Re: Correction to the letter of February 21,2002.
Dca:.Sr. ,zdirs. Sharmer;
On February 21,2002 this office sent you a letter stating that the Board of Appeals had
denied your application for a variance and ordered that the addition, deck and supports
be removed by June 1,2002. Also, the re-roofing plans were to be submitted to the
Zoning Office for the Administrators approval before construction.
This letter is to inform you that after reviewing the tape of that meeting, it was found
that the support beams may remain in place and do not need to be removed as earlier
mentioned.
If you have any questions in regards to this matter, please contact myself or the Zoning
Administrator.
Yours truly,

Dear Mr. and Mrs. Scharmer,
On February 19, 2002, the Sawyer County Board of Appeals denied your application for vari-
ance on the following described real estate to wit:
Part of Govt Lot 4, S 9, T 39N, R 7W, Parcel :4.2. WD Vo1424 Records Page 221 .
Approximately 100'x340' containing .78 acres. Property is zoned Residen-
tial/Recreational One. Application is for an after-the-fact variance for the con-
stnlction of an approximately 22'x42 sccond story addition with an attached 8'x42'
open deck onto an existing dwelling at a setback distance of 32' from the ordinary
high water mark of Blueberry Lake. Variance is requested as Section 4.49(2), Saw-
yer County Zoning Ordinance, would require a lake setback distance of 63' as the
average lake setback was determined at that distance from the lake. The Town
Board has approved the application.
The Board of Appeals denied the application and ordered that the addition, deck and supports be
removed by June 1, 2002. Also, re-roofing plans are to be submitted to zoning for the adminis-
tratar's approval before construction.
Findings of Fact of the Board of Appeals: It would be damaging to the rights of others or prop-
erty values. It would not be due to special conditions unique to the property. Applicant has sub-
stantially changed the structure of the building. It is not in the best interest of zoning. It is a self-
created hardship.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 02-002.

cause the variance application to be rejected by this office.
Your "Variance Application"will be reviewed at two public hearings. The first hearing

RE: Parcel :4.2, S 09, T 39N, R 07W, Town of Radisson, #6789N Brecke Lane:
Violations of the Sawyer County Zoning Ordinance
Dear Mr. Scharmer:
On Thursday, December 13, 2001 Eric VJellauer, Sawyer County Zoning Administration
Code Enforcement Officer, and myself visited your property. The purpose of the visit
was to address a complaint that the construction activities related to your cabin exceeded
those indicated on Land Use Permit (LUP) #01-058.
On April 12, 2001 this office issued LUP #01-058 to you for the "alteration ' and `'reroof
42' of cabin." The permit application also states "reroof existin cabin." The
construction cost was stated as $?500.00. Our visit to the property revealed that a second
story addition and an approximately 8' x 42' second story deck have been constructed
above the existina cabin. Additionally, exterior pipes at the rear of the cabin L:e
apparently been connected to the existin holdine tank.
The 50% current estimated fair market (CEFMV) rule applies in this situation as the
cabin is a nonconforming structure— it is closer than 75' to the lake. The "50% rule"
restricts the cost of improvements to a nonconforming structure to no more than 50% of
the CEFMV of the structure. A variance for construction activities exceeding 50%
CEFMV must be granted by the Sawyer County Board of Appeals. The Board rarely
grants such variances.
The costs related to the 50% CEFMV are the costs of materials (i.e., siding, roofin.
exterior windows and doors, sheathing, wall studs rafrers and trusses, insulation and
sheetrock, and in this case the supporting steel posts, etc.) and labor to enclose an
addition. Costs related to plumbing, heating electrical, window and floor coverings etc.;
are not related to the 50% CEFMV. I am requesting that you provide me with an
inventory of all materials used, to include retail cost, and the number of hours worked
during the construction of the addition and deck.
An addition constructed onto a nonconforming structure may not be constructed closer to
the lake than the "average lake setback" for that structure (the cabin). The average lake
setback for the cabin is 63 feet; however, both the deck and second story addition aze
32'/40' from the lake. The Sawyer County Boazd of Appeals must grant a variance for
construction activities closer to the lake than the average lake setback (63'). The Boazd
rarely grants such variances.
A licensed plumber must make the connection(s) to the holding tank. The plumber must
make application for a sanitary permit and have the permit properly issued prior to
making this connection.
Based on the visit, the following zoning violations exist with this situation.
1. Falsifying permit application (Land Use Permit) - $458.00.
2. Setback violation from navigable waters - $335.00.
There is also of a violation of Wis. Stats. Chapter 145, Plumbing and Fire Protection
Systems and Swimming Pool Plan Review, 145.06 License or registration required;
CXelTlpt1011S. 1 :1`.' 1P,ClIdE'C u :Oy Gi iiliS SCLil011 1LII I111J ICLLCI".
I shall issue citations for the above violations. As a part of the citations I will recommend
that the Court order the removal of the addition and deck by June 1, 2002.
Please contact this office if you have any questions or comments. Office hours are 8:00
A.it. to 4:00 P.M, Monday through Friday.
Sincerely yours,

