On February 19, 2002, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:

tial/Recreational One. Application is for the installation of a driveway access onto
State Hwy. 27/70 with a setback distance of 90' and 100' from existing adjacent
driveways. Variance is requested as Section 4.23(1), Sawyer County Zoning Ordi-
nance, would require a setback distance of 500' from an existing driveway on a
state highway. The Town Board has approved the application.
The Board of Appeals approved the application with the covenants established by the Depart-
ment of Transportation.
Findings of Fact of the Board of Appeals: Zoning will enforce the DOT covenants. There would
be no change in the use in the zone district. It is not a self-created hardship, the lot was there.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 02-003.

MEMORANDUM OF RECORD
Re:Eugene R.Shumann,Driveway Variance(State Highway 27/70)
Today I discussed the Shumann driveway vaziance with Kathy Nault,Wis DOT,District
8 Permit Coordinator. See attached WisDOT letter to Eugene R.Shumann dated
November 28,2001.
My concerns were:
1. The WisDOT/Shumann letter states that there is a"vacated private driveway that
serves the abutting property adjacent to the west property line of your property." This
driveway is located on the Patsy C Scroeder pxoperty-parcel:8.8. The letter also
states that"If you can obtain a variance from the County,we will tben issue you a
permit to relocate the old culvert down Yo your property."
My question concemed how the WisDOT would be able to move the Scroeder culvert
down to the Shumann property. Kathy Nault stated t6at Mrs.Scroeder had been
contacted and that she had no objection to moving the culvert as they,the Scroeder's,
were using a driveway west of the vacated driveway anyway.
2. My second concern was does the WisDOT realize that the Shumann property is
substandard in size and therefore not buildable,and that the driveway was for
recreational purposes. Kathy Nault stated that she was aware of this situation and that
the WisDOT's agreement with Mr.Shumann would be that the driveway must be
removed if Mr.Shuma er sold the property.

Dear Mr. Shumann,
Enclosed please find an application for variance for placement of a driveway access less than the
required 500 feet from existing driveway accesses.
In order to accept this application, this office requires confirmation in the form of a copy of your
letter from DOT, that a driveway permit would be issued if the variance is approved.
It will also be necessary to stake the driveway site. Then our Code Enforcement Officer can
make accurate measurements and if necessary we can adjust the wording on the variance
application.
If the signed application and DOT letter are returned with the variance fee of $250.00 by Friday,
January 4, 2002, your application will be scheduled for public hearings in February.
Please contact the zoning office with any further questions about this variance.

Thank you for your assistance with my variance papers requesting a driveway permit.
I have enclose the signed application along with a check for 5250.00 and very
possibly duplication of information that I may have faxed to you.
Mr.Ted Wuebben from Birchwood will be representing me at the meeting on February
19, 2002. I will be calling you closer to that date to find out if there are any
objectors. I would assume that the meeting will be held in the Sawyer County Court
House.

Dear Mr. Shumann:
This is in response to your letter, dated November 12, 2001 to Mr. Mentzel, regarding a
driveway access to your pazcel on STH 27/70.
As I stated to you by phone last year, there is a vacated private driveway that serves the abutting
properry adjacent to the west property line of your property. The DOT is willing to issue a
permit to you to relocate this driveway onto to your property..
Since there is a problem with Sawyer County Spacing requirements on driveways, you will still
need to obtain a variance from the Counry. Sawyer County has a spacing requirement of 500'
between driveways.
If you can obtain a variance from the County, we will then issue you a permit to relocate the old
culvert down to your property. We will also require you to sign a covenant stating the following
restrictions:
1. Access is for camping purposes only
2. Access must be gated during the winter months
3. If the property is sold to abutting owners,the driveway will be removed.
If you have any further questions concerning this matter, please give me a call at 715-392-7944.

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you ar a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain do not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact
the Town Clerk, Elaine Nyberg, 16199W Musky Point Drive, Stone Lake WI 54876,
715/865-2486, to obtain the time and confirm the date of the Town Board meeting for
your attendance or the attendance of your agent.
