The submittal described above has been reviewed for conformance with applicable Wisconsin Administrative Codes
and Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. This system is to be constructed and
located in accordance with the enclosed approved plans and with any component manual(s) referenced above. The
owner, as defined in chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements.
No person may engage in or work at plumbing in the state unless licensed to do so by the Department per s. 145.06,
stats.
The following conditions shall be met during construction or installation and prior to occupancy or use:
Reminders
• If using the existing septic tank, it must be inspected for watertightness and structural soundness, size and
baffles, and must be brought into conformance with the requirements of ch. SPS 383, Wis. Adm. Code.
• A sanitary permit must be obtained from the county where this project is located in accordance with the
requirements of Sec. 145.19, Wis. Stats.
• Inspection of the private sewage system installation is required. Arrangements for inspection shall be made with
the designated county official in accordance with the provisions of Sec. 145.20(2)(d), Wis. Stats.
• A state approved effluent filter is required.Maintenance information must be given to the owner of the tank
explainingthat periodic cleaning of the filter is required.
• A copv of the approved plans specifications and this letter shall be on-site durin�construction and oqen to
insqection bv authorized representatives of the Department,which mav include local inspectors.
Owner Responsibilities
• The current owner,and each subsequent owner,shall receive a copy of this letter.Owners shall also receive a
copy of the appropriate operation and maintenance manual(s)and be responsible for ensuring that POWTS is
operated and maintained in accordance with this chapter and the approved management plan under s.SPS
383.54(1�.
• In the event this soil absorption system or any of its component parts malfunctions so as to create a health
hazard,the property owner must follow the contingency plan as described in the approved plans.
• The owner is responsible for submitting a maintenance verification report acceptable to the county for
maintenance tracking purposes.Reports shall be submitted at intervals appropriate forthe component(s)utilized
in the POWTS.
In granting this approval the Division of Industry Services reserves the right to require changes or additions should
conditions arise making them necessary for code mmpliance.As per state stats 10112(2�,nothing in this review shall
relieve the designer of the responsibility for designing a safe building structure,or component.

on this letterhead.
The above left addressee shall provide a copy of this letter and the POWTS management plan to the owner and any
others who are responsible for the installation,operation or maintenance of the POWTS.

Dear Pinewood Properties LLC, Adam Bodenschatz:
The Wisconsin Department of Natural Resources (WDNR) has reviewed your request for a variance to the
Chippewa Flowage covenant restrictions for your property at 8677N Cty Hwy CC in the Town of Hunter, Sawyer
County,Wisconsin. This lot is further identified as having Sawyer County Tax ID#012740142414. The variance
would impact a set of septic tanks on the property, wbich are currently located within the l 00' buffer zone.
As stated in your letter received on April 26`�2023,the variance would allow the existing failed septic tanks to be
replaced within the buffer zone in their original location. The letter also stated that moving the septic tanks
beyond ]00' would result in increased ground disturbance.
Given the potential impacts to the visible shoreline and the overall management goal to "perpetuate the
undeveloped shoreline character of the Chippewa Flowage,"WDNR and Xcel Energy have agreed to approve this
variance request for the life of the current septic system. The entire system will need to be moved beyond the 100'
buffer zone at the time of replacement.
All other covenant restrictions are still in effect on your property and all disturbed areas within the buffer zone
will need to be planted with native vegetation. All other county and state codes and permits apply to the subject
property and must be applied for and adhered to.

Dear Eric:
1 have reviewed the building permit application submitted by Pinewood Properties to construct a new sanitary
system in the lots adjacent to and directly west of 8677N Cty Hwy CC in the Town of Hunter, Sawyer County,
Wisconsin. These lots are further identified as having Sawyer County Tax ID (west to east)#O]2740142407,
#012740142404, #012740142414, and#012740144204.
All of these parcels are encumbered by covenants that have been recorded in the Sawyer County Register of
Deeds office in Volui��e 429, Pages 203-207 and are subject to the restrictions therein. As such, these covenants
prohibit filling, grading, placement of structures, and cutting of native vegetation within the 100-foot horizontal
distance landward from N�e shoreline above elevation 1,313 MSL. Additional restrictions extend 1,000 feet
landward from the 1,313 contour line requiring that the exterior color of the building be natural wood and earth
tone color, and less than 35 feet in height.
The only exception is that tlle northern portion of parcel#012740142414 is without covei�ants. This covenant-
free portion extends to the North of the NESW/SENW boundary of T40N, R07W, 514. All of the other parcels
and the remainder of parcel #012740142414 are encumbered by covenants.
It is unclear from the supplied sketch included within the application plan if the proposed structures will be placed
beyond 100' from the shoreline to the east of the parcel, as it does not include the distance of proposed work and
disturbance to the shoreline. Structures include but are not limited to: septic coinponents, drain fields, and wells.
It is the responsibility of the landowner to ensure that any development of the property is not done in violation of
these covenants.
All other counry and state codes and permits apply to the subject property and must be applied for and adhered to.

To: Mr. Kenast
Based on our observations on April 18, 2023 at the above property, I would strongly
recommend the steel septic tank and the steel puinp tank be properly abandoned and have
the owner contact a Wisconsin licensed plumber to obtain proper sanitary permits for a
product approved, code-complying, and watertight tank(s) to be installed in the same
location to prevent many of the health and safety concerns associated with old steel septic
tanks.
Over time, steel tanks corrode and are prone to cave-ins, or collapse; due to heavy
saturated soils, frost heaving, or coinpaction from driving or walking over the tanks.
Corroded steel septic tanks pose the risk of leaking and contaminating groundwater,
drinking water and surface waters.
The following code references from Wisconsin Department of Safety and Professional
Services (DSPS) pertain to several common issues that occur with old, failing, corroded,
steel septic tanks:
SPS 382.10(1)(a) —Plumbing in connection with all buildings, public and private,
intended for human occupancy, shall be installed and maintained in such a
manner so as to protect the health, safety and welfare of the public or occupants
and the waters of the state.
SPS 382.22(1)(a)—All plumbing systems, both existing and new, and all parts thereof,
shall be maintained in a safe and sanitary condition.
SPS 382.22(1)(b) —All devices or safeguards that are required by this chapter shall be
maintained in good working order.
SPS 384.25(3) — Tank assemblies, including fittings and access openings, shall be
capable of withstanding loads and pressures that the tanks are intended to
encounter and remain watertight.
