On September 17,2002,the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:

construction of a 28'x36'two-story replacement dwelling(including eaves),with

a wetland azea that is adjacent to navigable water. Variance is requested as Sec-
tion 4.49(1), Sawyer County Zoning Ordinance, would require a minimum set-
back distance of 75'from this wetland area.The Town Board has tabled the appli-
cation.
The Board of Appeals approved the amended application as follows:Delete 12'x12'deck.Ap-
proved a 2-story, 36'x44' replacement dwelling including eaves,covered entry and deck at 20'
from the wetland area and 75'from the ordinary high-water mark of the lake.
Findings of Fact of the Board of Appeals:It would not be the convenience of the owner.It would
not be the basis of economic gain or loss.There would be no change in the use in the zone dis-
trict.It would be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decsion of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.In future correspondence,or in applying for permits,please

recommending to the��a��that the Ahmann variance application be heard
at the September�',2002 Public Hearing. He has stated that since the Ahmanns
variance application has been tabled since the July Public Hearing, it should be heard at

County Board of Appeals.
Read the attached "CouR Decisions Regarding the Granting of Variances" prior to
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sa���er Countv
Zonin� Ordinance would result in unnecessan hardship. Present [G"isconsin cnse 1a1��
describes hardship ns being present only ichen an npplicant has dernonstrated thnt he
or she lvi!! hnve no reasonnble use of the properry, in the absence of a tinrinnce. If a
parcel as a�vhole (but not necessarily each portion of the parcel) procides some
reasonable use for its o«ner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship (i.e.. purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be eranted, �rhen in the absence of the
variance approval, the owner �vill suffer loss of profit or financial hardship. Decks
and similar minor accessor} structures are not essential to the reasonable use of
property and are not elieible for variances.
2) The hardship must be due to unique phvsical limitations of the oropert� which are no[
eeneraflv shared b� other propeRies. Gro�cing families, additional li�ine area for
guests, the desire for a lar�er garage etc., are not factors in deciding variances.
3) A variance ma�� not be eranted �vhich results in harm to public interests. The Sa�ryer
County Zoning Ordinance was adopted "for the promotion and protection of the
public health, morals, safety, and the general �celfare." Additionally, the shoreland
zonin� provisions of the Ordinance, provides for �vater quality, �cildlifz habitat,
fisheries and natural scenic beauty protection of the County's lakes, ri�ers and
streams
4) Other considerations:
a. Self-created hardshios. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot ��hen the owner
has sold off portions that would have prevented the hardship, creatin� a land-
locked parcel by selling property, buildine during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bY nei ng bors. In Slate u. Kenosha County Board ofAdjustment, the
Board of Adjus[ment in part based its variance on the fact that many other
neighbors have decks within the setback. The couR rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the proaertv. Variances are granted for hardship that pertains
to the condi[ions of the property, rather [han to the person making the application.
Accordingly, variances run with the property and are not terminated when the
proper[y changes hands.

amount of$250.00 made out to the"Sawyer County Zoning Administration"by Friday,
June 7,2002 for hearings in July 2002.

returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to

Sawyer County Board of Appeals. 0nly tlle Board of Appeals can grant the variance, the
recommendation of the Town of Winter is advisory only.
