We are responding to your request for authorization to construct an access road and install
utilities in wetlands for a residential development adjacent to Nelson Lake. The proposed work
is located in Section 23, Township 42 North, Range 9 West, Sawyer County, Wisconsin.
Project authorization:
The regulated activities associated with this project include the permanent discharge of fill
material into 1,304 square feet of wetlands adjacent to Nelson Lake for the construction of a
driveway. The project also includes temporary discharges of dredged and fill material in an
additional 252 square feet of wetlands for the installation of a septic line. We have determined
that these activities are authorized by a Nationwide Permit (NWP), specifically, NWP 18, Minor
Discharges. This work is shown on the enclosed figures, labeled MVP-2021-01758-CJH.
Conditions of your permit:
You must ensure the authorized work is performed in accordance with the enclosed General
Permit terms, General Conditions, and St. Paul District Regional Conditions.
You are also required to complete and return the enclosed Compliance Certification form
within 30 days of completing your project. Please email the completed form to the contact
identified in the last paragraph.
A change in location or project plans may require re-evaluation of your project. Proposed
changes should be coordinated with this office prior to construction. Failure to comply with all
terms and conditions of this permit invalidates this authorization and could result in a violation of
Section 301 of the Clean Water Act or Section 10 of the Rivers and Harbors Act. You must also
obtain all local, State, and other Federal permits that apply to this project.
Water Quality Certification:
You must also comply with the enclosed Water Quality Certification conditions associated
with this General Permit.
Permit expiration:
The 2017 NWP is valid until March 18, 2022 unless modified, suspended, or revoked. If the
work has not been completed by that time, you should contact this office to verify that the permit
is still valid. Furthermore, if you commence or are under contract to commence this activity
before the date of General Permit expiration, modification, or revocation, you have 12 months to
complete the activity under the present terms and conditions of the General Permit.

meets all of the following criteria:
(a)The quantity of discharged material and the volume of area excavated do not exceed 25 cubic yards below the plane
of the ordinary high water mark or the high tide line;
(b)The discharge will not cause the loss of more than 1/10-acre of waters of the United States; and
(c)The discharge is not placed for the purpose of a stream diversion.
Notification: The permittee must submit a pre-construction notification to the district engineer prior to commencing the
activity if: (1)the discharge or the volume of area excavated exceeds 10 cubic yards below the plane of the ordinary high

Every person who may wish to ob�ain permit authorization under one or more NWPs,or who is curren�ly relying on an existing or prior permit authoriza�ion under

where tha�NWP is more resirictive.

authorization under the SL Paul DistricTs regional or programmatic general permits or an individual permit.
D. Grea[Lakes Comoact No projec�or part of a project thal would divert more than 1 Q000 gallons per day of surface or ground water into or out o(the
Great Lakes Basin is authorized by NWPs.
E. Tribai Riqhts:As sla�ed in General Condition 17 of the NWPs,no activity may impair tribal rights,including Veaty rights, prolected Iribal resources or

F. Areas under a Soecial Area Manaqement Plan�Regula�ed activities loca�ed within an area eligible for authorization under a valitl Special Area

G. Desiqnated Critical Resource Water The Lake Superior National EsWarine Research Reserve is a designated cri�ical resource waler and is subject

WISCONSIN: No work in a calcareous fen is authorized by a NWP unless[he Wisconsin Depariment of NaWral Resources(WI DNR)has approved an

MINNESOTA:No work in a calcareous fen is au�horized by a NWP unless Ihe Minnesota Departmenl of Natural Resources(MN DNR)has approved a

