Subject: Operation of houseboats on the Chippewa Flowage ' � ��''#�� '
Dear Mr. Davis:
This letter responds to your request for information on regulations that would apply to a proposed
houseboat rental business on the Chippewa Flowage, in Sawyer County. I have reviewed your request
with several staff in our regional and central of�ces. In brief, we conclude that the Department of Natural
Resources, the Lac Courte Oreilles Band of Lake Superior Chippewas, the US Forest Service, Sawyer �
County Zoning, the Xcel Energy, Inc., and others would each regulate some of the activities described in
your proposal to operate a houseboat rental business on the Chippewa Flowage.
As described in this letter, there are a number of obstacles and issues that need to be addressed prior to
operating a houseboat rental service on the Chippewa Flowage. But regardless of the regulations, the
Department would oppose this proposal because of our commitment to minimize development and its
intrusion on the natural, visual landscape on the Flowage. All partners to the Chippewa Flowage Joint
Agency Plan have pledged their efforts towards this goal with broad and clear support of the genera(
public.
Camping on the Chip�ewa Flowa�e
In August, 2000, the Department of Natura( Resources formally signed the Chippewa Flowage Joint
Agency Management Plan with the Lac Courte Oreilles Band of Lake Superior Chippewas and the U.S.
Forest Service. This Plan provides guidelines for public recreational activities within the Flowage
Management Area. The Plan intent is to protect the natural cliaracter of the flowage area and maintain the
high quality of its natural resources, its recreational opportunities, and traditional tribal uses for religious,
ceremonial, medicinal, subsistence and economic purposes over the long term.
The Joint Agency Management Plan as wel! as existing state regu�ations control all camping on public
lands and waters within the Flowage Management Area. Under the Plan, camping is limited to designated
public pritnitive campsites. The state currently offers eleven campsites on state owned islands.
Development and designation of additional campsites must be reviewed and approved by the three
partners to the Plan. At this time, the Department does not intend or plan to add any new campsites on the
Chippewa Flowage.
The Department further regulates camping activities under Administrative Code Chapter NR 45 which
governs visitor conduct and use of lands owned by the Wisconsin Department of Natural Resources. On
the Chippewa Flowage, this includes many of the islands and approximately half of the shoreline. This
code regulates camping, recreational boating, vehicle use, shoreline protection zones, and other
recreational uses.

Camping away from the designated sites or camping on the main shoreline is not permitted on state-
owned lands on the Chippewa Flowage. Campers must occupy the designated campsite. Using houseboats
for temporary residence or sleeping purposes is considered campir►g. Section NR 45.10(1) prohibits
camping, except at designated campsites. Visitors camping away from designated campsites would be
subject to evictions, forfeitures, and other actions by the Department. Mooring a houseboat at an island
campsite hut ret�aining.overnight on the boat is not permitted. On the Chippewa Flowage, houseboats
could only-}�u'sed�dk lodging or sleeping on those lands and areas of the waterway not owned by the
Departnient or cove`red by the Joint Agency Management Plan. If your customers intend to stay overnight
on-the�ouseboat, th�y�,would have to moor elsewhere on private lands where camping privileges have
" been granted and that"activity is permitted.The river channels adjacent to state-owned lands and the
� nat�rral�tal�e bo:�toms are also under state ownership, so overnight mooring in these areas would not be
permitted�ince,�liey are not a designated campsite on state lands.
No more than one camping party may occupy a single campsite. A camping party consisting of non-
family group may not exceed 6 persons. Mooring along the main shoreline but camping on the houseboat
is not permitted since there are no designated campsites on state lands except on the islands away from
the shoreline.
Camping permits are not required at this time but camping is provided on a first come-first serve basis.
Length of stay by one camping party can not exceed 10 days.No reservations for campsites are accepted
at this time. Campsites may not be"saved" by placing camping equipment several days in advance of
occupying the campsite.
No boat or aircraft may be left on shore, moored, or anchored overnight in the waters of any state park,
state natural area, recreation area or forest recreational area except in areas designated for that purpose or
on state-owned islands designated for camping. Additional regulations on noise standards would prevent
the operation of on-board generators, air-conditioners and other mechanical devices while camping at the
state-owned campsites.
If the houseboats are primarily used as a lodging unit and not actually used as a means of navigation by
the occupants, they would most likely meet the definition of a"fixed houseboat"and be in violation of
sec. 30.I21(Z), Wis. Stats., which prohibits the placement of fixed houseboats beyond the ordinary high
water mark of any navigable waterway. They would also be considered as unauthorized structures on
lakebed.
The Lac Courte Oreilles Band of the Lake Superior Chippewas owns and manages lands around the
Chippewa Flowage. Many of the islands are tribally owned especially on the portion of the flowage east
of County highway CC. Camping on the islands is generally open only to tribal members. I suggest you
contact the LCO Tribal Government Center,Natural Resources office to understand how their regulations
apply to your proposaL LCO is a partner to the Chippewa Flowage Joint Agency Management Plan. Dan
Tyrolt, LCO environmental engineer (715-865-2329) or George Morrow, LCO Head Tribal warden
(715-634-8934) may be appropriate contacts.
The USDA US Forest Service also owns shorelands and a few islands aloug the far east side of the
flowage as part of the Chequamegon-Nicolet National Forest. You should contact this agency to
understand their camping regulations.The US Forest Service is a partner to the Chippewa Flowage Joint
Agency Management
The Department would request that all partners maintain full compliance with the recreational camping
policy as agreed to under the Joint Agency Management Plan

� This new commercial operation would be subject to Sawyer County Zoning regulations for the RR-1
� District and would require, at minimum, for tl�e (andowner to obtain a conditional use permit for this
activity. This process would involve an application review period with public notice and a hearing. At this
time, due to the serious concerns about the protection of natural character and habitat on the Chippewa
Flowage,the Department would recommend that Sawyer County deny this conditional use permit.

