The average setback for your property is 53 feet . Additionally, after returning to the office and discussing your situation with the Deputy Zoning Administrator, Robyn Thake , I learned that even though you have the required 40 , 000 square feet (45 , 533 actual) for an additional dwelling on your property , you do not have sufficient frontage on the lake to divide the parcel into two individual 100 ' lots . If I recall from my discus:;ion with you, the present parcel has onLy 147 feet of lake shore frontage . This means that the planned additional dwelling can be constructed only if it shares a common wall with the existing dwelling or you are willing to split your parcel parallel with Birch Heights Lane , which I understand you do not want to do . If you do decide to build a dwelling which will share a common wa11 with your existing dwelling , you will require a variance because the new construction would probably exceed 50 percent of the estimated fair market value of the existing structure . The estimated fair market value situation' is important because your present dwelling is in a nonconforming use status (it is closer than 75 feet to the 1ake. A variance can be granted by the Sawyer County Board of Appeals . This type of variance is typically easier to obtain than a shoreline setback variance .
