Dear Ms. Bishop:
On December 17, 1996, the Sawyer County Board of Appeals approved your application
for a variance on the following described real estate to wit:
Lot 19, Round Lake Park in Govt Lot 6 S 23, T 41N, R
SW. Parcel -4.19. WD Vol 365 Records Pg 139 and Plat
Envelope 12. Parcel size is 299'/300' x 315'/321'
containing 2.15 acres. Property is zoned Residential/
Recreational One. Application is for the creation of
three parcels with a minimum lot width of 99.91 feet
each and a lot line setback of zero feet for an existing
dwelling from a proposed lot line. Variance is
requested ad Section 18.3, Sawyer County Zoning
Ordinance, would require a minimum lot width of 100 feet
and Section 18.4 would require a minimum lot line
setback of 10 feet. Town Board approved.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship.
There would be no change in the use in the zone district. It would not be
damaging to the rights of others or property values. It would be due to special
conditions unique to the property. Road frontage includes the fact that the
existing house on lot 3 is at a zero setback from the lot line.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.

Your application for a variance wi11 be considered at a Public Hearing
before the Sawyer County Zoning Board of Appeals on
December 17, 1996
This hearing wi11 begin at 7:00 P.M. in the Sawyer County Courthouse,
406 Main, Hayward, Wisconsin.
It is recommended that either you or a representative be present
at the Hearing. A lack of information about the situation may result
in unnecessary delay of a decision. Failure to appear may also re-
sult in the denial of the application.
If it is impossible for a representative to be present, please submit
a written statement to this office directed to Arvid H. Vallem, Chairman
of the Board of Appeals. This statement should include a description
of the general terrain; surrounding development; your proposed intentions;
and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hardship inflicted
upon the owner by conforming to the required minimum regulation which
induced the variance request. Convenience and financial loss or
gain does not constitute zoning hardship.
Your appiication may come before the Town Board for their review.

Dear Mr . Bishop :
I have had the opportunity to discuss your proposed land division
with the Chairman of the Sawyer County Zoning Board of Appeals .
We both realize that the lot division is not a problem as the 1ot
widths on the road side are approximately two (2) to three (3)
inches short of the required 100 feet in lot width.
However , Chapter 236 . 336 of the Wisconsin Administrative Code
prohibits the creation of a parcel less than the minimum parcel
size or 1ot width within a platted subdivision.
I am going to recommend that you apply for a variance of the
regulations from the Sawyer County Zoning Board of Appeals . If
the variance is approved, the property could be subdivided by
Certified Survey. In reviewing the preliminary, we would rather
see a straight property line between Lots 2 and 3 with an
encroachment easement given to the house , rather than dog leg the
property line around the house . We also question why Lot 2 does
not run all the way up to the town road.
For your convenience , I have enclosed a variance application. If
if ineets with your approval , you may sign it and return it to us
by November l , 1996 to be eligible for the December Public
Hearing.