ensure that it is beinq,or has been,cons�ructed and main�ained in accordance with�he NWP authorization.
P. Restoration for Temoorary Impacts:All�emporary impacis in waters of the U.S.,inUuding we�lantls,that occur as a result of the regula�ed
activity mus�be fully containetl with appropriate erosion control or containment methods.be res�ored to preconstruction con�ours and
elevations,and revegetatetl with na�ive,nominvasive vegetation.A project proponent may request,in writing,a waiver from�his condition from
the District An accep�able reason for a waiver to lhis condition may include, but is not limitetl to,the Distric�allowing natural restora[ion of the
site when the resWting grade and existing seed bank are sufficient for�he site[o restore lo pre-construction contlitions.
Q. Duration of Temoorary Impacts:Temporary impacts in waters of Ihe U.S., including wetlantls,must be avoided and limited to the smallest
area and the shortes�duration required to accomplish the project purpose.
PART A,ACTIVITIES WITHOUT PCN RE�UIREMENTS�
Temporary impacts may nol remain in place longer than 90 days be[ween May 15 and November 15. Before those 90 tlays have lapsed all
lemporary discharges musl be removed in iheir entirely.If�he temporary impacts would remain in place for longer�han 90 tlays beRveen May
15 antl November 15,a PCN is required and ihe activity is subject�o the requirements and limita�ions tlescribed in part B of this regional
condition.
PART e,ACTIVITIES WITH PCN REQUIREMENTS�
The PCN must specify how long the temporary impact will remain antl inclutle a restoration plan showing how all temporary fills antl structures
will be removed and�he area restored to pre-project condi�ions.Temporary impacfs are allowed[o stay in place as long as specified in the
PCN unless otherwise conditioned in a Corps NWP verification.All temporary impac�s must be removed in Iheir en�irety in accordance with�he
plan described in the PCN unless otherwise conditionetl in a NWP verification provided by the District.
R. Culverts and Crossinqs:Unless a NWP verificalion au�horizes otherwise,replacemen�and installation of culverts or crossings authorized by
a NWP are to follow(or be restored to)Ihe naWral alignment and profile of the tributary.The culvert(s)or bridge(s)must adequa�ely pass
bedload.sediment load,and provide si�e-appropriate fish and wildli(e passage. Example design elements include recessing single culverts�o
accommodate na�ural bank(ull width and adjusting addi�ional culvert inverts at an elevation higher than the bankfull elevation.
S. Best Manaqement Prectices�To minimize adverse effects(rom soil loss andbr sediment transport�ha�may occur as a result of the
aulhorized discharge and associated earth work,appmpriate best manaqement practices shall be maintained antl remain in place until the
affected area is s�abilized wi�h vegetation or ground cover.
T. RfP�aP:For all NW Ps Iha[allow tor�he use of riprap material for bank s�abilization,only rock shall be used and it must be of a size suKcient to
prevent its movement trom the authorized alignment by naWral forces untler normal or high flows.A project proponent may reQues�from the
District,in wri�ing,approval to use altemative riprap materials.
U. Pollu[ant or Hazardous Waste Spills:If a spill of any potential pollutant or hazardous wasle occurs,it is the responsibiliry ot�he permittee�o
immediately notify the National Response Center at 1-800-424-8802 or www.nrc.uscg.mil AND
IN WISCONSIN:the Wisconsin Depahment of Natural Resources'Spills Team at 1-800-943-0003
IN MINNESOTA the Minnesota Stale Duty Officer at 1-800-422-0798.
The permittee is responsible for removing such pollutan�s and hazardous materials antl for minimizing any contamination resulting from a spill
in accordance with slate antl fetleral laws.
V. Clean Construction Eouipment All construc�ion equipment must be clean prior lo entering and before leaving Ihe work site in order to
prevent the spread of invasive species.
W. Compliance:The permittee is responsible tor ensuring�ha�whoeve�performs,supervises or oversees any pohion of the physical work
associated with the consUuction of the project has a copy of and is familiar wi�h all the(ertns antl conditions of�he NW P antl any special
condi�ions included in any written verification letter from the Distric�.The permittee is ultimately responsible for ensuring�hat all Ihe terms and
contlitions of the NWPs are complied with.
The following General Conditions are applicable to all NWPs:
1.Naviqation.
(a)No activity may cause more than a minimal adverse effect on navigation.
(b)Any safery lighis antl signals prescribed by the U.S.Coast Guard,through regulations or otherwise,must be installed and maintained at ihe
permittee's expense on authorized facilities in navigable waters of the United States.
(c)The permittee understands and agrees that,if future operations by the United States require the removal, relocation,or other alteralion,of
the structure or work herein authonzed,or if,in the opinion o(the Secre�ary of the Artny or his authorized represenlalive,said 5trucNre or work
shall cause unreasonable obstruc�ion to[he free naviqation of the navigable waters,the permittee will be required, upon due notice from the
Corps of Engineers,to remove,rebcate,or al�er the strucWral work or obstructions caused thereby,wi�hou�expense to the United States. No
claim shall be made against the Uni�ed States on account of any such removal or al�eration.
2.Aouatic Life Movements.No ac�ivity may substantially disrupt the necessary life cycle movements of�hose species of aqua�ic life indigenous to the
wa�erbody,including[hose species lhat normally migrate Ihrough the area, unless the activity's primary purpose is to impound wa�er.All permanent and
temporary crossings of waterbotlies shall be suitabty wlverted,bridged,or o�herwise tlesignetl and constmc�ed to main�ain low flows to sustain the
movement of those aquatic species. If a bo��omless culvert cannot be used,then�he crossing should be designed and constructed to minimize adverse
effects to aquatic life movements.
3.Spawninq Areas.Activities in spawning areas during spawning seasons mus�be avoided to the maximum extent praclicable.Activi�ies that resWt in the
physical tles�ruciion(e.g.;through excavation,fill,or downstream smothering by substantial turbidity)of an importaM spawning area are not authorized.
4.Miqrotory Bird Breetlina Areas.Ac�ivi�ies in waters of the Uni�ed S�ates that serve as breeding areas for migretory birds must be avoided lo the
maximum ex[ent practicable.
5.ShellFsh Beds.No ac[ivity may occur in areas ot concenirated shelltish populations,unless the activiry is directly related to a shellfish harvesling
activiry au�horized by NWPs 4 and 48,or is a shellfish seedinq or habitat restoration activity authorized by NWP 27.
6.Suitable Ma[erial. No aclivi�y may use unsuitable ma�erial(e.g.,Vash.debris,car bodies,asphalC e�c.).Material used for construclion or discharged
must be free fmm toxic pollutants in toxic amounts(see sec[ion 307 of the Glean Water Ac�).
7.Water Suoplv In[akes.No activiry may occur in the proximity of a public water supply intaka.except where Ihe activity is for�he repair or improvement
of public wa�er supply intake shucWres or adjacent bank stabilization.
e.Adverse Effects from Imooundments.If the ac�ivity creates an impoundment o/water,adverse eRects to Ihe aquatic system tlue to accelere�ing the
passage of water,and/or restricting its Flow must be minimizetl�o the maximum exlent practicable.
9.Manaaement of Water Flows.To the maximum extent prac�icable,the preconstruction course,contlition,capacity,antl loca�ion of open waters must
be maintained for each ac�ivity,including stream channeliza�ion,storm water management ac�ivities,and temporary and permanent road crossings,except
as provided below.The ac�iviry must be constructed to wi(hstand expectetl high flows The ac�ivity must no�restric[or impede lhe passage o(normal or

