On .7une 18, 1996, the Sawyer County Board of Appeals approved, vith conditions,
your application for a variance on the following described real estate to wit:
Lot 1-A-1 in part SW� of the SW$ S 28, T 41N, R 9W. Parcel . 11.7.
AI.0 Vol 564 Records Pg 335 and CS Vol 6 Pg L55. Parcel size is
160' x 302' x 256' containing .47 acres. Property is zoned
Co�ercial One. Application is for an after-the-fact variance
as an approximate 14' x 26' deck was constructed onto an existing
business establishment at a setback of 115 feet from the centerline
of USH 63 South. Variance was requested as Section 4.21 (1) , Sawyer
County Zoning Ordinance would require a setback of 130 feet from
the centerline of IIS highway. Town Board approved. No decision
received from the City Council, City of Hayward.
The Board of Appeals approved the first 8 feet of the deck and the 6 feet toward
IISH 63 must be eliminated. Stairs may be reattached onto front of deck. Setback
will be 121 feet from the centerline of IISH 63 South. Owner must comply by
August 17, 1996.
Findiags of Fact of the Board of Appeals: It would not be the basis of economic
gain or 1oss. It would not be a self-created hardship. There would be no
change in the use in the zone district. It would not be damaging to the rights
of others or property values.
Any person or persons jointly aggriev�d by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.

The Town Board approved this application with a vote of 2 yes and 1 no.
Supervisor Stedman stated that he usually would vote no because people
should look into these matters before proceeding. However, in this case
there was a deck of sorts there when this owner took over. She thought
she was just making a safe, handicap accessible deck for access into her
shop.

This hearing wi11 begin at 9:00 AM in the Sawyer County Courthouse ,
406 Main, Hayward, Wisconsin.
