REVOCATION OF LAND USE PERMIT (LUP) #00-480
Dear Mr. Tilton:
I was informed this morning that the side lot line setback to your proposed addition is
approximately 30", not the 10' setback as indicated on LUP 00-480. As you probably
know, the addition cannot be constructed closer than 10' to the adjacent side lot line.
Mr. Tilton, I have no choice but to revoke LUP 00-480 effective immediately. I am also
ordering the removal of any part of the addition that is closer than 10' to the side lot line.
Removal is to be accomplished by Friday, December 29, 2000.
You have the option of applying for an after-the-fact variance to construct the addition
closer than 10' to the side lot line. If you decide to apply for the variance, the signed
application, with payment in the amount of$250.00, must be in this office by this Friday,
November 3, 2000. The public hearing before the Sawyer County Board of appeals would
be on Tuesday, December 19, 2000. The Board would make a final decision at that time
on your application.
The criteria for the granting of a variance is that variances are to only be granted when, in
the absence of the variance, the applicant will have no reasonable use of the property.
The Sawyer County Board of Appeals will definitely address the following issues:
• reasonable use of property, (do you have reasonable use of the property
without the addition?) and
• can the addition be constructed at another location where the required setbacks
can be met.
