Please review the inspection report and the variance application for correctness. If the information on the application is correct, you should sign Yhe application and return it to this office with a check in the amount of$20.00 made out to the"Sawyer County Zoning Administration"by Friday,February I,2002 for hearings in March 2002. Your"Variance Application"will be reviewed at two public hearings. The first hearing will held by the Town of Ojibwa at 7:00 P.M.,Monday,March 11,2002.You should contact Dona Phelps,Town of Ojibwa Clerk,at(715)266-8655(home)to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday,March 19,2002,in the large courtroom located in the Sawyer County Courthouse. You or your representative should attend each hearing, especially the hearing conducted by the Sawyer County Board of Appeals.Only the Board of Appeals can grant the variance, the decision of the Town of Ojibwa is advisory only. It is your responsibiliry to convince the Board of Appeals to grant the variance that you have requested. Therefore, you should consider using any means at your disposal(i.e., photographs, drawings,a good verbal presentation, ete.)as you present your facts to the Board. You told me that a representative of the Department of Transportation(DOT)assured you that DOT would issue a driveway permit if the variance were approved. This is important,as the DOT is not obligated to issue a permit even if the County approves the variance. Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to 4:00 P.M., Monday through Friday. I assume that the purpose of the driveway may be to construct a dwelling on your property. This property is in the Agricultural One (A-1) zone district. A conditional use permit is required for the dwelling if you will not be engaged in agricultural activities. This also requires a public hearing before the Sawyer County Zoning Committee. Another option may be to change the zone district of the property to Residential/Recreational Two (RR-2). However, this may not be possible as the Sawyer County Zoning Committee may consider this to be spot zoning as the closest RR-2 property is more than 0.5 miles from your property. You should contact Mrs. Kitty Taylor about your options prior to making plans to build a dwelling. Yours truly, Wi ham A. It is recommended that either you or a representative be present at the Hearing. A lack of information about the situation may result in unnecessary delay of a decision. Failure to appear may result in the denial of the application. If it is impossible for a representative to be present, please submit a written statement to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This statement should include a description of the general terrain; surrounding development; your proposed intentions; and the purpose of the request.
