and the building permit application. This is because your sign permit has been
approved but the land use application is on hold until after the May 1998 public hearing
regarding your property.
Rather than hold up the sign permit until then, if you send us two separate checks for

1. Your acceptinp thls permlt and bealnnlna to construct the proiect means that vou have read understand

2. A photograph of the completed proJea shall be submitted to the Department within 10 days of pro�eq completion.
3. You are hereby authorized to place clean fieldstone or quarry stone 6 to 24 Inches in diameter atong� Ilneal
feet of the shoreline. The stone may axtend up to_�feet waterward as measured from the existing bank. The
stone shall fo�low the natural contour of the shoreline and shall not be placed higher than .�.6 Inchas above the
ordinary high watermark. The flnal rlprap slope shali not exceed 2 feet horizontal to 1 foot vertical.
4. All grading and excavation must be corHined to the minimum area necessary for construction and shall not exceed the
maxlmum area allowed by the local shoreland zoning ordlnance or 10,000 square feet, whichever is less.
5. The use of fitter cioth, or a fiher layer, under the riprap Is recommended to extentl the I'rfe of the struqure and to Improve
ef(ectiveness.
6. The project shall be construaed in a manner that prevents upland soil losses and sedimantation of the waterway. Temporary
erosion control measures such as mulch, silt fence, and/or straw bales shall be used as needed and shall be put in place
prior to any preclpilation or H work ceases for longer ihan 24 consecutive hours. Any upland areas disturbed during
construalon shall be properly stabilized Immediately following project completion by seeding and mulching.
7. The removal of trees, shrubs, and other shoreline vegetation shall be kept to a minimum and any vegetation removal above
the ordinary high watermark of the waterway must comply with the shore cover removal requirements of the local county
zoning ordlnance.
8. No waterward extenslon of ihe upland property Is permitted other than what is reasonably necessary for the piacement of
riprap to stabillze and protect the existing bank. No fill material may be placed in a wetland or below the ordinary high ..
watermark of any surface watec '�.

Vendor and Purchaser agree that the Land Contract is hereby amended as follows: # �2---�
EXEMPT
1. The Land Contrnct is for real property only.
2. The total Land Contract balance as of the date hereof, is Ninety-three Thousand and
No/100 Dollars ($93,000.00), which shall beaz interest at the rate of nine percent
(9%) per annum until paid in full, with interest ouly to be paid monthly beginning
January 1, 1997,and on the fust day of each month thereafter until the entire balance
is paid in full. Interest shall be paid in aaeazs. The entire Land Contract balance and
accrued interest shall be paid in fu11 on the later to occur o£ (i) December 31, 1997;
or, (ii) the date which is three (3) months after Vendor's receipt of a"no fw-ther
action"letter from the Wisconsin Deparhnent of Natural Resources ("WDNR") for
the environmentat remediation which Vendor is undeztaking at the property that is
the subject of tlus Land Contract(the"Property").
3. Vendor shall send Purchaser copies of all sample analyses, reports and
correspondence from the envuonmental consultant performing the investigarion and
remediation of the Property and from the WDNR.
4. The first three(3)pazagaplvs set forth on the page entitled"ADDITIONAL TERMS"
of the Land Con�act, which page was recorded at Page 164 in Volume 523 of
Records, aze hereby deleted in their entirety.
5. The last patagraph set forth on the page entifled"ADDITTONAL TERMS" of the
Land Conhact,wlrich page was recorded at Page 164 in Volume 523 of Records, is
modified as follows:
A. Vendor discloses that he has removed the two (2)underground storage tanks
from the Property and aclmowledges that he is the person responsible for thz
environmental remediation of any contamination which may exist on the
Property because of the undergtound storage tanks.
g, purchaser hereby grants Vendor, his employees, agents, consultants, and
contractozs reasonable access to enter on, over and undet so much of the
Property as is necessary for Vendor to undertake and complete the
environmental remediation and restoration of the Property.

C. Vendor shall, at his cost and expense, upon compleuon of the remediation
promptly restore the portion of the Property affected by the environmental �
remediation, to a condition substantially equal to that e�cistine prior to the
commencement of such remediation.
D. In connection with Vendor's environmental remediation and restoration of
the Property,Vendor expressly reserves any and all rights wtuch Vendor may
have to seek and obtain: (i)reimbursement from and�or participation by the
State of VJisconsin and its Departments and PECFA Program; aud/or (u)
contribution from any prior owners of the Property. Purchaser expressly
agrees to cooperate witl�Vendor in connection with the prepazation and filing
of any necessary documents in connection with all such reimbursements,
participations and/or conhibutions.
6. The paragraph set forth on the page of the Land Contract that was recorded at Page
165 in Volume 523 of Records,is modified to state that Purchaser shall apply wiih
the Town of Haywazd for the transfer of the liquor license to Purchaser's name so
that the license can remain with the Properiy, however, in the event the Town oi
Hayward will not allow the transfer of said license to Purchaser, it shall not
constitute a Purchaser's default of the Land Contract.
7. Vendor acknowledges and agrees that, as of the date hereof; Purchaser is not ir.
default of anp provision of the Land Contract.
8. Except as herein modified, the Land Contr�acl remains in full force and effect, and
tlus Land Contract Amendment is not intended to and does not further moclify any
other provisions of the Land Contract