hiqh Flows,unless the primary purpose of�he activity is to impound water or manage high flows.The activity may alter the pre-consVuc[ion course,
condition,capaciry,and location of open waters if it benefits lhe aqua�ic environment(e.9.,slream res�oration or reloca�ion activities).
10.Fills Within 100-Year Floodulains.The activity must compty wilh applicable FEMA-approved state or local floodplain mana9ement requirements.
11.Equipmen[.Heavy equipment working in weUands or mudFlats must 6e placed on mats,or other measures must be taken to minimize soil disturbance.
12.Soil Erosion antl Sedimen[Controls.Appropria�e soil erosion antl setliment con�rols must be used and maintained in effective operating condition
during constmc[ion,and all exposed soil antl other fills,as well as any work below the ordinary high water mark or high tide line,must be permanently
s�abilized at the earliest practicable date. Permittees are encouraged to pedorm work within wa�ers of�he Uni�ed S�ates during periods of low-flow or no-
Oow,or during low tides.
13.Removal of Temoorary Fills.Temporary fills must be removed in their entirety and the affecled areas reWmed to pre-conslruction elevations.The
affected areas must be revegetated,as appropriate.
14.Prooer Maintenance.Any authoriretl s�rucWre or fill shall be properly main�ained,including main�enance to ensure public safety and compliance with
applicable NWP general conditions,as well as any activity-specific wnditions added by the distric[engineer�o an NWP authorization.
15.Sinqle and Comolete Proiect.The ac(ivity must be a single and complele project The same NW P cannot be used more�han once for the same
single and complete projec�.
16.Wild antl Scenic Rivers.
(a)No NWP activiry may occur in a componen[of the National Wild and Scenic River Syslem,or in a river officially desiqnated by Congress as a
"study river'for possible inclusion in the system while the river is in an official study status,unless the appropriate Federal agency with direct
management responsibility for such river,has determined in writing that the proposed activity will not adversely affect the W ild and Scenic Rrver
designation or sWdy status.
(b)Ii a proposed NW P activiry will occur in a component of the National W ild and Scenic River System,or in a river oKcialty designated by
Congress as a�'study river'for possible inclusion in�he system while�he river is in an offcial sWdy status.�he permittee musl submit a pre-
construction notifca[ion(see general condition 32).The district enqineer will coordinate the PCN wilh ihe Federal agency with direcl
management responsibility for that river.The permiUee shall not begin the NW P activiry until no�ified by the district engineer�hat the Federal
agency with direct managemen�responsibility for that river has tletermined in writing that the proposetl NWP activity will no�adversely affecl�he
Wild and Scenic River designation or study s�aWs.
(c)Informalion on Wild and Scenic Rivers may be obtained from the appropria�e Federal land management agency responsible for the
designa�ed Wiltl and Scenic River or Study River(e.g.,National Park Service, U.S. Forest Service,Bureau of Land Management, U.S Fish and
Wildlife Service). Infortnation on these rlvers is also available aC http://www.rivers.gov/.
17.Tribal Riqh[s.No NWP aclivity may cause more than minimal adverse ef(ects on tribal rights(including treaty rights),protected�ribal resources,or
iribal lands.
19.Endanqered Species.
�a)No activity is authorized under any NW P which is likety to directty or indirectty jeopardize the con�inued existence of a threatened or
endangered species or a species proposed for such designation,as identified under�he Federal Endangered Species Acl(ESA),or which will
tlirectly or indirectly destroy or adversely motlify the critical habitat of such species.No activiry is authorized under any NWP which"may affecT'
a listed species or critical habital,unless ESA section 7 consultation addressing�he eRects of lhe proposed activity has been wmpleted. Direcl
effects are Ihe immediate effec(s on listed species and cri�ical habi�at causetl by lhe NWP activity. Indirect eftec�s are those eRects on listed
species and critical habitat[ha�are causetl by�he NWP activity and are la�er in time,but still are reasonably certain to occur.
(b)Fetleral agencies should follow�heir own procedures for complyinq with the requirements oi the ESA. If pre-construclion notifica�ion is
