On October 15, 1996, the Sawyer County Board of Appeals denied your application
for a variance on the following described real estate to wit:
Part Govt Lot 3 S 33, T 38N, R 9W. Parcels :3.11
and :3.12. QCD Vol 241 Records Pg 50. Parcel size
is 1.09 acres. Property is zoned Residential/
Recreational One. Application was for the
construction of a garage at a road setback of 42 feet
from the centerline of Badger Bay Lane. Variance was
requested as Section 4.21(3), Sawyer County Zoning
Ordinance would require a minimum road setback of 63
feet from the centerline of a town road. No decision
was received from the Town Board.
Findings of Fact of the Soard of Appeals: It would be the convenience of the
owner. It would be a self created hardship. It would not be due to special
conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
96-032.

Inspection and Application for Variance
Dear Mr. and Mrs. Grant:
Attached is a copy of the inspection report based on my visit to the above property on
Friday, 06 September 1996. As you know, the required roadway setback for the
proposed garage is 63' from the centerline•of Badger Bay Lane; however, you desire to
construct the garage 42' from the centerline. Therefore, the prior approval of a
variance application by the Sawyer County Board of Appeals is required before
construction can begin.
I have enclosed a completed "Variance Application." Please review the application,
and if conect, sign it and return it to this office.
Your "Variance Application" will be reviewed at two public hearings. The first
hearing will be held by the Town of Edgewater at 7:00 P.M., Tuesday, 08 October
1996. You should reconfirm this date with the Town of Edgewater Clerk, Martha
DeLong Tei: (715) 354-3218. The second hearing will be held by the Sawyer County
Board of Appeals at 7:00 P.M., Tuesday, 15 October 1996 in the Circuit Courtroom
located in the Sawyer County Courthouse. You, or your representative, should attend
each hearing, especially the hearing conducted by the Sawyer County Board of
Appeals. Only the Board of Appeals can grant the variance, the opinion of the Town of
Edgewater is advisory only.
It is �}_our responsibility to convince the Board of Appeals to �rant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to
the Board.

Dear Mr. and Mrs. Grant:
Your application for a variance wi11 be considered at a Public
Hearing before the Sawyer County Zoning Board of Appeals on
October 15, 1996
This hearing wi11 begin at 7:00 P.M. in the Sawyer County Courthouse,
406 Main, Hayward, Wisconsin.
It is recommended that either you or a representative be present
at the Hearing. A lack of information about the situation may result
in unnecessary delay of a decision. Failure to appear may also re-
sult in the denial of the application.
If it is impossible for a representative to be present, please submit
a written statement to this office directed to Arvid A. Va11em, Chairman
of the Board of Appeals. This statement should include a description
of the general terrain; surrounding development; your proposed intentions;
and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hardship inflicted
upon the owner by conforming to the required minimum regulation which
induced the variance request. Convenience and financial loss or
gain does not constitute zoning hardship.
Your application may come before the Town Board for their review
on October 8, 1996. Please contact the Town Clerk, Martha DeLong,
Rt. 1, Box 140, Birchwood, WI 54817, (715) 354-3218, to obtain the
time and confirm the date of the Town Board meeting for your attendance
