Deaz Mr. Lyberg:
Enclosed is an Application for Land Use Permit for proposed construction activities on
your condominium unit. As you know, this unit is nonconforming as it is located closer
than 75' to the lake. Because of iYs nonwnformity, there aze specific restrictions that
apply to the construction of additions or the making of improvements to this unit.
First, the average lake setback for this unit is 4T from the lake. Construction activities
closer than 4T to the lake would require the prior approval of a variance. From the
August 14, 2001 inspection report it appeazs that the 8' deck is 40' from the lake. This
would put the dwelling 48' from the lake. Thus, construction activities on the dwelling
would be greater than 4T from the lake.
Second, the 50% cunent estimated fair market (CEFMV) rule applies in this situation as
the dwelling is a nonconforming structure. The "50% rule" restricts the cost of
improvements to a nonconforming structure to no more than 50% of the CEFMV of the
structure. The 50% CEFMV for the dwelling is $22,900. Construction costs exceeding
$22,900 would require the approval of a variance by the Sawyer County Board of
Appeals.
The 50% current estimated fair market (CEFMV) rule is intended to allow the owner of a
nonconforming structure the opportunity to alter, repair and add onto that structure within
the limits of the costs of material and labor to perform these activities. The combined
costs of materials and labor shall not exceed 50% of the CEFMV of that particular
nonconforming structure. Alterations, additions to and the repair of a nonconforming
structure aze those activities that, once accomplished, will result in the significant
extension of the life of that nonconforming structwe. Please contact this office for an
explanation of what is and is not included in the 50% CEFMV calculations.
Third, construction activities aze permitted if the nonconformity of the building is not
incieased. In short, unit#5 cannot be expanded any closer to unit#4 or any closer to the
lake. An addition could be constructed towards unit#6, provided that the addition would
_ - be no closer thac� 20' from unit#6. The minimum required setbacks between
condominium units is 20' (eave to eave).

Dear Mr. Lyberg:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information"
• "Variance Application" - completed.
If you believe that you meet the criteria for the requested variance, you should review the
application for correctness, sign it, and return it to this office with a check in the amount
of $250.00 made out to the "Sawyer County Zoning Administration" by Friday, August 2,
2002 for hearings in September 2002.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Hayward at 7:00 P.M., Tuesday, September 10, 2002. You should contact
Jodi Longtine, Town of Hayward Clerk, at 634-4123 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 17, 2002, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

Sawyer County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer Counry Courthouse, 10610 Main
Street, Hayward, Wisconsin.

to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This

and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