required for�he proposed activity,the Federal permittee must provide Ihe district engineer with Ihe appropriate tlocumen�ation to demonsVate
compliance with Ihose requirements.The dislrict engineer will veri(y that Ihe appropriate documentation has been submitted. If�he appropria�e
documentation has not been submitted additional ESA sec�ion 7 consWta�ion may be necessary for the ac�ivity and the respec�ive federal
agency would be responsible(or fW(illinq its obligation under section 7 of the ESA.
(c)Non-federal permittees mus�submi�a pre-construction notification to[he dishict engineer i(any lisletl species or tlesignated critical habitat
might be affected or is in�he vicinity of�he ac�ivity, or if�he ac�ivity is located in designated critical habitat,and shall nol begin work on the
activity un[il notified by�he dis�rict engineer ihat the requirements of the ESA have been sa[isfied and thal the activity is authorized For activities
that migh�affect Fetlerally-listetl endangered or threatened species or designated critical habitat.the pre-construction notification must include
the name(s)of the endangered or threatened species that might be affecled by lhe proposed activity or Ihat utilize the designated critical habitat
that might be affected by the proposed activity.The disirict engineer will determine whether the proposed activiry"may aAect'or will have"no
effecP'to listed species and designated critical habi�a[and will notify the noo-Federal applicant of the Corps'determina�ion within 45 days of
receipt of a complete preconstruction notification. In cases where the non-Federal applicant has identified lis�ed species or critical habitat lhat
might be aRected or is in Ihe vicinity of the activity,and has so no�ified Ihe Corps,the applicant shall not begin work until the Corps has provided
nolifcalion thal lhe proposed activiry will have"no effecf'on listed species or critical habitat, or until ESA section 7 consultation has been
completed.If�he non-Federal applicant has not heard back from�he Corps wi�hin 45 days,the applicant must still wait for nolifica�ion from the
Corps.
(d)As a result of formal or informal consWtation with�he FWS or NMFS�he distric�engineer may add species-specific permit conditions b the
NW Ps.
(e)Authorization of an activi�y by an NWP does not authorize the"take"of a threatened or endangered species as defned underihe ESA. In�he
absence of separate authorization(e.g.,an ESA Section 10 Permit,a Biological Opinion with"incidental take"provisions,etc.)from the FWS or
the NMFS,the Endangered Species Act prohibits any person subject to ihe jurisdiction of the United States to�ake a listed species,where"take"
means to harass,harm, pursue, hunt,shoot,wound, kill,Vap,capture,or collecl,or to allempt to engage In any such conducL The word"harm"
in the defini[ion of"take"means an act which actually kills or injures wiidlife. Such an act may include significant habitat modification or
degradation where it acWalty kills or injures wildlife by significan�ly impairing esseNial behavioral pa�tems,including breeding,feeding or
sheltering.
(�If the non-federal permittee has a valid ESA secllon 10(a)(�)(B)incidental take pertnit wi(h an approved Habitat Conservation Plan for a
project or a group of projects Ihat inclutles�he proposed NW P activiry,Ihe non-federal applicant should provide a copy of[hat ESA seclion
10(a)(1)(B)permit with the PCN requlred by paragraph(c)of this general condlfion.The dlstrict engineer will coordlnale with the agency that
issued the ESA section 10(a)(1)(B)permi�to de�ermine whether the proposed NWP activity and the associated incitlental take were considered
in the intemal ESA section 7 consultation conducted for the ESA sectlon 10(a)(1)(B)permiL If that coordination results In concurrence from ihe
agency that ihe proposed NWP activity and the associated incidental[ake were considered in the internal ESA section 7 consultation for the
ESA section 10(a)(1)(B)permit,the district engineer does no�need to conduct a separate ESA section 7 consultation for the proposed NWP
activity.The district engineer will notify the non-federal applicant within 45 days of receipt of a complete pre-construction nolification whether the
ESA section 10(a)(1)(B)permit covers the proposed NWP ac�iviry or whether adtli�ional ESA section 7 consultation is requiretl.
(g) Information on the location of threatened and endanqered species and their cri�ical habitat can be obtained direcUy from the oftices of Ihe

