Dear Mr. Neuman:
On January 16, 1996, the Sawyer County Board of Appeals denied your application for
a variance on the following described real estate to wit:
Parcel in part of �ovt Lot 4 S 17, T 40N, R 8W. Parcel :4.2.
WD Vol 450 Records Pg 350. Parcel size is .68 acres. Property
is zoned RR-2. Application was for the enclosing of a 12' x 18'
open deck at a waterline setback of 41 feet from the normal
highwater mark of Grindstone Lake. Variance was requested as
Section 4.49 (2), Sawyer County Zoning Ordinance, would require
a waterline setback of 64 feet as the average waterline setback was
determined at 64 feet from the normal highwater mark of the lake.
Town Board approved.
Findings of Fact of the Board of Appeals: It would be the convenience of
the owner. It would be damaging to the rights of others or property values.
It would not be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.
In future correspondence, or in applying for permits, please refer to Variance
96-001.

This matter comes before the court on a Complaint for Certiorari Review.
The court makes the following finding: Plaintiff, William M. Neuman, owns
property in the Town of Bass Lake, Sawyer County, Wisconsin. Plaintiff made an
application for a variance on November 8, 1995. The variance request was subject to a
public hearing held on January 16, 1996, before the Sawyer County Zoning Board of
Appeals. After taldng testimony from interested parties, the Boazd of Appeals denied the
application for variance. Plaintiff was notified of the Board's decision on January 22, 1996,
by letter from the Deputy Zoning Administrator.
This court's review is limited to whether the Boazd's action was decided under a
correct theory of law and whether it xas arbitrary, oppressive or unreasonable and whether it
was supported by the evidence. The burden to establish an unnecessary hardship is imposed
upon the plaintiff. The plainaff failed to establish the existence of an unnecessary hardship.
The decision of the Board is supported by substantial evidence in the record.
T'he court concludes that the Sawyer County Zoning Boazd of Appeais proceeded on a
coaect theory of law and that their decision was not arbitruy, oppressive or unreasonable

NOW COMES the defendant, Sawyer County Zoning Board of Appeals, by its attomeys,

As and for its affirmative defenses to the plaintiff's Complaint, the defendant alleges and

3. The burden of proof to establish an unnecessary hardship in accordance with
§59.99(7)(c), Wis. Stats. is unposed upon the applicant in each such case brought before the
Board, herein the plaintiff. The plaintiff failed to establish the existence of an unnecessary
hardship as defined and applied by Wisconsin law.
4. Certiorari review of a decision of a zoning board of appeals or adjustment is to
adhere to the rules governing common-law certiorari proceedings and [he scope of review is
generally confined to the board's record. It not being necessary in accord with §59.99(10), Wis.
Stats. for a proper disposition of the matter for this Court to take evidence, the scope of review
should be lnnited to the record before the defendant board. In accord with the standards set
forth in Klinger v. Oneida Counry, 149 Wis.2d. 838 (1989) the circumstances necessary to
justify this Court's exercise of discretion to take evidence are not present.
WHEREFORE this defendant prays that the Court dismiss the plaintiff's Complaint for
Certiorari Review and that it award to the defendant its costs and disbursements.

Dear Robyn:
Thank you for your letter and enclosures of February 26, 1996. You will please find enclosed
the answer which I have filed with the Circuit Court in this matter. As you will observe,I have
denied the three essential paragraphs of the Complaint asserting some form of wrong doing on
the part of the Board. In addition,I have included several affirmative defenses to the effect that
the burden of proof is upon the applicant and, additionally, that there is no justification for the
Circuit Court to hold an evidentiary hearing in this matter to determine whether or not the
Board's decision was correct as a matter of law.
With respect to the materials which you sent to me I find that I have a question of you. You
state that the file is an exact duplicate and is in the same order as the file prepared for the
Circuit Court. Am I correct in understanding,as such,that the entire contents of the file which
you sent to me was a part of the record before the Board of Adjustment? My question relates
to the fact that in review of the transcript I note no reference being made to the various maps
and other documents;however, this does not conclusively establish that they were not a part of
the record. In accord with§59.99(10), Wis. Stats., we should submit to the Court only those
items of documentary evidence which were presented to the Board, together with procedural
materials, including but not limited to the application for the variance and the order emanating
from the Board.
Proceeding to my initial appraisal of the case I clearly don't see that the applicant presented any
evidence whatsoever of an unnecessary hardship as defined by Wisconsin law. This statement
notwithstanding, however, I would appreciate i[if you would send me a copy of your current
zoning code which I might use as a basis of argument to the Court in this matter, relative to this
concept, among others. From the transcript it is apparent to me that the Board afforded Mr.
Neuman ever opportunity to present his case but that,realistically and honestly,he had no viable

