting of the Sawyer Counry Board of Appeals.
It is vour responsibility to convince the Board of Appeals to grant the variances that
you have requested. Therefore, you should consider using any means at your disposal
(i.e., photographs, drawings, a good verbal presentation etc.) as you present your facts
to the Board.