19.Miqretory Birds and Bald and Golden Eaqles.The permittee is responsible for ensuring�heir action complies with Ihe Migratory Bird Treaty Act and
Ihe eald and Golden Ea91e Protection Act The permittee is responsible for con[ac�ing appropria(e local offce of(he U.S.Fish and Wildlife Service to

determine applicable measures to reduce impacts to migratory birds or eagles,including whether"incidental take"permits are necessary and available
under the Migralory Bird Treaty Ac�or Bald and Golden Eagle Protection Act for a pahicular activiry.
20.Historic Prooerties.
(a)In cases where the tlis�rict engineer tletermines�hat the activity may have the potential to cause effec�s�o properties listed,or eligible for
listing,in Ihe National Register of Historic Places,the activiry is not au�horized,until the requirements of Section 106 of the Na�ional Historic
Preservation Act(NHPA)have been satis(ied.
(b)Federal permi[tees should follow their own procedures for comptying with the requirements of sec�ion 106 0/the National Historic
Preservation Act.If pre-conslruction notifcation is required for the proposed NW P activiry,the Federal permittee must provide the tlistrict
engineer with Ihe appropriate documentation to demonstrate compliance wi[h Ihose requiremen�s The district engineer will verify Ihat[he
appropriate tlocumentation has been submi�ted.If the appropriate documentation is not submitted,�hen additional consWtation under section
106 may be necessary.The respec�ive federal agency is responsible for fulfilling its obligation to comply with seclion 106.
(c)Non-fetleral permittees must submit a pre-construction notification to the district engineer it the NWP activiry might have the potential to
cause effects to any his�oric propetlies listed on,determined to be eligible for lis�ing on,or poten�ialty eligible for listing on the National Register
of Historic Places,including previously uniden�ifietl properties. For such activities,Ihe pre-conshuction notificalion must state which historic
properties might have lhe potential to be affectetl by the proposed NWP activity or include a vicinity map indicating the location of the historic
properties or[he po�ential for Ihe presence of historic properties.Assistance regarding information on�he location of,or poten�ial for,�he
presence of hisloric properties can be sougM from�he State Historic Preservation Officer,Tribal His�oric Preservation Officer,or designated
tribal representative,as appropriate,and�he National Regis�er of Historic Places(see 33 CFR 330A(g)).When reviewing pre-consVuction
notifica�ions,tlis�rict engineers will comply wi�h the current procedures for addressing Ihe requirements of section 106 0(the National Historic
Preservation Act The district engineer shall make a reasonable and good fai�h effoM1�o carry out appropriate identifcalion efforts,which may
include background research,consul�ation,oral his�ory interviews,sample feld investigation,and field survey. Based on the information
submitted in the PCN and these identifica�ion efforts,the district engineer shall determine whether ihe proposetl NWP activity has�he potential
to cause effects on the historic properties.Sec�ion 106 consWta�ion is no(required when the district engineer determines tha�Ihe activity does
not have[he potential[o cause e(fec�s on hisloric propetlies(see 36 CFR 8003(a)).Section 106 consultation is required when�he dislrict
engineer determines�hat�he aclivity has the potential to cause effects on historic properties.The tlis�rict engineer will conduct consultation with
consulting parties identifed under 36 CFR 80Q2(c)when he or she makes any o(the following effect de�erminations for�he purposes of section
106 of the NHPA�.no his�oric properties aftected,no adverse eRect,or adverse effecL Where�he non-Federal applican�has identified historic
pmperties on which the activity might have lhe potential lo cause effecis antl so notified�he Corps,the non-Federal applicant shali not begin[he
ac�ivity un�il notifietl by the district engineer either that the activiTy has no potential to cause effec[s to historic properties or�ha�NHPA sec�ion
106 consultation has been completed.
(d)For non-federal permit�ees,the tlis�rict enqineer will nolify�he prospective pertni��ee within 45 days of receipt of a complete pre-construction
no�ifica�ion whether NHPA section 106 consultation is required. If NHPA section 106 consul[ation is required,�he dis�ric�engineer will notify the
non-Fetleral applicant that he or she canno[begin the activity until section 106 consul�ation is completed. If the non-Fetlerel applicant has not
heard back from the Corps within 45 days,�he applicaN mus�s�ill wait for notificalion from lhe Corps.
(e)Prospective permittees should be aware[hat sec�ion 110k of Ihe NHPA(54 U.S.C.306113)prevents the Corps from granting a permi�or
olher assislance lo an applicant who.wi�h intent to avoid�he requirements of sec�ion 106 of the NHPA,has intentionally significantly ativersely
affected a historic pmperty to which the permit would relate,or having legal power�o prevent it,allowetl such signifcant adverse effect to ocwr,
