Since there was an existing shed located on the property over the period of 10 years it would be viewed as an "existing non-conforming structure". This terminology ineans that you are allowed to keep the non-confonnity as long as the use or the size of the shed is not changed. In conversations with you, you had indicated that you replaced the existing shed on the property of the same size. This is an allowed use of a replacement of the existing non-conforming structure. However, the newly placed shed will require a Land Use Permit (LUP) from our office. Please complete the attached LUP and submit back to our office with the fee of $50. If you require additional assistance with filling out this permit you may reach back out to me but I can fill in a lot of the required information as it relates to the setbacks. I am setting an order for correction to have the LUP with the $50 submitted back to our office by May 31, 2023. Failure to comply with this order for correction will result in citation for $452.50 with a recommendation to the Judge for a daily forfeiture in the amount of$25 for every day the shed remains in violation. Our office has been notified that a shed was placed on the property without pennits. Sheds are vacant land are allowed but must be granted a Land Use Permit from our office and must meet the following requirements: An exemption is granted for one (1) STORAGE SHED / STORAGE STRUCTURE to be allowed on vacant parcels with the following requirements: 1. Parcel must contain a minimum of 20,000 square feet of land area. 2. This exemption is not allowed in platted subdivisions. 3. This exemption requires a Land Use Permit regardless of size and not to exceed 144 square feet of footprint area. 4. Must be less than 14' in height. 5. No habitation is allowed in these exempt structures. 6. Applicable accessory structure setbacks shall be applied. 7. A fire number/site address is required as part of this STORAGE SHED / STORAGE STRUCTURE exemption. 8. A SHIPPING CONTAINER / INTERMODAL CONTAINER in excess of 144 square feet is not allowed for this exemption. 9. Check with respective Town or County Highway Department if a driveway permit is required. The shed located on your property is in violation of these provisions as the total size is exceeds the 144 sq ft allowed as the shed exemption. Furthermore, it appears that the shed is being used a habitation which is also in violation of the ordinance requirements. A primary dwelling that would allow for habitation must meet dimensional requireinents of at least 20' of width x 20' of length and contain a minimum of 500 sq ft of total habitable living area with approved Land Use Permit. ��I�e9w� �on—�o� �r^'•:�j � I ain setting an order for correction to have the shed removed from the property by May 15, 2023 or to apply for a Conditional Use Permit as listed in Section 4.26 of the Sawyer County Zoning ordinance. Failure to comply with this order for correction will result in citation for $452.50 with a recommendation to the Judge for a daily forfeiture in the amount of $25 for every day the shed remains in violation.
