I believe tl�at this now concludes this matter, and I'm therefore going to go ahead and close my file
on this case.
If it appears that there will be a further appeal in this case, then I would assume that we need to get
our heads together and decide who would be handling that appeal.

It has been represented to this Court by the verified Petition of Michael A. Kelsey of
Haywazd,Wisconsin,heretofore filed that the Findings of Fact of the Sawyer Counry Boazd of
Appeals,dated at its meeting of May 21,2002,and pursuant to Notice of May 21,2002,pertaining
to a requested Application for Conditional Use Permit filed by Murray S.Julian was improper in that
the Sawyer Counry Zoning Committee's action was azbitrary,oppressive,and unreasonable and
represented its will and not its judgment,and the evidence presented to the Sawyer County Zoning
Committee did not support the findings of fact and the Committee could not reasonably make the
determination in question.
This Court is willing to be certified of all of the proceedings of the Sawyer County Zoning
Committee had in relation to the matter,and upon which the allegedly enoneous determination is
founded,and command that you certify and retum to this Court and file this Writ and your return
with the Clerk of the Court within sixty(60)days after the service of this Writ upon you,such return
to include all of the petitions,tape recordings of testimony and proceedings,and other documents
pertaining to the application for conditional use permit filed by Murray and Marie Julian had before
the Sawyer County Zoning Committee,so that this Court may further act on this matter as a right and
according to the law ought to be done,and have you then and there this Writ.

The Petition of Michael A.Kelsey respectfully represents to the Court that:
1. He is an attorney at law residing and practicing in the City of Haywazd,Sawyer
County,Wisconsin,and his post office address is P.O.Box 718,Haywazd,Wisconsin 54843.
2. He makes this Petition to the Court on behalf of the Petitioner, being duly
authorized to do so.
3. The name and post office address of the Petitioner is: Murray S. Julian,7633

4. The Sawyer County Boazd of Appeals is an agency created by ordinance of the
Sawyer County Board pursuant to the provisions of§59.97,Wisconsin Statutes,consisting of
three(3)members appointed by the Sawyer Counry Boazd. Current members of the Sawyer
Counry Boazd of Appeals,and their mailing addresses,aze:

5. By its decision of May 21, 2002, the Sawyer Counry Boazd of Appeals denied an
Application for Variance filed by Petitioner as follows:
Part of Govt Lot 2, S 25, T 41N, R 8W, Pazcel :2.6. Vol 539 Records Page 183.
1.84 total acres. Properry is zoned ResidentiaURecreational One. Appiication is
for the creation of two (2) substandazd lots, each having less than 100 feet in
width, by the purchaser. Variance is requested as Section 18.3, Sawyer County
Zoning Ordinance, would require a minimum lot width of 100 feet on a Class#1
lake. The Town Boazd has denied the application.
6. The Sawyer County Zoning Administration,by Cindy K.Yackley,Deputy Zoning
Commissioner, sent a letter dated May 21, 2002 to Murray S. Julian, and any other persons
aggrieved by the decision of the Sawyer County Boazd of Appeals, that they may commence an
acrion within thirty (30) days after the date of this Notice. A copy of said Notice is attached as
Exhibit A.
7. This Petition is made to the Court to obtain a Writ of Certiorari to require the
Sawyer County Boazd of Appeals to certify to this Court the proceedings relating to the
appropriate application for a variance by Murray Julian for purposes of review pursuant to
§59.99(10), Stats., Sawyer County Ordinance and the rules and by-laws adopted by the Sawyer
County Boazd of Supervisors.
8. The Petitioner herein is a person aggrieved by the notice dated May 21, 2002 by
the Sawyer County Boazd of Appeals, their interest in such matter being as follows:
Murray Julian is the property owner and taxpayer and owns the
property which is the property in question.
9. Petitioner seeks reversal of the decision of the Sawyer County Board of Appeals:
a. The Committee's actio� in denying the requested conditional use was
azbitrary,oppressive and unreasonable,and represented its will and not its judgment when it made
its findings of fact based upon the evidence presented and before it;specifically,there was ample
evidence provided by Petitioner relating to the appiication for a variance.
b. The evidence presented to the Sawyer County Board of Appeals was such
that the Sawyer Counry Board of Appeals could not reasonably make the order or determination
in question.
c. The Sawyer Counry Boazd of Appeals has granted similaz variances in the
past.
10. Petitioners respectfully request a hearing to present additional evidence and/or
written azgument in this matter, pursuant to Wis. Stats.