unless the Corps,after consWtation with ihe Advisory Council on Historic Preservation(ACHP),determines that circumslances justify granting
such assislance despite the ativerse effect crealetl or permitted by the applicanL If circumstances justify granting the assistance,the Corps is
requiretl to notify the ACHP and provide documenta�ion specifying the circums�ances,the degree of damage to the integriry of any historic
properties aHec�etl,antl proposed mi�igation.This tlocumentation mus�include any views obtained from the applicant,SHPO/THPO,appropriate
Indian tribes if Ihe undertaking occurs on or affects hisloric properlies on tribal lands or affects properties of interest to those tribes,and other
padies known to have a legitima�e interes�in the impac�s�o the permitted activity on histotic properties.
21.Discovery of Previouslv Unknown Remains antl Artifacts. If you discover any previously unknown historic,cWtural or archeological remains and
artifacts while accomplishing the activiry authorized by Ihis permit,you must immedialely notify the disirict engineer of what you have found,and to the
maximum extent praclicable,avoitl conslruction activities ihat may a((ect ihe remains antl artifacts until the required coordination has been completed.The
district engineer will initiate the Federal,Tribal,and state coordination required to de�ermine if�he items or remains warrant a recovery eftotl or if the site is
eligible for listing in the National Regis�er of Historic Places.
22.Desiqnated Critical Resource Waters.Critical resource waters inclutle.NOAA-managetl marine sancWaries and marine monuments,and National
Estuarine Reseamh Reserves.The district engineer may designate,after notice and opportunity for public comment,additional waters offcially designated
by a state as having particular environmental or ecological significance,such as outstanding national resource waters or state natural heritage sites.The
district engineer may also designate atlditional critical resource walers after notice antl opportunity tor public comment.
(a)Discharqes of dretl9etl or fill material into waters o(the United Slales are not authorized by NW Ps 7, 12, 14, 16, 17,21.29, 31,35,39,40,
42,43,44,49,5q 51,and 52 for any activity withln,or dlrectly affecting,critical resource waters,including wetlands adjacent to such waters.
(b)For NWPs 3, 8, 10, 13, 15, 18, 19,22,23,25,D,28.30,33,34,36, 37,38,and 54, notifcation is required in accordance with general
condition 32,for any activity proposed in the designated critical resource waters inclutlinq wetlands adjacenl lo those waters The district
engineer may authorize activities under these NWPs only after it is determined that the impacts to the critical resource waters will be no more
[han minimal.
23.Mitiqa[ion.The district engineer will consider ihe following factors when determining appropriate and practicable mitigation necessary to ensure tha[
the individual and cumula�ive adverse environmental effects are no more than minimaC
(a)The activity mus�be designed and consVucted to avoid and minimize adverse effects,both temporary and permanent,lo wa�ers of the
United States to the maximum exten�practicable at the project site(i.e.,on site).
(b)Mitigation in all its forms(avoiding,minimizing,rectifying; reducing,or compensating for resource losses)will be required to�he extenl
necessary lo ensure that the individual and cumula�ive adverse environmental effec�s are no more Ihan minimal.
(c)Compensa�ory mi[igation at a minimum one-forvone ratio will be required for all wetland losses tha�exceed 1/10-acre and require pre-
consVuc�ion nolificalion,unless the distric�engineer determines in writing that either some other form of mitigation would be more
environmentally appropriate or lhe adverse environmeMal effects of the proposed activity are no more than minimal,and provides an activiry-
specific waiver of this requirement.For we0and losses of 1I10-acre or less that require pre-construction notifcation,the district engineer may
delermine on a case-by-case basis that compensatory mitigation is required to ensure that the activity results in only minimal adverse
emironmental eHecis.
(d)For losses of sireams or other open waters that require pre-construction notifcation,the district engineer may require compensatory
mitigation to ensure that the activity resul�s in no more than minimal adverse environmental effects Compensatory mi�igation for losses of
s[reams should be provided, if practicable,through slream rehabili[atioa.enhancement,or preservalion,since slreams are diffcWt to-replace
resources(see 33 CFR 3323(e)(3)).
(e)Compensatory mitigation plans for NWP activities in or near sUeams or other open walers will normalty include a requirement(or the
restoration or enhancement,maintenance,and legal protection(e.g.,conservation easemen[s)of riparian areas nezt lo open waters. In some
cases,lhe restoration or maintenancelprotection of riparian areas may be[he onty compensatory mitigation required. Restored riparian areas
should consist of native species.The widih of ihe required riparian area will address documented water quality or aqualic habilat loss concems.

