Dear Mr. Bailey: Today I received an anonymous telephone call pertaining to the possibility that you may be considering enclosing a deck attached to your condominium unit. The question posed to me was whether the enclosing of the deck was allowed. The enclosure of an existing deck is the same as constructing an addition onto a dwelling. I have reviewed a 1996 inspection report(September 30, 2004) for your unit and the variance (#96-034)that was granted for the "replacement dwelling" and one deck and it appears that the dwelling is approximately 40' from the lake. The current ordinance would not allow any addition onto your cabin unless the addition was off of the rear of the dwelling. The point is,there are issues involved with enclosing the deck and this office should be contacted before the project is started. Please contact this office if you have any questions or comments. There are two sih�ations with the exisCing cabin that will require the prior approval of a variance before your proposed construction may begin. First, the required lake setback is 75 feet; however, the cabin is approximately 36 feet from the shoreline. Second, the cabin is a nonconforming structure as it is closer than 75 feet to the lake, and it appears that the cost of construction will exceed 50 percent of the cabids current estimated fair market va]ue. Therefore, the priar approval of a variance application by the Sawyer County Board of Appeals is required before construction can begin. I have endosed a completed "Variance Application.' Please review the application, and if correct, sign it and return it to this office by Friday, 11 October 1996 for public hearings in November 1996. Your "Variance Application" will be reviewed at two public hearings. The first hearing will be held by the Town of f�ayward at 7:30P.M., Tuesday, OS November 1996. You should reconfirm this date with Mrs. Arlene Mizerka, 1'own Clerk, TeL• (715) 634-4123. The second hearing will be held by the Sawyer County Board of Appeals at 7:00 P.M., Tuesday, 19 November 1996 in the Circuit Courtroom located in the Sawyer County Courthouse. You, or your representative, should attend eacli hearing, especially the hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant the variance, the opinion of the Town of Hayward is advisory only. You must provide this office with an estimate of the anticipated costs of materials a�d labor for this project. The estimated costs should be divided into: (1) the estimated cost of materials and labar to enclose the addition, (2) the estimaled cost of materials and labor to finish the interiar of the addition, (3) the estimated cost of materials and labor to improve/renovate the existing structure a�d (4) the total cost of all materials and labor involved in the project. This information shall be in this office five working days prior to the scheduled meeting of the Sawyer County Board of Appeals. It is �r responsibility to convince the Board of Appeals to grant the variance that you have requested. 'Therefore, you should consider using any means at your disposal (i.e., photographs, drawings, a good verbal presentation etc.) as you present your fac[s to the Board. Because the proposed construction is taking place within a condominium, this office requires a letter from the condominium association stating that the members of the association have no objections to the construction activities. Typically, this letter is sig�ed by the association president However, I am told that Mr. Bailey is the association preside�t Therefore, because Mr. bailey is a co-owner of the unit that will be altered, we would prefer an association let[er signed by anolher association officer, preferably the association secretary. Pinally, you will be required to have an area for a replacement septic system identified and an approved Sanitary Permit issued for Che new system before this office can issue you a Land Use Permit for your proposed construction plans. It appears that there may be sufficient area for a new septic system behind units 03 and O5. Also, because your cabin shares a septic system with imit O1, this office will need to know how the waste generated wiYhin unit O1 will be disposed of (i.e., a new septic system serving only unit Ol, this is probably the preferred solution, ar a new septic system serving both units). Note's Prepared for the Sawyer County Board of Appeals Meeting on November 19, 1996 Background We have owned Unit 2 of the Mixed Pines Condominium Association for ten years. When we first purchased the property we had no children and the dwelling was adequate for our purposes. Now we have two kids. The dwelling is fit for summer use only. We would like to be able to use it year round and eventually make it our permanent home. There are four other dwellings in the association, and we are the last to make this kind of improvement. Current Structure 1. The current structure is at least 40 years old. 2. Consists of 560 square feet of livable space, with a dirt crawl space and an old cistem underneath. 3. Two bedrooms have been added at some point. However, the floor joists of the addition are at right angle to the initial portion causing a noticeable "sag" in the structure. 4. The foundation is primarily frost footings. Over the years the ground freezes and thaws, causing movement in the structure so now it "tilts" toward the lake. � 5. The septic system is 4 feet from the structure. It is currently shared with Unit #1 and will be replaced. 