On May 21, 2002, the Sawyer County Boazd of Appeals denied your application for variance on
the following described real estate to wit:

the basis of economic gain. The Sawyer County Zoning Committee stated at its May 17 meeting
that they aze not in favor ofproperties being divided to have a width of less than 100 feet.
Any person or persons jointiy aggtieved by this decision of the Boazd of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future cosespondence, or in applying for permits, please

The Court's review on a Writ of Certiorari is limited to determining whether the Board
kept within its jurisdiction, acted according to law, acted arbitrarily or unreasonably, and whether
the evidence was such that the Board might reasonably make the order or determination it made.

A County Board of Adjustment is authorized to grant variances from the zoning
requirements "that will not be contrary to the public interest, where, owing to special conditions,
a literal enforcement of the provisions of the ordinance will result in unnecessary hardship, and
so that the spirit of the ordinance shall be observed and substantial justice be done."
This case presents itself ir� such a way that the Board of Adjustment seems a little
unreasonable. The court cannot substitute its judgment for that of the Board of Adjustment. The
court is limited in its review of the Board of Adjustment as to whether the Board kept within its
jurisdiction, acted according to law, did act arbitrarily or unreasonably and the evidence was such
that the Board could reasonably make the order or determination it did.
The zoning code provides for lot size of 100 feet or more. Any width less than 100 feet is

substandazd. If the purpose of the zoning code is considered it is clear that creation of
substandard lots is not looked upon with favor. The attempt in this case was to create two (2)
substandard lots.
The decision of the Sawyer County Board of Adjustment is affirmed.

The Sawyer County Board of Appeals,respondent, hereinafter referred to as `Board", by its
Acting Corporate Counsel, Ward Wm. Winton, respectfully submits this brief in opposition to the
Brief filed by Attorney Michael A. Kelsey, Attorney for Murray S. Julian, Petitioner.
I. Statement of Facts:
A. Procedural History: This matter came before the Sawyer County Zoning Board of
Appeals on May 21, 2002 pursuant to a petition for a variance filed by petitioner, Murray S. Julian.
The variance was filed to allow creation of two substandard lots which would have less than 100 feet
in width. Section 18.3 of the Sawyer County Zoning Ordinance would require a ininimum lot width
of 100 feet on a Class #1 lake.
Prior to the May 21, 2002 hearing by the Board, on May 14, 2002, the petition had been
submitted to the Town Board of the Town of Hayward, which had denied the petition for a
variance.

At the May 21, 2002 meeting, the Zoning Board of Appeals took evidence, listened to
testimony, and then, at the conclusion of the hearing, unanimously voted to deny the requested
variance.
Murray S. Julian, has filed this appeal following the adverse decision of the Board.
B. Statement of Facts:
Murray S. Julian and Marie K. Julian,husband and wife, received a Warranty Deed to their
lands dated May 18, 1968. A copy of that deed is attached as Attachment "A". The important
portion of the legal description is highlighted as follows:
A piece or parcel of land lying in Government Lot Two (2), Section Twenty-five (25),
Township Forty-one (41)North, Range Eight (8) West, herein described as follows: Commencing
at the Southwest corner of Gov. Lot 2;thence N 5°17'W, along the West line of Gov Lot, 471.7 feet;
thence N 72°13' E, 513.8 feet; thence N 60°30' E, 501 feet to the point of beginning; the�zce N
63°40' E, 200 feet; thence N 31°DO' W, 400 feet to the South shore of Round Lake; thence
Southwesterly along the shore of said lake 200 feet; thence S 31°00'E, 400 feet back to the poi�it
of beginning.
A reading of the legal description suggests that the lot's relevant dimensions are 200 feet of
lakeshore on Round Lake, and 400 feet deep.
A preliminary drawing prepared by Surveyor David Rieder, a copy of which is attached as
Attachment "B" shows that the lot has an actual width of 199.34 feet rather than 200 feet. A
drawing of the lots sought to be created indicates that each lot would have an actual width of 99.67
feet. See Attachment "C", attached.
Based upon the statements made by Attorney Michael A. Kelsey at the hearing to the Board
of Appeals, the Julians signed an offer to purchase to sell their lands, subject, however, to a
contingency that a variance could be granted to allow the creation of two substandard lots. The

