Scharmer RRl Box 90 Houston, WI 55943 RE: Parcel :4.2, S 09, T 39N, R 07W, Town of Radisson, #6789N Brecke Lane: Violations of the Sawyer County Zoning Ordinance Dear Mr. Scharmer: On Thursday, December 13, 2001 Eric VJellauer, Sawyer County Zoning Administration Code Enforcement Officer, and myself visited your property. The purpose of the visit was to address a complaint that the construction activities related to your cabin exceeded those indicated on Land Use Permit (LUP) #01-058. On April 12, 2001 this office issued LUP #01-058 to you for the "alteration ' and `'reroof 42' of cabin." The permit application also states "reroof existin� cabin." The construction cost was stated as $?500.00. Our visit to the property revealed that a second story addition and an approximately 8' x 42' second story deck have been constructed above the existina cabin. Additionally, exterior pipes at the rear of the cabin L��:e apparently been connected to the existin� holdine tank. � The 50% current estimated fair market (CEFMV) rule applies in this situation as the cabin is a nonconforming structure— it is closer than 75' to the lake. The "50% rule" restricts the cost of improvements to a nonconforming structure to no more than 50% of the CEFMV of the structure. A variance for construction activities exceeding 50% CEFMV must be granted by the Sawyer County Board of Appeals. The Board rarely grants such variances. The costs related to the 50% CEFMV are the costs of materials (i.e., siding, roofin�. exterior windows and doors, sheathing, wall studs rafrers and trusses, insulation and sheetrock, and in this case the supporting steel posts, etc.) and labor to enclose an addition. Costs related to plumbing, heating electrical, window and floor coverings etc.; are not related to the 50% CEFMV. I am requesting that you provide me with an inventory of all materials used, to include retail cost, and the number of hours worked during the construction of the addition and deck. An addition constructed onto a nonconforming structure may not be constructed closer to the lake than the "average lake setback" for that structure (the cabin). The average lake setback for the cabin is 63 feet; however, both the deck and second story addition aze 32'/40' from the lake. The Sawyer County Boazd of Appeals must grant a variance for construction activities closer to the lake than the average lake setback (63'). The Boazd rarely grants such variances. A licensed plumber must make the connection(s) to the holding tank. The plumber must make application for a sanitary permit and have the permit properly issued prior to making this connection. Based on the visit, the following zoning violations exist with this situation. 1. Falsifying permit application (Land Use Permit) - $458.00. 2. Setback violation from navigable waters - $335.00. There is also of a violation of Wis. Stats. I shall issue citations for the above violations. As a part of the citations I will recommend that the Court order the removal of the addition and deck by June 1, 2002. They constructed a 22' x 42' second story addition with an attached 8' x 42' deck to an existing dwelling, at a setback distance of 32' from the OHWM. The basic purpose of the shoreland zoning ordinance is to protect navigable waters from degradation and deterioration which results from uncontrolled use and development of shorelands. According to Wisconsin case law, re-affirmed in the recent Wisconsin State Supreme Court decision State of Wisconsin v. Kenosha County Board of Adjustment, when an applicant submits a request for a variance, he or she must show that unless a variance is granted, he or she has no reasonable use of the property. In other words, the party seeking the variance must prove that an unnecessary hardship will result if the variance is not granted. The hardship must be the result of a unique condition of the property or land, and not a condition personal to the landowner. The granting of a variance cannot be to alleviate (or accommodate) a self-created hardship, or merely for self-convenience. See also, Section 59.694(7), Wisconsin Statutes. The minimum setback helps to spread development and provides adequate space for waste disposal systems, offers a separation between potentially intrusive or conflicting uses, and preserves ground surface area for infiltration of rainfall and runoff, thus protecting the lake by limiting the nutrients running into it, and minimizes the potential for aesthetic impact. Granting variances that would reduce the setback requirement could also set a precedent and have a detrimental cumulative impact. After reviewing the request by Daniel and Janet Scharmer, the Department believes that none of the above criteria are met, the lot has buildable area at a setback farther from the lake that would minimize environmental effects, and recommends that the board deny the request.
