Dear Mr. and Mrs. Tyson:
On December 17, 1997, the Sawyer County Board of Appeals approved your application
for a variance on the following described real estate to wit:
Part Govt Lot 1 S 36, T 41N, R 8W. Parcel :1.13. QCD
Vol 393 Records Pg 31. Parcel size is 120'/130' x
170'/210' containing approximately .48 acres. Property
is zoned Residential/Recreational One. Application is
for the razing of an existing dwelling and the
construction of a replacement dwelling at a waterline
setback of 52 feet from the ordinary highwater mark of
Round Lake. Variance is requested as Section 4.49 (1),
Sawyer County Zoning Ordinance, would require a
waterline setback of 75 feet from the ordinary highwater
mark of the lake. Town Board approved.
The Board of Appeals approved a waterline setback of 55 feet from the ordinary
highwater mark of Round Lake.
Findings of Fact of the Board of Appeals: Sufficient lowland behind the dwelling
to prevent the new dwelling to be constructed further back. There would be
no change in the use in the zone district.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
96-042.

Dear Mr. and Mrs. Tyson:
Attached is a copy of the inspection report based on my visit to your property on
Wednesday, 16 October 1996. As you know, the required waterline setback for the
construction of your proposed replacement dwelling is 75 feet. However, because you
desire to construct the dwelling at a waterline setback of 52 feet, the prior approval of a
variance application by the Sawyer County Board of Appeals is required before
construction can begin.
I have enclosed a completed "Variance Application. ' Please review the application,
and if conect, sign it and retum it to this office with a check in the amount of $250.00
made out to the "Sawyer County Zoning Administration. " The application and check
must be in this office by 4:00 P.M. , Friday, O1 November 1996 for public hearings in
December 1996.
Your "Variance Application" will be reviewed at two public hearings. The first
hearing will be held by the Town of Hayward at 7:30 P.M. , Tuesday, 03 December
1996. You should reconfirm this date with Mrs. Arlene Mizerka, Town Clerk, Tel:
(715) 634-4123. The second hearing will be held by the Sawyer Counry Board of
Appeals at 7:00 P.M. , Tuesday, 17 December 1996 in the Circuit Courtroom located in
the Sawyer County Courthouse. You, or your representative, should attend each
hearing, especially the hearing conducted by the Sawyer County Board of Appeals.
Only the Board of Appeals can �rant the variance, the opinion of the Town of Hayward
is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation etc.) as you present your facts to the
Board.
Please contact this office if you have any questions or comments. Mrs. Kelly Sake,