Julians therefore filed their petition for a variance.
According to the variance application submitted by the Julians, the lots are in the
Residential/Recreational One zoning district.
II. Applicable Sawyer County Zoning Ordinance Provisions: Relevant sections are:
Section 4.415 Lake Class Development Standards and Lists of Lakes by Classification.
After adoption of this section, or an amendment thereto, no lot area shall be so reduced that
the dimensional and yard requirements required by this ordinance cannot be met. Parcels of land
existing and of record shall meet the minimum requirements of Section 4.25 and lots existing and
of record, i.e., documented by recording of a metes and bounds description; or a Certified Survey
Map; or a recorded platted subdivision, but of substandard size to the Lake Class Development
Standards are hereby not nonconforming to the parcel size. . . .
That section requires a 100 foot lot width for general development.
Section 4.417 List of Lakes Classification.
Round lake is classified as a Class #1 lake by Section 4.417 of the Sawyer County Zoning
Ordinance.
18.3 Minimum Lot Width without public sewer.
Section 18.3 of the Sawyer County Zoning Ordinance, entitled"Dimensional Requirements,
requires a minimum lot width of 100 feet for lots within the Residential/Recreational One zoning
classification. (See copy of Section 18.3, attached as Attachment"D".)
11.3 VARIANCES
11.31 The Board of Adjustment may grant upon application a variance from the dimensional
standards of this ordinance where an applicant convincingly demonstrates that literal enforcement
of the provisions of the ordinance will:
1) Result in unnecessary hardship on the applicant;
2) Due to special conditions unique to the property;
3) Such variance is not contrary to the public interest.

Under the section of the Zoning Ordinance dealing with Rules and By-laws of the Sawyer
County Board of Appeals,there are a number of sections which are applicable to this case:
Section 4.0 POWERS AND DUTIES OF THE BOARD
412 To authorize,upon appeal in specific cases,such variance of the zoning ordinance as
will not be contrary to the public interest where,owing to special conditions,a literal enforcement
of the provisions of the ordinance will result in unnecessary hardship and so that the spirit of the
ordinance shall be observed,public welfare and safety secured and substantial justice done. A
variance:
a)shall be consisYent with the spirit and intent of the zoning ordinance.
b)shall not permit any changes in the uses in the established zone district.
c)shall not be granted unless it is shown that the variance will not be contrary to the public
interest or damaging Yo the rights of property values in the area.
d)shall not be granted for actions which require an amendment to the ordinance.
e)shall not have tl�e effect of allowing a use or structure which is prohibited in that zone
district by the ordinance unless it determines that no feasible,legal use can be made of the
property without such vanance,provided no use variance may be granted in a floodplain or
wetland/shareland district.
f.shall not Ue granted on the basis of economic gain or loss.
g.shall not be granted for a self created hardship.
SECTION 12.0 Definitions
10)Variance:An action which authorizes the construction or maintenance of a building in
a manner inconsistent with the dimensional rcquirements of a zoning ordinance. A variance may
Ue granted only in cases of unnecessary hardship and when the spirit of the ordinance is not violated.
11)Unnecessary hardship:A unique and extreme inabiliYy to conform to the provisions of
a zoning ordinance due to physical factors which are not solely related to economic loss or gain. An
applicant mustprove unnecessary hardship.
III. Standard of Review: The standard of review is that same as that enunciated in State of
Wisconsin v. Ozaukee Couniy Board offldjustment, 152 Wis2d 552,449 N.W.2d 47(Wis.App.
1989),citing Snyder v. Waukesha Zoning Board,74 Wis.2d 468 at 475,247 N.W.2d 98(1976),as
follows:
1.Whether the Board kept within its jurisdiction.