Final Regulations Pertaining to the Issuance, Reissuance, )
and Modification of Nationwide Permits )
On January 6, 2017,the United States Department of the Army, Corps of Engineers (COE),
published its final notice regarding the Issuance of Nationwide Permits (NWPs) in the Federal
Register(agency docket number COE-2015-0017). The publication includes new,existing, and
modified NWPs. Publication of these NWPs serves as the Corps' application to the State for
water quality certification (WQC) under Section 401 of the Federal Clean Water Act(CWA).
The Wisconsin Department of Natural Resources (WDNR) has examined the final regulations
pursuant to Section 401, CWA,and Chapter NR 299,Wisconsin Administrative Code (Wis.Adm.
Code).
The WDNR has determined the following conditions for the NWPs are required to ensure
compliance with state water quality standards enumerated in s. 299.04,Wis.Adm. Code. The
certification contained herein shall expire on March 19, 2022.
Section 401 Certification does not release the permittee from obtaining all other necessary
federal,state, and local permits, licenses, certificates,approvals, registrations,charters, or
similar forms of permission required by law. It does not limit any other state permit, license,
certificate, approval, registration, charter,or similar form of permission required by law that
imposes more restrictive requirements. It does not eliminate, waive,or vary the permittee's
obligation to comply with all other laws and state statutes and rules throughout the
construction, installation, and operation of the project.This Certification does not release the
permittee from any liability, penalty, or duty imposed by Wisconsin or federal statutes,
regulations, rules, or local ordinances,and it does not convey a property right or an exclusive
privilege.
This Certification does not replace or satisfy any environmental review requirements, including
ihose under the Wisconsin Environmental Policy Act(WEPA)or the National Environmental
Policy Act(NEPA).
Note:The specific language in the NWPs is not included in this document. Copies of complete
nationwide permits published in the Federal Register on January 6, 2017, may be obtained from
your local COE field office.
STATE CONDITIONS AND LIMITATIONS OF CERTIFICATION
GENERAL CONDITIONS:
1.The permittee shall allow the WDNR reasonable entry and access to the discharge site to
inspect the discharge for wmpliance with the certification and applicable laws.
2. If any of these §401 water quality certification conditions are found invalid or unenforceable,
the water quality certification is denied for all activities to which that condition applies.
3.Water quality certification is denied without prejudice for activities involving the temporary
stockpiling of dredged or fill material in waters of the state, including wetlands.
4. No discharges of dredged or fill material below the ordinary high water mark of a navigable
stream as defined by s. 310.03�5),Wis. Adm. Code, may take place during fish spawning periods
or times when nursery areas would be adversely impacted.These periods are:
• September 15th through May 15`h for all trout streams and upstream to the first dam or
barrier on the Root River(Racine County), the Kewaunee River(Kewaunee County), and
Strawberry Creek(Door County�. To determine if a waterway is a trout stream,you may use
the WDNR website trout maps at http://dnr.wi.�ov/topic/fishina/trout/streammaps.html.
• March 1'�through June 15th for ALL OTHER waters.
5. Unless specifically exempt from state statute and federal Pre-Construction Notification (PCN)
requirements, Applicants seeking authorization under these NWPs shall complete the Joint
State/Federal Permit Application on the department e-permitting site at

