On October 15, 2002, the Sawyer County Board of Appeals denied your application for variance
on the following described real estate to wit:
Part of Govt Lot 7, S 34, T 40N, R 9W, Parcel :7.2. Vol 519 Records Page 231.
Lot size is 95'x150'/276'x252' containing 0.46 acres. Property is zoned Residen-
tial/Recreational Two. Application is for the construction of an 18'x24' detached
1 1/z story garage (including eaves), at a setback distance of 40' from the ordinary
high-water mark of Durphee Lake and 32' from a wetland area. Variance is re-
quested as Section 4.49(1), Sawyer County Zoning Ordinance, would require a
minimum setback distance of 75' from the ordinary high-water mark of the lake
and 40' from the wetland area. The Town Board has approved the application.
The Board of Appeals denied the application as submitted.
Findings of Fact of the Board of Appeals: They did not prove a hardship. They have reasonable
use of the property. It is for the convenience of the owner and it is not due to special conditions
unique to the property.
Any person or persons jointly aggrieved by this decsion of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 02-031.

Describe what you consider"reasonable use" of your property.
Reasonable use of my property would be the ability to construct a garage.
Describe the hardship(s) that exists that does not allow you "reasonable use" of your
property.
The hardship is a Iack or an area that could be used to build. I have worked with the
Wisconsin DNR and Sawyer County Zoning in finding an alternative solution with no
success. My property is approximately '/2 acre with around 50%that has been labeled
navigable water. My taxes are based on the '/z acre with no consideration given for the
limitations placed upon me.
Did this hardship(s) exist when you became the property owner?
No. The Wisconsin DNR and Sawyer County Zoning did not inform me there would be
limitations. The fact that ? was paying, and continue to pay taxes on the entire '/2 acre is
reasor, to believe I live on a property that can house a garage.
Explain how the granting of this variance will provide you with "reasonable use" of
your property.
My family is considering moving permanently to the property and we would need a
garage for storage and protection from the inclement weather.
A variance will not be contrary to the public interest because...
Since the property is located on a dead-end, private road, the public will not be affected
by the granting of this variance. All neighbors are very supportive of any and all
improvements including our efforts to build a garage.

Dear Mr.Partlow:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance-Additional Information,"and a completed
• "Variance Application."
Please review the inspection report,read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance,you should then
review the variance application for conectness,sign it,and return it to this office with a
check in the amount of$250.00 by Friday,August 3,2001 for hearings in September
2001.
The"Application for Variance-Additional Information"must also be completed and
returned with the Variance Application. Both documents together make up Yhe entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your"Variance Application"will be reviewed at two public hearings.The first hearing
will held by the Town of Bass Lake at 630 P.M.,Monday,September 10,2001. You
should contact Shirley A.Miller,Town of Bass Lake Clerk,at(715)634-2172(home)to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday,September 18,2001,in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing,especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance,the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince tlie Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Boazd.

Your application for a variance will be considered at a Public Hearing before the
Sawyer Cou�ty Zoning Board of Appeals on
15 October 2002
This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack
of information about the situation may result in unnecessary delay of a decision.
Failure to appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement
to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, Shirley Miller; 715/634-2172 to obtain the time and confirm the date of
the Town Board meeting for your attendance or the attendance of your agent.