2. Whether it proceeded on a correct theory of law.
3. Whether its action was arbitrary, oppressive, or unreasonable and represented its will and
not its judgment.
4. Whether the evidence was such that it inight reasonably malce the order or determination
in question.
In addition, case law also indicates additional canons of review. There is a presumption of
correctness and validity which is accorded to the Board's decision. Arndorfer v. Boa��d of
Adjustment, 162 Wis.2d 246, 469 N.W.2d 831 (1991), citing Snyder, supYa.
The plaintiffs, here the Julians, have the burden of overcoming the presumption of
correctness. Miswald v. Waukesha County Board ofAdjustment, 202 Wis. 2d 402 (Ct. App. 1996).
The findings of the board are conclusive if any reasonable view of the evidence would sustain
them. Clark v. Waupaca County Board of Adjustment, 186 Wis. 2d 300.
Finally, a reviewing court may not substitute its discretion for the Board's. See ArndoYfer,
above.
IV. Argument:
The standards for review are considered as follows:
The Julians do not raise the issue of whether the Board of Appeals kept within its
jurisdiction. There is no evidence in the record to suggest that the Board did not keep within its
jurisdiction.
Secondly is the issue of whether the Board proceeded using a correct theory of law. It
appears by the record that the Board carefully followed the provisions of the Sawyer County Zoning
Ordinance.

The Julians have a conforming lot at present. It measures 199.34 feet by 400 feet. They also
have a dwelling erected upon the lot which they can presently utilize. In the event that they wish to
remove the exisYing dwclling and construct another upon the lot,they can do so. They are not
presently restricted in their present use of their lands in any way. They are not restricted in using
their lot,as it now exists,in any way in the future under the provisions of the zoning ordinance.
The Julians wish,however,to subdivide their lot and create two new lots and erect two
dwellings thereupon. The lots sought to be created cannot comply with the dimensional
requirements of the zoning ordinance.
It appears that the Board applied Section 4.415 of the Zoning Ordinance which prohibits Yhe
reduction in the size of a lot so tUat it cannot meet the dimensional requirements of the ordinance.
The plainYiffs do noY dispute the application of Section 4.415 to the case at hand.
Section 18.3 of the ordinance specifies thaY the minimum width for development of lots in
the RRl zoning area is 100 feet. The plaintiffs do not dispute that this section also applies Co their
proposed land division.
The work of David Rieder,the Surveyor,showed that two conforming lots could not be
created upon the lands of the plaintiffs in accordance with the provisions of the zoning ordinance.
Under Section 11.3,Variances,tbe Julians had the burden of showing thaf the failure to grant
the variancc would result in an unnecessary hardship to the applicants,that the variance should be
granted due to special conditions which are unique to the property,and that such a variance was not
contrary to the public interest. The Board argues that the Julians failed to carry their burden of proof
with respect to these particular issues.
At the hearing,Board member Arvid Vallem raised the question ofwhat the Julians'hardship

would be. The Julians presented no argument or evidence to show that their current use of their
lands would be affected in any way by the failure to grant a variance. They argued "The reasonable
use of the property is that they, like everybody else, should be able to have two lots out of that
because other people have done that and reasonable use is to be able to separate the lot." (See the
Minutes of the hearing, page 5)
The hardship which the Julians suggest that they will experience is foregoing the economic
gain experienced by subdividing and selling two lake lots on Round Lake. Their hardship is in
foregoing future financial gain. Unfortunately, Section 4.12(fl of the Rules and Bylaws of the Board
of Appeals indicates that the Board may not make its decision based upon economic gain or loss.
The Board correctly determined that under section 11 .31 of the ordinance, the Julians had
not met their burden of showing unnecessary hardship.
Should the variance be granted due to special conditions unique to the property? The Julians
presented no evidence of any special conditions affecting the property except the evidence provided
by Surveyor David Rieder that the lot as it presently exists is not 200 feet in width.
The failure of a lot to meet the width requirements of the zoning ordinance is commonly the
incentive for a property owner to apply for a variance. To suggest that the special conditions which
would motivate the granting of a variance is the fact of nonconformity with the ordinance, is to
suggest that a variance would have to be granted in every case. That is nonsense.
Any "special conditions" affecting the property in this case are about to be created by the
Julians themselves when they subdivide the lot. In this case, the Board correctly determined that
there simply are no "special conditions" which would justify the granting of a variance.
Finally, was there evidence upon which the Board could determine that granting of the