6. Not winterized and are currently having difficuhy with carpenter ants. 7. The current market value is estimated at $16,000. Physical limitations thal apply to the App[ication for Variance 1. The current structure is 36 feet from the shoreline. The structure would be moved back 4 feet to comply with the average setback. 2. Restricted from complying with the 75 foot setback, because the Declaration of Condominium Ownership restricts us to the Limited Common Element (LCE), as outlined in the Condominium Plat. 3. In addition we are required to be at least 30 feet from the centerline of the private road. 4. As a result of complying with the average setback the septic system will be moved/replaced. 5. To move and enlarge the structure, within our LCE, requires writteu permission (via majority vote) from the Condominium Association. Proposed Buil�ling Project 1. In order ro do so we need to requesl permission from Uie association. Wc have bcen in contact with a contractor(same one as Lobby's)and the Sawyer County zoning pcople and it is highly unlikely that wc would be able lo expand as is outlined in the condo agreements. Following is an itemized list of wl�at we can do and what we can ask permission for: Originally, we had intended to tear down the existing structure and replace it with a brand new dwclling. We would add a full basement with walk-out and perUaps add a loft. It was also our intcntion to use the entire future expansion area. Tlus will make thc dwelling 20 X 34 FeeL First we found that we cannot scrap the current swcture because Uien it becomes new conswction, and new construction is required ro be seventy five (75) feet from lake shore. Therefore the current structure will have to be modified. It would be similar ro Kallem's and Haase's projects. The cabin will be jacked up and a basement dug out, and almost all oC sWcture taken apart but retaining floor boards and wall studs. Secondly, we found that even Ihough we are modifying the existing structure we are required to apply for a building variance. Apparently,anytime onc adds fi(ty perccnt or more to the value of thcir property they are required to file a variance. There are some grandfather rules that apply. The state calculates and avecage setback from the shore and you cannol go any closer than thaL The se[back tor our situation is fiCty one (51) teet. This means our dwelling would have to be moved four (4) feet furiher from the shore. Wc could apply for a variancc on this as wcll, howevcr, lhc Sawycr County roning lhoughl it highly unlikcly lhat we would gcl il. Therefore we arc rcqucsting permission from the members of the xssociution to allow us to movc our entire dwclling spacc, plus the future expansion area, four fcet back from the existing location. The State of Wisconsin would allow us to expand the dimensions of our dwelling an additional thirteen (13) feet. This would make our cabin structure 33 X 34 feeL However, this would also be a change to our allotted dwelling space within the condominium by-laws, but we would still be within our limited common area. At this time we are not one hundred percent sure we would expand to this size, it is dependent on cost, however, we would have to include this expansion in the variance process. Therefore we are requesting permission from the members of the association to allow us to expxnd our dwclling space from 20 X 34 feet to 33 X 34 feet. There will be no additional espense to Woody's to be connected to the new system. Thcrc arc two options for a sewer system; first is a holding tank similar to what we currently have only move it closer to the main drivcway, the second option was to have a pumping system that would puntp from a tank lhrough pipes bclween Wicherts and the fish house lo a drain field out b�ck. This second oplion is nol the optimal for to us, however, it is not our decision. The Stale of Wiswnsin will decide how we can proceed. A"Perc" test will be taken of the area behind Wichert's and Haase's, if the soil is suitable for a drain field we will be required to do it. Also, when the existing system wears out and we need to replace it, the same rules would apply. Tlie drain field is not our first choice,but it is beyond our control In order to minimize the impact of a building project such as this, we would begin constructio September 1997 (Approximately a year from now). The fall of the year would minimize the imp and allow time to have everything taken care and cleaned up by spring of 1998. We will rcpair all road and incidcmal damagc �h�it maty resull from this projce�. On a furthcr no�c, this project will require the removal of lrces from our limited common arca. Attached to this letter is a form letter for you to sign and send back as soon as possible, indicaling whethcr or not you will allow Uiis requesl. Additionally, in order to complete Ihe variance process the zoning people require a let[er from an officer of Ihe associalion, indicating [hat the members approve of these changes. 1 am sending a form letter to Haase's, since Lobbie is a vice president and I have not had the opportunity to discuss this with Kallem's yet. All Lobbie will have to do is sign and re�urn the letter in the stamped envelope. If a majority of the members agree, the letter wil] get forwarded to Sa�ryer County zoning. The zoning people also want [o be sure of the understanding of a shared septic system between Woody's and ourselves and tl�at it will not be a problem.