Restrictive Covenants
In many locations on the shorelands around the Chippewa Flowage, the 1984 Chippewa Reservoir
Settlement Agreement established buffer zones around the flowage to protect the immediate shoreline and
istands from further development. Landowners holding lands within these zones must comply with the
restrictive covenants conveyed on property deeds when these lands were originally purchased.
Most of the Chippewa Flowage shorelands within Section 6 Township 40 North Range 6 West are
subject to the 100 Foot Buffer Zone Covenant described on deeds of record for each property. Dun
Rovin Lodge, a commercial development, is located within one of these protection zones and the
Department believes these covenants significantiy limit the activities that may occur within 100 feet of
the 1313-ft mean sea (evel elevation. You may wish to investigate this issue further to avoid any conflict
with the restrictive covenants caused by this new commercial development. The covenant clearly includes
a reversionary provision if the current property owner violates the terms of the covenant and restrictions.
Operation of houseboats on navi�able waters of Wisconsin
State laws and regulations concerning the surface waters of the flowage are under the jurisdiction of the
Department.
Under s 30.50(1), Wis. Stats.,the proposed 10' x 35' houseboats would have to be registered and issued
a certificate of number for operation in Wisconsin. The 16' boat being towed by the houseboat would
also have to be registered and issued a certificate of number.
Under s. 30.60, Stats., based on length,the houseboats would be classified as Class 2 motorboats and the
l6' boat would be ciassified as a Class 1 motorboat. Class 1 and 2 motorboats when underway at any
time from sunset to sunrise shall carry and have lighted the following lamps:
� =? For Class 2 motorboats, one lamp must be displayed in the fore part of the boat as near the
stem as practicable, so constructed as to show an unbroken bright white light over an arc of
the horizon for 225 degrees of the compass and so fixed as to throw the light from directly
ahead to 2 points abaft the beam on either side. For Class 1 motorboats, the front light may be
a combination red/green bow light displayed over an unbroken arc of horizon for 225 degrees
of the compass from directly ahead to 2 points either side of tlle beam.
(b) For Class 2 motorboats, one lamp must be displayed aft showing a bright white light all
around the horizon and higher than the white light forward. Class 1 motorboats must display
an aft light all around the horizon.
(c) On the starboard side, one lamp showing a green light, and on the port side,one lamp
showing a red light, both fitted with inboard screens of sufficient height and set as to prevent
these lights from being seen across the bow. Each such side light shall be constructed as to
show an unbroken light over an arc of the horizon covering 225 degrees and shall be fixed as
to throw light from directly ahead to 2 points abaft the beam on its respective side.

All Class 1 and 2 motorboats when moored, anchored, or drifting outside designated mooring areas or
beyond 200 feet from the shoreline are required to be lighted from sunset to sunrise by a white light
visible all around the horizon.
Every white light prescribed by this section shall be of such character as to be visible at a distance of at
least 2 miles on a dark, clear night. Every colored light prescribed shall be visible at a distance of at least
one-rnile on a dark, clear night.
These boats shall be equipped with fire extinguishers of such numbers, size, and type capable of prompt(y
and effectively extinguishing burning gasoline. One or two fire extinguishers will be required on the
Class 2 motorboats, depending on the type of extinguisher and size.
Storage batteries shall be provided with suitable supports and secured against sifting with the motion of
the boat. Such batteries shall be equipped with a non-conductive shielding means to prevent accidental
shorting of battery terminals.
Each motorboat must be equipped with approved personal flotation devices(PFD) for every passenger.
All PFDs must be easily accessible and wearable PFDs must be the proper size for the intended wearer.
In addition,the houseboat must be equipped with at least one approved Type IV throwable device.
No person may anchor, place, affix, or abandon any unattended boat, raft, float, or similar structure in the
traveled portion of any river or channel or in any traffic lane established and legal(y marked, so as to
prevent, impede, or interfere with safe passage of any other boat through the same. General ly any boat left
anchored for more than 24 ho��rs in a spot other than a recognized mooring space would be considered an
obstruction to navigation in violation of Section 30.15, Wi. Stats.
All sewage and gray water must be contained so that there is no possibility of discharge to a waterway.
Only a licensed septage hauler can empty holding tanks. Also, pumping or transfer of septage would not
be allowed on state property, which wou(d include the boat landings.
Other agencies to contact
Changes to the water supply and sewage handling systems at the Dun Rovin Lodge as a result of this
houseboat operation may be subject to review and inspection by the Division of Public Health, Wisconsin
Department of Health and Family Services.
Under exemption from licensing granted by the Federal Energy Regulatory Commission, Xcel Energy
operates the Chippewa Flowage as a storage reservoir with seasonal drawdowns to moderate high and low
flow extremes in the Chippewa River. Under the same authority,the Lac Courte Oreilles Band of Lake
Superior Chippewas operates the powerhouse at the dam for hydroelectric generation. Xcel Energy holds
most of the rights to the flowage bottom. You may wish to contact them regarding regulations that would

Because these houseboats will be used for conunercial purpose, they may be subject to applicable U.S.
Coast Guard standards. I did not research this issue but you may want to seek clarification with their
office.