variance would not be in the public interest?
A review of the minutes indicates that the Board had received and placed in the record,a
letter from the Wisconsin Department of Natural Resources,wriYeen by John Spangberg,a Water
Management Specialist. In his letter,Mr.Spangberg reviewed the rationale for shareland zoning,
which he identified as"to protect navigable waters from degadation and deterioration which results
from uncontrolled use and development of shorelands.". Spangberg also made the point that
minimum lot size helps to spread development and provides adequate space for waste disposal
systems,offers a separation between potentially intmsive or conflicting uses,and preserves ground
survace area for infiltration of rainfall and runoff,limiting nutrients running into the lakes. He also
commented upon the possible precedential effect of granting variances which reduce the lot size
requirement.
Other speakers at the hearing also expressed their concerns for the potential environmental
impact of allowing the routine creation of substandard lots by subdividing existing lots.
There was evidence in the recard to support a determination by the Board that the granting
of the variance would not be in the public interest.
The decision of the Board that the Julians had failed to meet their burden of proof to justify
the granting of a variance is supported by the evidence in the record.
The Board realized that this was a h-oublesome case,because of the small difference in the
measurement of land which mcans that a subdivision of the Julian lot would result in two
substandard parcels.
However,the difficulty for the 7ulians was that they could not show that they would have no
reasonable use of the property absent the granting of a variance. Further,the only hardship which

they could show would be the foregoing of a future financial benefit if they were able to sell two lots
upon which two dwellings could be constructed instead of one.
The decision of the Board of Appeals was not arbitrary nor capricious, but was based upon
ample evidence in the record.
The decision of the Board should be sustained by the Court upon review.

Ladies and Gentlemen:
I have reviewed the proposal by Murray and Marie Julian etux. for a variance from Shoreland
Regulations Section 18.3 of the Sawyer County ordinance which requires a minimum lot width
of 100 feet on a Class 1 lake, for the purpose of creating two substandard lots.
The basic purpose of the shoreland zoning ordinance is to protect navigable waters from
degradation and deterioration which resuRs from uncontrolled use and development of
shorelands. According to Wisconsin case law, re-affrmed in the recent Wisconsin State
Supreme Court decision State of Wisconsin v Kenosha Countv Board of Adiustment, when an
app�icant submits a request for a variance, he or she must show that unless a variance is
granted, he or she has no reasonable use of the property.
In other words, the party seeking the variance must prove that an unnecessary hardship will
result if the variance is not granted. The hardship must be the result of a unique condition of the
property or land, and not a condition personal to the landowner. The granting of a variance
cannot be to alleviate (or accommodate) a self-created hardship, or merely for self-convenience.

The minimum lot size helps to spread development and provides adequate space for waste
disposal systems, offers a separation between potentially intrusive or conflicting uses, and
preserves ground surface area for infiltration of rainfall and runoff, thus protecting the lake by
limiting the nutrients running into it, and minimizes the potential for aesthetic impact. Granting
variances that would reduce the lot size requirement could also set a precedent and have a
detrimental cumulative impact.
After reviewing the request by Murray and Marie Julian, the Department believes that none of
the above criteria are met. The lot can remain intact as is, and maintain all of its uses, with no
hardship upon the owner. Thank you for the opportunity to comment on this proposal.

for a variance on the following described real estate to wit:

containing 2.15 acres. Property is zoned Residential/
Recreational One. Application is for the creation of

requested ad Section 18.3, Sawyer County Zoning

The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship.
There would be no change in the use in the zone district. It would not be
damaging to the rights of others or property values. It would be due to special
conditions unique to the property. Road frontage includes the fact that the
existing house on lot 3 is at a zero setback from the lot line.
Any person or persons jointly aggrieved by this decision of the Board of Appeals
may commence an action in the Circuit Court for Writ of Certiorari to review
the legality of this decision within 30 days after the date of this notice.

your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, 634-4958 to obtain the time and confirm the date of the Town Board
meeting for your attendance or the attendance of your agent.
