Building
Dear Mr. Berg:
Last week while visiting with a property owner on West Shore Lane I observed a 10' x
16' storage building being constructed on your property — new concrete slab with stud
walls. Upon returning to the office I discovered that LUP #98-351 had been issued by
this office on July 15, 1998 for the construction of three decks and the storage building.
This permit expired on July 15, 1999. I have not been able to locate a more recent permit

further complicate matters; the ordinance now requires a minimum 40' setback between
structures and wetland areas. It is my opinion that the building is being constructed closer
than 40' to the wetland area behind the cabin.
Mr. Berg, you have three options: (1) Remove the slab/walls and construct the storage
building in a location on the property that meets all setback requirements, (2) apply for an
"after-the-fact" variance to allow for the construction of the building in its current
location or (3) remove the slab/walls and not construct the building at all. . I am
enclosing a copy of the "Conclusions of Law" that states the criteria for the granting of a
variance. A variance would not be granted if a location can be found on the property for
the building where all minimum setbacks can be met.
