My position is that if a building permit was not obtained at the time the average setback was determined, or prior to the change in the zoning ordinances, then any construction on said lot would be subject to the current zoning regulations and a minimum setback of 75 feet. This is for the purpose of constructing a new dwelling, 32' x 44'. I would like to take this opportunity to explain some of the history of this site and highlight a conversation John Gozdzialski, DNR Water Leader and myself had last Friday June 14, 2002 with General Kissinger. In 1994 our Department denied an application to fill in part of the wetland area on the lot, which General Kissinger appealed. On June 30, 1995 the Administrative Law Judge upheld our decision to deny the wetland fill as alternatives existed. On or about September 3, 1995 Department staff and now retired Zoning Administrator, Dave Heath met on site to look at alternatives with General Kissinger. Based on the 8-3-95-inspection report an agreement was made to locate the driveway around the wetland. The inspection report also lists the average setback distance of 58 feet from the ordinary high water mark (OHWM) of the lake. If General Kissinger has a valid permit from 1995 for a structure at 58 feet from the OHWM the Department does not object. However, if no permit was issued then we feel the Sawyer County Zoning ordinance as it is written today must be applied as it would to all new construction within Sawyer County. On Friday June 14, 2002 John Gozdzialski and myself discussed with General Kissinger what role the Deparkment of Natural Resources has played in the review of this lot to be developed as a residence. Our role has been in the review of the location of the driveway to avoid the impacts of fill placed in the wetland. This matter has been satisfactory resolved. The Zoning o�ce has aiways handled the setback issue. I hope that this explanation helps to keep the two issues separate regarding the driveway and the lake setback. If this is considered new development and a new application then the standards regarding the issuance of a variance must be applied. In other words, the party seeking the variance must prove that an unnecessary hardship will result if the variance is not granted. The granting of a variance cannot be to alleviate (or accommodate) a self-created hardship, or merely for self-convenience. See also, Section 59.694(7), Wisconsin Statutes. In the March 22, 2002 letter from Bill Christman to General Kissinger, Bill suggests that the building be located at least 75 feet from the lake and apply for a variance to reduce the setback from tha wetland. The Department agrees with that approach, however, the uitimate decision will be up to the Board. Unfortunately it will be impossible for me to appear personally at your board meeting, but my board would appreciate it if you could read, or distribute this memo to your board members . Sawyer Countys most valuable asset is its Water . It is at tne heart of the countys multi-million dollar recreational economy. If I were a Sawyer County offical I would protect this Water asset with every law at my disposal . The greatest threat to the countys water right now is run-off frort�xisting real estate and new development . As long as land owners and developers obey and conform to existing zoneing and development ordinances I have no problem. Its when numerous variances are requested to modify exting code that I object . The Kissinger request is tc�modify three set back distances on a lot that barely meets the 20 , 000 sq ft . size requirement . This is a speculative development, the person that purchases this property will no doubt need to request more variences later on to build a garage , and other out-buildings . There are no other property owners near this property to object because Kissinger owns all the acerage near it. Granting these varience requests would probably enable the developer to develop other lots that are also too close to wetlands and the Lake shore. The 57 foot set back from the lake would allow other lots that close to the lake to be developed. Request to build on this lot was denied in 1995. The owner must think that now because of a new board of appeals he can get it approved. Please do not allow that to happen. I ' ve been an Industrial building developer all my working life, and am fully aware that building according to zoneing code creates quality developments. Building with many variences creates slums.