case for a variance to present. Having made this observation I might then inquire of you as to
whether you have any information which would tend to substantiate the reason for Neuman's
attorney to have alleged arbitrary and capricious action on the part of the Board. Is there
something outside of the record that I should be aware of?
Finally, you will please find enclosed a proposed cover sheet for the submission of the record
to the Circuit Court in the form of an index to allow easy access to its contents. Look it over
and if it appear to be accurate I would suggest submitting that together with the record. Please
note that the reccrd should be filed with the Court no later than March 15, 1996. Please give

this law firm to represent the interests of the Zoning Board of Appeals in the above-captioned
matter. It is my understanding that the Summons and Complaint were served upon the Counry
Clerk on February 14, 1996. As such, our initial answer is due on or before March 5, 1996.
For your convenience, if you have not already been provided with a copy, I have enclosed a
copy of the Summons and Complaint and Order for Certiorari in this matter. In accordance with
§59.99,Wis. Stats.,the Cour[has ordered that the Clerk of the Board of Appeals is to transmit
the record of the proceedings to the Clerk of Circuit of Court within 30 days of the date of the
Order, that date being February 13, 1996.
What I would like to do initially is to discuss this matter with you over the telephone and
ascertain the nature of the contents of the record before the Board of Appeals,together with any

Now comes the plaintiff, William M. Neuman, by his attor-
neys, Lein Law Offices, and £or a complaint £or remedy available
by certiorari and other review, alleges as follows:
1) That the plaintiff, William M. Neuman, resides at 125
Main Street, Elroy, Wisconsin 53929.
2) That the defendant, Sawyer County Zoning Board of
Appeals ("Board"), is a competent unit of Sawyer County, State of
Wisconsin, a municipal corporation, said Board being established
under Wisconsin Statute Section 59.99.
3) That William M. Neuman owns real property in the Town
of Bass Lake, Sawyer County, Wisconsin, located in part of
Government Lot 4, Section 17, Township 40 North, Range 8 West,
found in a warranty deed recorded in Volume 450 of Records, page
350, as Parcel Number 4.2.
4) That on or before November 8, 1995, William M. Neuman
made application for a variance with respect to this property.
5) The variance request was subjected to public hearing
held by the Sawyer County Zoning Board of Appeals on January 16,
1996 . Following that hearing, the said Board of Appeals denied
the application for variance.
6 ) On January 22, 1996, the plaintiff was notified of
the denial by a letter dated January 26, 1996, from the Sawyer
County Zoning Administrator by Robin K. Thake, deputy zoning
administrator. .
7 ) The action of the Board in denying the variance
application was arbitrary, discriminatory, oppressive and
unreasonable and represented its will and not its judgment.
8 ) The decision of the Board denying the variance
application was not reasonably supported by the evidence.
9 ) The plaintiff seeks full review of this Court of the
action of the Board, including the taking of additional evidence
pursuant to statutory certiorari and for a full review of the
Board's action and decision.
WHEREFORE, the plaintiff prays for judgment reversing the
determination of the Sawyer County Zoning Board of Appeals and
granting the requested variance and/or remanding the matter for a
proper rehearing. Plaintiff further prays for relief awarding
them costs and disbursements of this action.

zoned RR-2. Application is for the enclosing of a 12' x 18'
open deck at a waterline setback of 41 feet from the normal
highwater mark of Grindstone Lake. Variance is requested as
Section 4.49 (2), Sawyer County Zoning Ordinance, would
require a waterline setback of 64 feet as the average
waterline setback was determined at 64 feet from the normal
highwater mark of the lake. Town Board has approved.

the entire 16' x 28' structure to add new support beams; a11
at a waterline setback of 52 feet and at a cost exceeding 50%
of the current fair market value. Variance is requested as
Section 4.49 (2), Sawyer County Zoning Ordinance, would
require a waterline setback of 71 feet as the average
waterline setback was determined at 71 feet from the 1ake;
and Section 10.2 restricts the cost of construction to less

This matter comes before the court on a Complaint for Certiorari Review.
The court makes the following finding: Plaintiff,William M. Neuman, owns
property in the Town of Bass Lake, Sawyer County, Wisconsin. Plaintiff made an
application for a variance on November 8, 1995. The variance request was subject to a
public hearing held on January 16, 1996, before the Sawyer County Zoning Board of
Appeals. After taldng testimony from interested parties, the Boazd of Appeals denied the
application for variance. Plaintiff was notified of the Board's decision on January 22, 1996,
by letter from the Deputy Zoning Administrator.
This court's review is limited to whether the Boazd's action was decided under a
coaect fheory of law ar.d whether it was arbitrary, oppressive o:ur.reasonable and whethe:it
was supported by the evidence. The burden to establish an unnecessary hardship is imposed
upon the plaintiff. The plaintiff failed to establish the existence of an unnecessary hardship.
The decision of the Board is supported by substantial evidence in the record.
The court concludes that the Sawyer County Zoning Board of Appeals proceeded on a
correct theory of law and that their decision was not arbitrary, oppressive or unreasonable
