Notice is hereby given that on December 17, 1996> the Sawyer County Zoning
Board of Appeals approved the following application:
Lot B in Govt Lot 6 S 2, T 39N, R SW. Parcel :6.6. QCD
Vol 433 Records Pg 441 and CS Vol 2 Pg 171. Parcel size
is 108'/110' x 156'/176' containing .47 acres. Property
is zoned Residential/Recreational One. Application is
for the raising of an existing 20 x 25' dwelling; the
construction of a 12' x 25' proposed addition onto the
existing dwelling; and the construction of a 25' x 32'
full basement beneath the existing dwelling and proposed
addition; all at a waterline setback of 21 feet from the
ordinary highwater mark of Barber Lake and at a
construction cost exceeding 509 of the current estimated
fair market value. Variance is requested as Section 4.49
(2), Sawyer County Zoning Ordinance, would require a
waterline setback of 51.6 feet as the average waterline
setback was determined at 51.6 feet form the ordinary
highwater mark of the lake; and Section 10.2 restricts
the cost of construction to less than 50� of the current
estimated fair market value. Town Board approved.
The Board of Appeals is requiring the dwelling be moved back and the closest=
part of the dvelling shall not be closer than 30 feet from the ordinary
highwater mark of the lake. The addition, basement addition and construction
costing more than 50� of the current estimated fair market value have been
approved at this new setback.
Findings of Fact of the Board of Appeals: There would be no change in the
use in the zone district. It would be due to special conditions unique to
the property. There are wetlands behind the dwelling.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.

Application for Variance
Dear Mr. Simono:
Attached is a copy of the inspection report based on my visit to your property on
Tuesday, 22 October 1996. As you know, the required waterline setback for the
proposed addition and the existing cabin is 51.6 feet. Therefore, the prior approval of
a variance application by the Sawyer County Board of Appeals is required before
consCruction can begin, as the cabin/addition will be at a waterline setback of 21'/24
feet..
I have enclosed a completed "Variance Application." Please review the application,
and if correct, sign it and return it to this office with a check in the amount of $250.00
made out to the "Sawyer Counry Zoning Administration." The application and check
must be in this office by 4:00 P.M., Friday, Oi November 1996, for public hearings in
December 1996.
Your "Variance Application" will be reviewed at two public hearings. The first
hearing will be held by the Town of Winter. You must call Mrs. Arlene Bishop. Town
Clerk/Treasurer, Tel: (715) 266-3131 for the exact date/time of this meeting. The
second hearing will be held by the Sawyer County Board of Appeals at 7:00 P.M.,
Tuesday, 17 December 1996 in the Circuit Courtroom located in the Sawyer County
Courthouse. You, or your representative, should attend each hearing, especially the
hearin� conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the opinion of the Town of Winter is advisory only.
You must provide this office with an estimate of the anticipated costs of materials and
labor for this project. The estunated costs should be divided into: (1) the estimated cost
of materials and labor to raise the existing dwelling and add the full basement under
both the cabin and the proposed addition (2) the estimated cost of materials and labor to
enclose the addition, (3) the estimated cost of materials and labor ro finish the interior
of the addition, (4) the estunated cost of materials and labor to improve/renovate the
existing structure and (5) the total cost of all materials and labor involved in the project.
This information shall be in this office five working days prior to scheduled meeting of
the Sawyer Counry Board of Appeals.
It is your responsibility co convince the Board of Appeals to ;rant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation etc.) as you present your Yacts to the
Board.