the following NWPs. Certified activities are subject to WQC conditions 1-5 above. If activities are
denied without prejudice,the applicant must apply to the WDNR for an individual 401 WQC.

o WQC denied: Where the effluent from the outfall is not regulated under the WPDES

Nationwide Permits Denied Water Quality Certification Without Preiudice At This Time:
The following NWP categories are denied Water Quality Certification (WQC) in their entirety and
require an individual Section 401 WQC for all activities under these NWPs. In instances where a
state has denied the 401 WQC for discharges under a particular NWP, permittees must furnish
the District Engineer for the COE with an individual 401 WQC.
Each category was reviewed and it was determined that: potential water quality and beneficial
use impacts would be beyond that considered minimal; the activity was not likely to occur in
Wisconsin; the NWP doesn't align with state general permit standards required by statute (NWP
29, 40, 43}; inadequate data was available for WDNR to fully evaluate potential water quality
and beneficial use impacts; or the category was empty (Reserved).

NOTICE OF APPEAL RIGHTS

Statutes and administrative rules establish time periods within which requests to review
Department decisions must be filed.
To request a contested case hearing pursuant to section 227.42,Wisconsin Statutes,you have 30
days after the decision is mailed,or otherwise served by the Department,to serve a petition for
hearing on the Secretary of the Department of Natural Resources.
This determination becomes final in accordance with the provisions of s.NR 299.05(7),Wisconsin
Administrative Code,and is judicially reviewa6le when final. Forjudicial review of a decision
pursuant to Sections 2Z7.52 and 227.53,Wisconsin Statutes,you have 30 days afterthe decision
becomes final to file your petition with the appropriate circuit court and to serve the petition on
the Secretary of the Department of Natural Resources.The petition must name the Department
of Natural Resources as the respondent.