Discussion:
To qualif} for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sa1er Countv
Zonine Ordinance«ould rzsult in unnecessaR hardship.Present[6"isconsin case lmr
clescribes hnrdship as berng present only i+{ien nn npplieant has ciema7stratecf thnt he
or she 1ii11 haie no reasonnble use ojthe poperry, in the absence of n varince. If a
parcel as avhole(but not necessarily each portion of the parcel)proides some
reasonable use for its oener, then the test is not met and aariance cannot be eranted.
A'ariance cannot be eranted because of a self-imposed hardship(i.e.,purchasing
propertyvith limitations and expecting that a variancevould be erantzd to relieve
these limitations).A variance also cannot be eranted, vhen in the absence of the
cariance approval, the ownercill suffer loss of profit or financial hardship.Decks
and similar minor accessor} structures are not essential to the reasonable use of
property and are not eliible for variances.
2) The hardship must be due to unique phsical limitations of the propert hich are not
eeneralh shared b other properties.Groine famifies,additional liinarea fo;
guests, the desire for a larer garage etc.,are not factors in decidine variances.
3) A variance ma not be erantedvhich results in harm to oublic intzrests. The Sayer
County ZoninOrdinanceas adopted'`fur the promotion and protection of the
public health,morals,safety,and the generai«elfare."Additionall},the shoreland
zoninpro'isions of the Ordinance, proidzs for water qualit},ildlife habitat,
tisherizs and natural scenic beaut} protection of the Count}'s lakes, riers and
streams
4) Other considerations:
a. Szlf-created hardships.A property o«ner ma}not obtain aariance for a hardship
that is self-imposed.Examples include:creating a substandard lot«hen the oner
has sold off poRions thatcould have precented the hardship.creating a land-
locked parcel by selling propeRy,building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bv nei¢hbors. In State u. Kenosha Counry Board ofAdjusrment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
propeRy without a deck.
c. Variances run with the propertv. Variances are granted for hardship that peRains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.
Do you qualify for a variance based on the "reasonable use of property standard"
affirmed in these court decisions and the above discussion on the criteria for the granting
of variances? Yes` _ or No_
If you answered "No" to the above question, you do not qualif} for a variance.
If you answered "Yes" to the above question:

Re: Correction to the letter of February 21, 2002.
Dear Mr. and Mrs. Scharmer;
On February 21, 2002 this office sent you a letter stating that the Board of Appeals had
denied your application for a variance and ordered [hat the addition, deck and supports
be removed by June 1, 2002. Also, the re-roofing plans were to be submitted to the
Zoning Office for the Administrators approval before construction.
This letter is to infortn you that after reviewing the tape of that meeting, it was found
that the support beams may remain in place and do not need to be removed as eazlier
mentioned.
If you have any questions in regazds to this matter, please contact myself or the Zoning
Administrator.
Yours truly,

Ladies and Gentlemen: v.-.
1 have reviewed the proposal by Daniel and Janet Scharmer etux. for an after-the-fact variance
from Shoreland Regulations Section 4.49(2) of the Sawyer County ordinance which requires a
minimum setback of 63' as the average lake setback from Blueberry Lake. They constructed a
22' x 42' second story addition with an attached 8' x 42' deck to an existing dwelling, at a
setback distance of 32' from the OHWM.
The basic purpose of the shoreland zoning ordinance is to protect navigable waters from
degradation and deterioration which results from uncontrolled use and development of
shorelands. According to Wisconsin case law, re-affirmed in the recent Wisconsin State
Supreme Court decision State of Wisconsin v. Kenosha County Board of Adjustment, when an
applicant submits a request for a variance, he or she must show that unless a variance is
granted, he or she has no reasonable use of the property.
In other words, the party seeking the variance must prove that an unnecessary hardship will
result if the variance is not granted. The hardship must be the result of a unique condition of the
property or land, and not a condition personal to the landowner. The granting of a variance
cannot be to alleviate (or accommodate) a self-created hardship, or merely for self-convenience.
See also, Section 59.694(7), Wisconsin Statutes.
The minimum setback helps to spread development and provides adequate space for waste
disposal systems, offers a separation between potentially intrusive or conflicting uses, and
preserves ground surface area for infiltration of rainfall and runoff, thus protecting the lake by
limiting the nutrients running into it, and minimizes the potential for aesthetic impact. Granting
variances that would reduce the setback requirement could also set a precedent and have a
detrimental cumulative impact.
After reviewing the request by Daniel and Janet Scharmer, the Department believes that none
of the above criteria are met, the lot has buildable area at a setback farther from the lake that
would minimize environmental effects, and recommends that the board deny the request.
Thank you for the opportunity to comment on this proposal.
Sincerely,
, _ ..

Janet M. and Daniel W. Scharmer
Re: Part of Gov't lot 4, S 9, T 39N, R 7W; Parcel :4.2.
Dear Mr. and Mrs. Scharmer,
Your application for a variance will be considered at a Public Hearing before the
Sawyer Counry Zoning Board of Appeals on
19 February 2002
This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack
of information about the situation may result in unnecessary delay of a decision.
Failure to appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement
to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; sunounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, Jeamme Hanson; 715/945-2285 to obtain the time and confirm the date of
the Town Board meeting for your attendance or the attendance of your agent.
