construction of a 28' x 48' new dwelling at a waterline setback of
56 feet from the normal highwater mark of Lake Hayward and at a road
setback of 52 feet from the centerline of Chippewa Trail on a parcel
containing 10,870 square feet. Variance was requested as Section
4.49 (1) , Sawyer County Zoning Ordinance requires a waterline
setback of 75 feet from the normal highwater mark of the lake;
Section 4.21 (4) requires a road setback of 63 feet from the
centerline of a town road; and Section 18.2 requires a minimum
parcel size of 20,000 square feet. Town Board denied. City
Council, City of Hayward, denied.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship.
There would be no change in the use in the zone district. It would not be
damaging to the rights of others or property values. It would be due to special
conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may coffinence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.

Commor. Ccuncil at their regularly scheduled meeting on April 3, 1996
unanimously voted to deny the request. A representative from American
Homes informed the Council that the Town of Hayward had denied the
request. Some members of the Council stated that the lot was both
too small and the building would be too close and that they normally
go along with whatever the Town decides.

you, please review, sign and submit a check in the amount of
$175 . 00 if you wish to proceed with your plans .
Please note that your parcel is zoned (C-1) Cou�ercial-One .
In this zone district , in order to construct a new dwelling ,
some type of commercial activity must accompany it .
If you do not plan on having any type of cou�ercial activity,
you do have the option of rezoning your parcel to a residential
zone , which requires a public hearing and a $80 . 00 fee .
Mr . Johnson, if your not in any hurry to build, I will be remapping

Revocation of Setbacks
Dear Mr. Johnson:
On 12 Ju1y 1994 an on-site inspection was performed on the
above property which resulted in a setback of 56 ' for the construction
of a new dwelling . However, on Thursday, 15 June 1995 the
Sawyer County Board of Supervisors approved amendments to the
Sawyer County Zoning Ordinance. In part , these amendments
state, "For lots that abut on navigable waters , a11 buildings
and structures , new dwellings on vacant lots and replacement
dwellings , escept piers , boat hoists , boathouses , and open
fences which may require a lesser setback, sha11 be set back
a minimum of 75 feet from the ordinar� highwater mark of navigable
waters and wetlands adjacent to any navigable water . A11 setback
distances are measured from the overhang or appendage such
as a deck, horizontally to the closest point of the ordinary
highwater mark. " In short , the setback for the new dwelling
is now 75 ' rather than 56 feet .
However, to a11ow for a reasonable delay in construction plans
for you and other property owners in this situation, this
office is "grandfathering" in those average setbacks for new
dwellings and structures that resulted from property inspections
performed 'oetween O1 January 1994 and 15 June 1995 . But ,
for construction to be allowed at the average setback, a Land
Use Permit must be issued by this office no later than 15
June 1996 . Land Use Permits issued after 15 June 1996 will
require the mandated 75 ' setback.
