Regarding the building permit for the property at 13-39-9. I called to ask if there was to be a 10 foot deck on the Whitefish Lake side of the building. If so, it would need to be at least 7S from the ordinary highwater mark of the lake. Parcel size is approximately 270' /450' x 703' /903' containing 6.75 acres. Property is zoned Residential/Recreational One and Wetland One. Application is for the construction of a dwelling at a setback of 28 feet from the ordinary highwater mark of a navigable wetland. Variance is requested as Section 4.49 (1) , Sawyer County Zoning Ordinance, would require a minimum setback of 75 feet from the ordinary highwater mark of navigable wetlands adjacent to any navigable waters. Town Board denied. The Board of Appeals approved the application as submitted. Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would not be a self-created hardship. There would be no change in the use in the zone district. It would be due to special conditions unique to the property. Without a variance the property would be rendered useless. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice.
